PRESENT: Spitzer, Schletty, Irsfeld and Vail ABSENT: LaValle 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of November 19, 1979 as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of November 27, 1979 as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Schletty, to approve the General Claims for December 3, 1979 as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims for December 3, 1979, as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Ernest Hengel - Variance and Minor Subdivision Mr. Hengel is requesting to divide a 20 acre parcel into two 10 acre parcels as indi- cated on the submitted Certificate of Survey. Each lot is 10 acres, but the easterly lot has only 256.75' frontage. Because the division meets the Zoning requirements, Land Division approval is all that would be required along with a variance for the 256.75' lot width. MOTION: Spitzer made motion, seconded by Schletty, that Mr. Ernest Hengel be granted a Variance from Chapter 290-9, Subd G & K, in the matter of the 20 acre parcel described as the Ei of the NW2 of the NE4 of Section 22, T31N, R21W, Washington County, Minnesota, to permit the easterly tract to be divided with a frontage of 256.75' , and the parcel to be divided into two 10 acre parcels in accordance with the Certificate of Survey on file. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 6 8 December 3, 1979 Ernest Hengel - cont. MOTION: Irsfeld made motion, seconded by Vail, to refund the $40.00 Minor Subdivision fee to Erenest Hengel. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.3 Letter of Credit - Grace Development (parking lot) Engineer Kuusisto stated that the parking lot in the Bald Eagle Industrial Park has been staked, and the project is ready to go on December 5, 1979. He recommended that the letter of credit be extended. MOTION: Irsfeld made motion, seconded by Vail, to extend the Letter of Credit Of Grace Development for the parking lot in the Bald Eagle Industrial Park until January 5, 1980. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, directing the City Clerk to contact Grace Development requesting them to obtain an extension on their Letter of Credit for the parking lot throught1/8/80. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.4 On and Off Sale Liquor Licenses MOTION: Irsfeld made motion, seconded by Schletty, to grant an ON SALE NON-INTOXICATING LIQUOR LICENSE to Jeffrey Hughes, WILD WINGS GAME FARM, 9491 152nd Street North, in the amount of $10.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Vail made motion, seconded by Irsfeld, to grant an OFF SALE NON- INTOXICATING LIQUOR LICENSE, CIGARETTE LICENSE AND A SOFT DRINK LICENSE to NADEAU'S MARKET, 14583 Forest Blvd North, in the amount of $32.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Schletty made motion, seconded by Irsfeld, to grant a CIGARETTE AND SOFT DRINK LICENSE, to Jayson Knoph, A & W DRIVE-IN, 14869 Forest Blvd North, in the amount of $17.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 169 December 3, 1979 MOTION: Irsfeld made motion, seconded by Vail, to grant an ON SALE INTOXICATING LIQUOR LICENSE, CIGARETTE LICENSE AND SOFT DRINK LICENSE, to the AMERICAN LEGION POST 620, 5736 147th Street, in the amount of $117.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Vail made motion, seconded by Schletty, to grant a CIGARETTE AND SOFT DRINK LICENSE to GRANGERS BODY SHOP AND DX, 14797 Forest Blvd North,. in the amount of $17.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Schletty made motion, seconded by Irsfeld, to grant a CIGARETTE, SOFT DRINK AND BILLIARD LICENSE to PAUL'S PIZZA, 14145 Forest Blvd, in the amount of $22.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, that in accordance with Chapter 190-7, Subd B, licenses in effect for Paul's Pizza, at 14145 Forest Blvd, be transferred to 14849 Forest Blvd, as of the date of his move, to the end of the year, unless owner objects. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Vail made motion, seconded by Schletty, to grant a SOFT DRINK LICENSE to INTERSTATE LUMBER COMPANY, 5517 145th Street, in the amount of $5.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, that the City of Hugo recognizes that they have received a liquor license application from Stanley Lynn, and that the city will consider applications in the order that they were received, for a period of 90 days. VOTING FOR: Spitzer, Irsfeld and Vail ABSTAINED: Schletty MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to grant an ON SALE INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LIQUOR LICENSE, CIGARETTE LICENSE, AND SOFT DRINK LICENSE to Eugene Peltier, BLACKSMITH LOUNGE, 17205 Forest Blvd, in the amount of $1817.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 1 • " December 3, 1979 MOTION: Irsfeld made motion, seconded by Vail, to grant an OFF SALE INTOXICATING LIQUOR LICENSE, OFF SALE NON-INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LIQUOR LICENSE, CIGARETTE LICENSE, SOFT DRINK LICENSE AND BILLIARD LICENSE to Swan Anderson, CARPENTER'S STEAKHOUSE, 14559 Forest Blvd, in the amount of $1837.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to grant an OFF SALE INTO- XICATING LIQUOR LICENSE to HOPPY'S, INC. , 14777 Forest Blvd, in the amount of $100.00. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee MOTION: Schletty made motion, seconded by Vail, to appoint Beverly Burr, 5801 147th Street, to serve on the Ordinance Committee. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 6.2 Planning Commission - No discussion 6.3 Water Superintendent - No Discussion 6.4 Building Inspector Mr. Tom Crever submitted his monthly report. 6.5 Fire Chief - No discussion 6.6 Police Chief - No discussion 6.7 Attorney Mr. Johnson submitted his monthly report. MOTION Irsfeld made motion, seconded by Schletty, that the acting Mayor, Dan Spitzer and the City Cleric, be directed to sign the agreement with Rice Creek Watershed. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to set a Special Meeting for December 10, 1979, at 7:00 PM, for the purpose of discussing one or more areas of the Police Contract VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 171 December 3, 1979 Attorney Johnson stated the various costs incurred for easements and replacing of fencing and shrubs for the Bridge Replacement Program. MOTION Irsfeld made motion, seconded by Vail, that the Mayor and City Clerk be authorized to sign easements, and to pay easements and fencing fees and tree and shrub replacements in the amount of $3,002.00, for the Bridge Replacement Program. VOTING FOR: Spitzer, Schietty, Irsfeld and Vail MOTION CARRIED Attorney Johnson will contact Washington County regarding the Bridge Replacement Program to provide the city with the option to reject the bids if necessary. MOTION: Spitzer made motion, seconded by Schletty, that the John Norton Special Use Permit be laid over to December 17, 1979. If Mr. Norton wishes to pursue the matter, is to contact the City Clerk. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 6.8 Engineer Mr. Kuusisto submitted his monthly report. Kuusisto discussed the three lots on 8A and Goodview Avenue. Lot 2 cannot be released as yet. Kuusisto suggested that as a possible alternative to pumping to Lot 2, the Bramstedt's bring their lot up to the required elevations and let that set. This would keep the lots separate. 6.9 Clerk MOTION: Spitzer made motion, seconded by Schietty, that the City Clerk be directed to contact the buyers of the Gerald Ensign property, to try and resolve the issue of hookup to the sanitary sewer. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to vacate the temporary appointment of James Fure as acting Police Chief, effective 11/26/79. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED The clerk's office has been contacted by the United Power Association regarding the installation of power lines within the city. Mrs. Theodora Peltier, Chairwoman of the Ordinance Committee, is to be contacted to draft an Utility Franchise Ordinance. The clerk was instructed to notify the UPA that the city would like to have them appear at a City Council meeting to explain what is to take place in the city. 172 December 3, 1979 MOTION: Irsfeld made motion, seconded by Spitzer, that the City Clerk be directed to apply for Special Grant Money to retype the Codebook.
