PRESENT: Spitzer, Schletty and Vail ABSENT: LaValle and Irsfeld 3.0 APPROVAL OF MINUTES MOTION: Vail made motion, seconded by Schletty, to approve the minutes of October 1 , 1979, as submitted. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED MOTION: Schletty made motion, seconded by Vail, to approve the minutes of October 8, 1979, after the following insertion is made: After the meeting was called to order - The Special Meeting was held on a legal holiday in order to assure the presence of a quorum. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Schletty made motion, seconded by Vail, to approve the General Claims for October 15, 1979, as submitted. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED MOTION: Vail made motion, seconded by Schletty, to approve the Utility Claims for October 15, 1979, as submitted. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES MOTION: Schletty made motion, seconded by Vail, to deviate from the published agenda and take up items relating to Stan's Withrow Junction. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED STAN"S WITHROW JUNCTION MOTION: Vail made motion, seconded by Schletty, that the City accept the petition regarding Stan's Withrow Junction. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED OCTOBER 15, 1979 143: STAN'S WITHROW JUNCTION - Continued Spitzer also made as part of the record a letter received form Mrs. Mary Ecker rep- resenting CONCERNED CITIZENS OF HUGO AT WITHROW. This letter listed several complaints relating to the exterior activities around Mr. Lynn's bar. Attorney Johnson had submitted a letter stating the changes he has suggested in the drafted ordinance relating to nude dancing in premises selling intoxicating liquor. The Council reviewed these proposed changes. Mr. George Knutson, 10051 Kerry Court, stated that this type of entertainment was an imposition on local residents. The rights of many people are greater than those of one individual. This type of entertainment does not help the image of a community. Mrs. Linda Rosenbush, 12011 Keystone Avenue, stated that she lives across the street from Stan's and has three small children. This is not the type of atmosphere she wants to raise her children in. On October 5, she had to keep her children indoors because of the activity outside of Stan's bar. She did not care for the type of people this kind of activity brought into the .community. Spitzer directed the Police Department to investigate the complaints listed in the letter received form Mrs. Ecker. MOTION: Schletty made motion, seconded by Vail, that the proposed ordinance regulating entertainment in premises selling intoxicating liquor be referred to the Ordinance Committee. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED Mr. Lynn arrived at the meeting at this point, and stated that he was informed that the meeting did not start until 7:30 P.M. He stated that he was not aware of the activities outside of his establishment as stated in Mrs. Ecker's letter. He also stated that the flyer regarding "girl show" at his establishment was distributed by his authority. 5.1 Walter Stoltzman - Farm Site Plan Mr. Stoltzman, 8221 157th Street North, would like to construct a 32x 48 pole barn to be used for repairing of his own equipment and storage. MOTION: Schletty made motion, seconded by Vail, to approve the Farm Site Plan for Walter Stoltzman, to construct a 32 x 48 pole barn to be used in the repairing of his own equipment and for personal storage. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 5.2 Richard Brandt - Farm Site Plan Mr. Brandt, 9950 152nd Street North, would like to construct a 40 x 60 barn to be used for storage. He owns 20 acres in the Conservancy zone. 1 4 4 OCTOBER 15, 1979 Richard Brandt - Farm Site Plan Continued MOTION: Schletty made motion, seconded by Vail, to approve the Farm Site Plan for Richard Brandt, to construct a 40 x 60 pole barn to be used for his personal storage. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 5.3 Jerome Jesson - Renew of Mobile Home Permit MOTION: Vail made motion, seconded by Schletty, to renew the Mobile Home Permit for Jerome Jessen, 7475 132nd Street North, under Chapter 40, Article III, Subdivision D, for a period of 90 days. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 5.4 Safeway House Movers - Amended Special Use Permit Mr. Semple has made application to move in a 28 x 36 cold storage building. MOTION: Schletty made motion, seconded by Spitzer, to approve the Amended Special Use Permit for Safeway House Movers, to move in a 28 x 36 cold storage building. