MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL MEETING OF
NOVEMBER 5, 1979 •
The meeting was called to order by Mayor LaValle at 7:00 P.M.
PRESENT: LaValle, Spitzer, Schletty, Irsfeld and Vail
3.0 APPROVAL OF MINUTES
MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes
of October 15, 1979, after the following change has been made:

4.0 APPROVAL OF CLAIMS
MOTION: Irsfeld made motion, seconded by Spit zer , to approve the General
Claims for November 5, 1979, as submitted.

5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES
5.1 Greg Stankey - Temporary Mobile Home Permit
Mr. Stankey's request for a temporary mobile home was approved by the Planning
Commission on June 14, 1978. The City Council had requested that a perc test
for the property located at 17385 Forest Boulevard be presented. Mr. Stankey
stated that the water table was too high so a mound type system would have to
be installed. He stated that Tom Crever had already given a verbal approval for
the system. Kuusisto reviewed the plans submitted, and stated that the fill
would have to set for awhile or artificial compaction would solve the immediate
problem. Mr. Stankey will ultimately be constructing an office building on the
property.
MOTION: LaValle made motion, seconded by Irsfeld, to grant Mr. Greg Stankey
a temporary Mobile HOme Permit at 17385 Forest Boulevard, under
Chapter 40, Article III, Subdivision B, for a period of ninty days.

Stankey - Continued
The Building Inspector is to be contacted indicating the recommendation 6f the
Engineer that the fill on Stankey's property is to be artificially compacted.
5.2 Off Sale Liquor Licenses
MOTION: Spitzer made motion, seconded by Irsfeld, to grant an OFF SALE
LIQUOR LICENSE TO STANLEY LYNN, STAN'S WITHROW JUCNTION, 12020
Keystone Avenue North, in the amount of $100.00.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail

5.3 William Clark - Variance
Mr. Clark had made application for a variance to construct his garage closer to
Homestead Drive than the main residence. The Planning Commission recommended that
Mr. Clark's fee be refunded because the variance was granted when the Special Use
Permit was approved. The Site Plan for the variance was the same as the plan
for the Special Use Permit. Attorney Johnson concurred with the Planning Commission's
interpretation.
MOTION: Irsfeld made motion, seconded by Schletty, to refund William Clark's
application fee of $15.00 for a variance because variance was approved
at the time the Special Use Permit was granted.

Mr. Clark stated that he would like to change the drainage on his property from
the north to the south. Spitzer stated that an Amended Special Use Permit would
be needed.
5.4 Jerome Pierre - Garbage and Rubbish License
MOTION: Spitzer made motion, seconded by Irsfeld, to grant a license for the
collection of garbage and rubbish to Do All Sanitation, 12863 Keller
Avenue North, for a fee of $50.00, under Chapter 120, of the Hugo
City Code.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail

5.5 Shubat and Prazich - Rezoning
Mr. Shubat and Mr. Prazich made application to rezone property at 16155 Forest
Boulevard from Agriculture to Industrial. The Planning Commission recommended denial
of the application for the following reasons: 1) Hugo does not need an additional
Industrial zone, 2) Do not feel the city should have an Industrial zone located on
both sides of a main arterial, and 3) land is located adjacent to SFE area and,
therefore, does not comply with the Comprehensive Plan.

Shubat and Prazich - Rezoning Continued
MOTION: Spitzer made motion, seconded by Vail, to deny the application of
Charles Shubat and George Prazich to rezone property located at
16155 Forest Boulevard North, from Agriculture and Industrial.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail
MOTION CARRIED
5.6 Vern Peloquin - Subdivision
Kuusisto has reveived the drainage plan for Peloquin's subdivision in the Industrial
Park and will be incorporated on the final plan. Kuusisto stated that a drainage
easement (15' ) would be needed on Geneva Avenue. Peloquin agreed to provide this
easement.
MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Preliminary
Plan for the Peloquin Industrial Park Subdivision subject to the
following conditions:
1 . Quit claims deeds that will be required to bring legal descriptions
into agreement with actual construction be exectued.
2. Provide Development Contract for the undeveloped portion of the
property be specified and executed.
Approval to be granted to Peloquin et al.

