PRESENT: LaValle, Spitzer and Schletty ABSENT: Irsfeld and Vail 3.0 APPROVAL OF MINUTES MOTION: Schletty made motion, seconded by Spitzer, to approve the minutes of December 3, 1979 as submitted. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Schletty, to approve the General Claims for December 17, 1979 as submitted. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, to approve the Utility Claims for December 17, 1979 as submitted. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Ron Johnson - Discussion on division of land (Cty 57 & 4) Mr. Johnson is interested in dividing a 60 acre parcel of land into three 20 acre parcels. One parcel would have access from County Road 4, and Mr. Johnson was questioning if a private easement could be used for access to the back two parcels. There is an easement along the property line, and was maintained at one time. Attorney Johnson stated that because of the size of the parcels, and the fact that there is a right-of-way there now, Ron Johnson could probably get by with a private easement. Spitzer informed Mr. Johnson that when he goes further with the application, that he get appropriate temporary reservations for a cul-de-sac. MOTION: Spitzer made motion, seconded by Schletty, that we part from the agenda and take up the matter of the Bridge Contract. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED 17 `, December 17, 1979 BRIDGE REPLACEMENT PROGRAM MOTION: Spitzer made motion, seconded by Schletty, to approve Bridge Re- placement Contract 1979V33. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED Mayor LaValle stated that there could be more money available, if after opening of the bids, it is needed. BREVIG - REZONING Mr. Geck, attorney for James Brevig, was present and stated that he and his client are interested in resolving the dike problem. Mr. Brevig would like to rezone a protion of his property from RRII to SFE and divide it for another building site. A perc test for the proposed lot was submitted. Geck stated that the • dike would remain at its present location. LaValle stated that the city would cooperate and Mr. Geck will attend the necessary meetings and bring in all material relating to this matter. The Planning Contract will be discussed at the meeting of 1/7/80. MOTION: Spitzer made motion, seconded by Schletty, to set a public hearing for January 21 , 1980, at 7:30 PM, to consider the following pro- posed ordinances: 1 . Site Plan requirements in the RB and CB Districts, and 2. Amending Special Uses for CB District and the Industrial District to permit watchman's quarters as a Special Use. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED 5.2 William Bighley - Sewer Hookup Mr. Bighley has purchased the Gerald Ensign property, and has been informed that this property has not been hooked up to the sanitary sewer. Mr. Bighley stated that he is attempting to hire a licensed and bonded installer to do the work. 5.3 United Power Association Representatives from UPA and Anoka Electric were present to discuss the proposed power lines to be installed along County Road 4. Maps and a resume' were provided for the Council's review. The route of the lines was discussed and the type of poles to be installed. LaValle stated that no permits for construction would be required, and thanked the gentlemen for taking the time to keep the city informed. A project design will be provided to the city before actual construction begins. (VAIL ARRIVED AT 8:11 PM) 5.4 John Norton - Special Use Permit Mr. Norton is applying for a Special Use Permit to fill Lot 7, Block 1 , Royalhaven Estates. Norton is now proposing to move the wetland with a distance of 67' from the septic system to the wetland. Norton's application to Rice Creek Watershed December 17, 1979 177 John Norton - cont. will be considered at their meeting of December 28, 1979. LaValle felt that there would be a problem with the adjacent lot. He informed Mr. Norton that a Variance to the setback requirement is something that may be granted. The suggested that Mr. Norton provide the city with a complete diagram indicating the septic system, well, etc. , along with distances. MOTION: Spitzer made motion, seconded by Vail, to table this matter until Mr. Norton calls City Hall to be placed on the agenda. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED 5.5 Safeway House Movers - Amended Special Use Permit MOTION: Spitzer made motion, seconded by Schletty, to approve the Amended Special Use Permit for Safeway House Movers to move in a 30 x 60 cold storage building, #5, with the condition that a Site Plan showing fire lanes and road layouts to be submitted within 60 days. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED 5.6 Grace Development - Letter of Credit for Parking Lot MOTION: Spitzer made motion, seconded by Schletty, that the Letter of Credit of Grace Development to cover the costruction of the parking lot in the Bald Eagle Industrial Park be extended to July 1 , 1980. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED 5.7 Liquor Licenses MOTION: Spitzer made motion, seconded by Schletty, to grant an ON SALE INTOXICA- TING LIQUOR LICENSE, ON SALE SUNDAY LIQUOR LICENSE, AND A CIGARETTE AND SOFT DRINK LICENSE, to Howard Meline, MELODY LOUNGE, 13891 Forest Blvd. , in the amount of $1 ,717.00. VOTING FOR: LaValle, Spitzer, Schletty MOTION CARRIED MOTION: LaValle made motion, seconded by Schletty, to table the liquor licenses for HOPPY'S, INC. , until the next regular meeting (1/7/80) . VOTING FOR: LaValle and Schletty VOTING AGAINST: Spitzer and Vail MOTION FAILED 1118 December 17, 1979 HOPPY'S, INC. - cont. MOTION: Spitzer made motion, seconded by Vail, to set a Special Meeting of the City Council for December 27, 1979, at 7:00 PM, for the sole purpose of considering a liquor license. VOTING FOR: Spitzer and Vail VOTING AGAINST: LaValle and Schletty MOTION FAILED MOTION: Spitzer made motion, seconded by Vail, to reconsider the motion to table Floppy's Liquor License until the next regular meeting. VOTING FOR: LaValle, Spitzer, Vail VOTING AGAINST: Schletty MOTION CARRIED MOTION: LaValle made motion, seconded by Schletty, to table the liquor licenses for Hoppy's Inc. , until the next regular meeting ( 1/7/80) . VOTING FOR: LaValle, Spitzer,Schletty, Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS MOTION: Spitzer made motion, seconded by Schletty, to appoint Mr. Ken Hansen to serve on the Ordinance Committee. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED 8.0 NEW BUSINESS 8.1 Employment of Mark Granger Mark Granger stated that he would be able to work on a part-time basis only staring January, 1980. He would be able to work full-time during the summer months of 1980. LaValle informed him that he would be responsible to the City Clerk, who will coordinate his work schedule. White Mr. Granger is on a part- time basis, he will be paid on an hourly basis for hours worked under 40, and will receive 1i hours off for every hour worked for over 40 hours as per the Personnel Policy. MOTION: Spitzer made motion, seconded by Schletty, that Mr. Mark Granger be employed on one-half (f) time basis for the City of Hugo until further notice, effective January 1 , 1980. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED 9.0 CLERK MOTION: Spitzer made motion, seconded by Vail, to approve Northwestern Bell Job Order 30802. VOTING FOR: Spitzer and Vail VOTING AGAINST: LaValle and Schletty MOTION FAILED 180 December 17, 1979 Mark Granger asked if the city would be willing to participate in the purchase of hockey nets for the rink at the elementary school ($150.00) ; the city's portion to be $50.00. LaValle suggested that Granger contact the school district to see if they would be willing to defray some of the cost. 10.0 MISCELLANEOUS The clerk has received a letter from PCA stating they they had received an anonymous complaint regrading a septic tank overflow from the property located at 5457 145th Street. (There appears to be a discrepancy in the address identified) . MOTION: LaValle made motion, seconded by Spitzer, that the City Attorney be instructed to prepare ordinance violation complaints against the alleged violators of Ordinance 262, as listed below: Karl Hjelmhaug - 5473 145th Street North Dick Mireault - 14015 Flay Avenue North VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, to reappoint Bill Hanson and Jim Houle to serve on the Planning Commission.