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 5.5 Hugo Feed Mill - Special Use Permit Mr. Marier would like to construct a grain storage building, 30' in diameter and 30' high. The location for the proposed building is in the Industrial zone. The pro- posed site is located on property that is leased form the railroad. Spitzer asked that a copy of this lease be obtained for the City's records. MOTION: Schletty made motion, seconded by Vail, to approve the Special Use Permit for Hugo Feed Mill, to construct a grain storage building on the southeast corner of the existing warehouse. Mr. Marier to pro- vide a copy of his lease with the railroad. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 5.6 Wayne Scanlon - Deleted ! A OCTOBER 15, 1979 1 ` 5.7 George Indykiewicz - Renew of Mining Permit Mr. Kuusisto stated that after inspection of the mining area, some side slopes were getting steep on the south side, and there was a..considerable amount of debris surrounding the two buildings. Mr. Indykiewicz stated that he would see to it that the area was cleaned up, and he would be filling around the steep slopes. MOTION: Vail made motion, seconded by Schletty, to approve the Mining Permit for George Indykiewicz until November 1 , 1980, subject to proper bond and certificate of insurance. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS 6.1 Review Ordinance for Site Plan RB & CB District MOTION: Schletty made motion, seconded by Vail, to refer the proposed Ordinance for Site Plan approval in the RB & CB District to the Ordinance Committee. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED Attorney Johnson will further review the proposed Gambling Ordinance. 7.0 UNFINISHED BUSINESS 7.1 County Owned Land - No discussion 8.0 NEW BUSINESS The City Clerk received a summons regarding the Matthew Hicks accident. The City has 20 days in which to respond. MOTION: Spitzer made motion, seconded by Vail, that Attorney Charles Johnson be instructed to contact the city's insurance carrier relative to the summons received by the city (Matthew Hicks) in an attempt to dispose of this matter. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED The Clerk has received a bill form Mr. Charles Beach for tree inspection in the City. This bill was submitted for work performed prior to the city's officially hiring Mr. Beach as the Tree Inspector (September 17, 1979) . The Clerk was instructed to return the bill to Mr. Beach stating the conditions of his employment. MOTION: Spitzer made motion, seconded by Schletty, that the City Clerk be instructed to obtain a cost estimate to purchase a United States Flag along with a new light. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 1[46 October 15, 1979 Clerk - Continued The Clerk stated that the Building Inspector will be on vacation the week of 10/15/79 and work will be absorbed by Washington County. Planning Commission member Mike McAllister stated that the Commission will hold a special meeting on November 28, 1979, at 7:00 P.M. , to help clear up the matter of pole barns being constructed in the AG and Cons. zones. The Clerk's office will be asked to attend this meeting along with Attorney Johnson. 10.0 MISCELLANEOUS MOTION: Spitzer made motion, seconded by Vail, the granting of a permit to NSP for G-523322. NSP to obtain highway permit as per comments of City Engineer Kuusisto. A railway permit will also be required. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, the granting of a permit to NSP for G-517924. NSP to obtain a highway permit as per comments of City Engineer Kuusisto. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, the granting of a permit to Northwestern Bell for J.O. 47006. Bell has agreed to move cable if road is regraded. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, the granting of a permit to Northwestern Bell for J.O. 47621 . VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED The City Clerk was instructed to contact Bernie McDermaid to try and resolve the discrepancy in the easement of July Avenue. Officers Fure and Klarich requested that the City Council issue a letter of recomen- dation in their attempts in securing a new position. Fure also inquired if there was going to be a public hearing regarding the disbandment of the Police Department, and Spitzer stated that he did not know. MOTION: Spitzer made motion, seconded by Vail, directing the City Clerk to place Mr. Vern Peloquin on the City Council agenda for November 5, 1979, to discuss his subdivision in the Industrial Park. VOTING FOR: Spitzer, Schletty and Vail MOTION CARRIED 147 October 15, 1979 Engineer Kuusisto has been in contact with Mr. Ken Tschida regarding the drainage in the Bald Eagle Industrial Park. Mr. Kuusisto will submit his recommendations in writing. Councilman Schletty stated that Anoka Electric now has highpressure sodium lights available for the intersection of 170th Street and Highway 61 . Spitzer assured Mr. Stanley Lynn that the Clerk's office will inform him as to when any matters relating to his business are placed on the City Council's agenda.