5.7 Wayne Scanlon - Temporary Mobile Home Permit
Mr. Scanlon is purchasing 47 acres on a Contract for Deed, and anticipates construction
of his house in 1981 . Mr. Scanlon would be required to produce a perc test for
his homesite and proof of ownership before the Council could take any action on
his application.
6.0 REPORTS OF OFFICERS AND COMMITTEES
6.1 Ordinance Committee
The Ordinance Committee will be meeting on November 8, 1979, to further discuss the
proposed Nudity Ordinance. Attorney Johnson will also advise the Committee regard-
ing watchman's quarters in the Industrial zone. LaValle suggested that the
Planning Commission consider mixed uses in a zone while reviewing the city's
Comprehensive Plan. Spitzer felt that the Committee should limit the quarters to
a mobile home.
6.2 Planning Commission
The Planning Commission will be holding a Apecial Meeting on November 28, 1979, at
7:00 P.M. , to try to resolve the discrepancies regarding the applications for pole
barns within the city. Attorney Johnson will be in attendance at this meeting.

6.3 Water Superintendent - No discussion
6.4 Building Inspector
Mr. Crever submitted his monthly report.
6.5 Fire Chief
Mr. Joe McMahon, representing the Fire Chief, stated that the Fire Department was
in need of gloves and mits for the winter. The cost would be approximately $250.00.

6.6 Police Chief
Acting Police Chief Fure Submitted his monthly report.
MOTION: LaValle made motion, seconded by Schletty, that the clothing allowance
claims submitted by Police Chief Barth be denied because it was paid
in April , 1979.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail

6.7 Attorney
Mr. JOhnson submitted his monthly report.
MOTION: Irsfeld made motion, seconded by Vail, to set a Special Meeting of
the Hugo City Council for November 27, 1979, at 7:00 PM, for the
purpose of discussion of the Police Contract.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail

6.8 Engineer
Mr. Kuusisto' submitted his monthly report.
MOTION: LaValle made motion, seconded by Irsfeld, to grant a 30 day extension
on the letter of credit for Grace Development to cover the parking
improvement in the Bald Eagle Industrial Park.
VOTING FOR: LaValle Spitzer, Schletty, Irsfeld and Vail
MOTION CARRIED
MOTION:: LaValle made motion, seconded by Schletty, that the bid from
Lametti & Son for Watermain Improvement Project 7906 be rejected
due to the fact it was over the engineer's estimate and only one
bid received.

MOTION: Irsfeld made motion, seconded by LaValle, to set a Special Meeting
of the Hugo City Council for November 12, 1979, at 7:00 P.M. , for the
purpose of discussion of Watermain Improvement Project 7906.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail
MOTION CARRIED
MOTION: Spitzer made motion, seconded by Irsfeld, to approve Job Order 47147
for Northwestern Bell to bury cable across 165th Street.
VOTING FOR: LaValle, Spitzer, Irsfeld and Vail
VOTING AGAINST: Schletty
MOTION CARRIED
6.9 Clerk
The Clerk was instructed to advertise for the sale of the old copy machine for
$100.00 - $150.00.
The Fire Department has been delegated to maintain the hockey rink at the Hugo
Elementary School.
The Clerk stated that four unpaid REC charges has surfaced. The Clerk was directed
to contact the appropriate parties to obtain their consent to having the charge
certified on the tax roll over a three year period.
Mr. Fischer is to be contacted regarding the repair of the blacktop of Irish
Avenue.
7.0 ORDINANCES AND RESOLUTIONS
7.1 Gambling Ordinance
Johnson stated that review that review of this draft has not been completed.
10.0 MISCELLANEOUS
Police Reserves
MOTION: Spitzer made motion, seconded by LaValle, that acting Police Chief
Fure be directed to reduce the number of hours for the part-time
Police Officers to 50% for the balance of the month.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail

The Council determined that if applicable, taxes will be withheld from the salaries
of the part-time officers.
