PRESENT: LaValle , Schletty, Irsfeld and Vail ABSENT: Spitzer 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of November 5, 1979, as submitted. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Vail made motion, seconded by Irsfeld, to approve the minutes of the Special Meeting of November 12, 1979, as submitted. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Vail, to approve the General Claims for November 19, 1979, as submitted. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Joseph Gregoire - Renew Temporary Mobile Home Permit MOTION: Irsfeld made motion, seconded by Schletty, to grant a renewal of the Mobile Home Permit for Joseph Gregoire, 7600 165th Street North, under Chapter 40, Article III, Subdivision D, for ninety days. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED 5.2 Mr. Paul Santanni - Temporary Mobile Home Permit Mr. Santanni has purchased 80 acres, with clear title to 10 acres, located at 7124 125th St. Fire has destroyed a number of buildings on the property, and Mr. Santanni would like to move in a mobile home to be used by a caretaker: He would be needed to take care of his farming operation (beef cattle) . Mr. Santanni had stated that he would be constructing a home on the property in three years. He was informed that the Mobile Home Permit was good for only two years, and could not be renewed after that time. 60 NOVEMBER 19, 1979 Santanni - Continued MOTION: Irsfeld made motion, seconded by LaValle, to grant a Temporary Mobile Home Permit to Mr. Santanni, 7124 125th Street, under Chapter 40, Article III, Subd. C, for a period of ninety (90) days. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED 5.3 Ron Istvanovich - Cancelled 5.4 Mrs. Joel Ebert - REC Charge (Cancelled) 5.5 Neil McLean - Division of land on 170th Street Mr. McLean is the realtor involved in the sale of a 40 acre parcel along 170th Street in Section 12. The parcel would be divided into two 20 acre parcels, one of which is in the Agriculture zone and one in Conservancy. The back 20 acres does not have road frontage, so an easement would be required. Engineer Kuusisto stated that the easement should be 33' because the property is located on the quarter section line. McLean stated that the driveway would cross wetland and would require some fill. He was informed that Rice Creek Watershed would have to be contacted to obtain a permit to fill the land. LaValle stated that a registered land survey sould be submitted indicating the two parcels of property and a 33' easement to serve the back 20 acres. A land division would be required. 5.6 John Norton - Special Use Permit Mr. Norton is requesting to fill Lot 7, Block 1 , Royal haven Estates for the purpose of obtaining a building site. The Planning Commission forward the request without recommendation. Rice Creek would not provide a permit for Mr. Norton to fill the wetland on his property. He would be using less fill and have steeper slopes (2:1 ) . Kuusisto wondered how the entire area would look because of the filling. He thought that the wetland should be filled in order to make the area aesthetically beautiful, considering the value of the homes adjoining. Because of the 2:1 slopes, Kuusisto felt there should be provision for safety in relation to the ponding of the water on Norton's lot. The ordinance reads that no septic system, well, or building should be constructed closer than 100' from the high water mark, and Mr. Norton would not be able to meet this requirement. There is a provision for a variance of 1/3 the distance. Mr. Norton will be contacting Rice Creek to see if they will allow for the arrangement of the filling of his lot. MOTION: LaValle made motion, seconded by Irsfeld, to table the request of Mr. Norton until he requests the City Clerk place the matter on the agenda for further action. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED NOVEMBER 19, 1979 p 5.7 Tim Wallace - Special Use Permit Mr. Wallace owns 14 sled dogs and had made application for a Special Use Permit for a kennel. The land he rents is in the Agricultural zone, and allows for the animals under permitted use. MOTION: Irsfeld made motion, seconded by Vail, to refund the Special Use Permit fee of $35.00, as no permit is required. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED 5.8 Letter of Credit - Jim Muggs Councilman Schletty and Kuusisto had inspected the roads and culvert, and found them to be in good condition. MOTION: LaValle made motion, seconded by Irsfeld, to release the letter of credit for James Muggs. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED 5.9 Off-Sale Liquor Licenses MOTION: LaValle made motion, seconded by Vail, to grant an OFF SALE LIQUOR LICENSE to Howard Meline, MELODY LOUNGE, 13891 Forest Blvd. North, in the amount of $100.00. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Schletty, to grant an OFF SALE LIQUOR LICENSE to Eugene Peltier, BLACKSMITHIOUNGE, 17205 Forest Blvd. North, in the amount of $100.00. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Irsfeld, to grant an OFF SALE LIQUOR LICENSE t6 Richard Schmidt, SCHMIDTY'S 61 CLUB, 17285 Forest Blvd. North in the amount of $100.00. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS Mr. Johnson was presented a draft of an ordinance to provide watchman quarters in the CB and RB districts. He will have his comments ready for the meeting of 12/3/79. 162 NOVEMBER 19, 1979 Mrs. Peltier was present and stated that she will have need of new members :on-the Ordinance Committee after the first of the year. The clerk will place an add in the paper to seek replacements. MOTION: LaValle made motion, seconded by Irsfeld, that Mr. Richard Houde be appointed a member of the Ordinance Committee. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED It was also noted that the Special Meeting of the Planning Commission on 11/28/79 to discuss pole barns has been postponed to December 13, 1979, at 7:00 P.M. 7.0 UNFINISHED BUSINESS Attorney Johnson stated that he had met with the property owners regarding the Bridge Replacement Program, and everyone is in general agreement with the layout as submitted by Kuusisto. The main concern is comming up with an':agreeable method of handling fence removal and relocation. LaValle stated that $1 .00/Ft. has been agreed upon. Mr. Gene Leroux was present at the meeting, and discussed the loss of his trees and bushes, and the need for resodding. City officials will meet with Mr. Leroux to straighten out these matters. 9.0 CLERK Bernie McDermaid had requested the return of the $200.00 he had submitted to the city. He was under the impression that the money was provided to insure the construction of July Avenue. LaValle stated that the $200.00 covered title insurance. The City Clerk will check the records to determine status. The city has received a letter from Governor Quie requesting that the city designate an emergency housing center, open 24 hours a day, where individuals can go to stay warm. MOTION: LaValle made motion, seconded by Irsfeld, that the City of Hugo will designate City Hall as the Emergency Relief Shelter for the residents of the city. To obtain access to the building the following parties can be contacted: Washington County Sheriff's Office (439-7300) or Mayor LaValle at 429-2051 . VOTING FOR: LaVAlle, Schletty, Irsfeld and Vail MOTION CARRIED TREE INSPECTOR MOTION: LaValle made motion, seconded by Irsfeld, that the permit fee for the storage, utilization, and houling in of firewood by tree removal con- tractors be set at $20.00/permit. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED NOVEMBER 19, 1979 1[6:3 CLERK - (Continued) The Clerk stated that Grace Development had sold Lot 3 (8A and Goodview) . Kuusisto stated that Lot 3 needs about 6" of fill but can be issued a Building Permit. However, if the septic system has to be placed on the new fill, they will have to wait a year. The Building Inspector will have to make a judgment. Richard Vail has sold Outlot A in Evergreen Hills. Attorney Johnson will check his files to see if there was a restrictive covenant attached to this Outlot. Clerk will check with Washington County to see if it was ever recorded. Mort Huber has been filling land on Bald Eagle Lake and has never obtained any per- mits from Rice Creek Watershed or the DNR. LaValle stated that the appropriate agencies will take care of this matter. Officer Klarich stated that the Police Department would like letters of recommendation to aid them in their search for employment. MOTION: LaValle made motion, seconded by Schletty, that the City Clerk be directed to draw up letters of recommendation for Police Officers requesting it. Letter should state length and quality of service. VOTING FOR: LaValle, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to adjourn at 9:55 P.M. All aye.
