PRESENT: LaValle, Spitzer, Schletty and Irsfeld ABSENT: Vail 3.0 APPROVAL OF MINUTES MOTION: Schletty made motion, seconded by Irsfeld, to approve the minutes of December 17, 1979, as submitted. VOTING FOR: LaValle, Spitzer, Schletty and Irsfeld MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Schletty, to approve the General Claims for January 7,1980, with the addition of the claim for $3,795.94 (Clerk's Office) payable to Copy Duplicating Products, Inc. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Utility Claims for January 7, 1980, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 American Legion .Auxiliary 620 - Bingo License MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Bingo License for the American Legion Auxiliary Post 620 subject to the • signatures of the Building Inspector and the Fire Chief, with a waiver of the bond. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 5.2 Jerome Jessen - Renewal of Mobile Home Permit MOTION: Spitzer made motion, seconded by Irsfeld, to grant a renewal of the Mobile Home Permit for Jerome Jessen, 7475 132nd Street North, under Chapter 40, Article III, Subdivision B, for a period of 90 days. THOMAS C. HOPKINS, 14777 Forest Blvd. North, in the amount of 51 ,722.00. . VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to adopt RESOLUTION 1980-61 , A RESOLUTION THAT THE HUGO CITY COUNCIL REQUIRES THE PAYMENT OF ALL LICENSE APPLICATION FEES AND LICENSE FEES OF $100.00 AND MORE TO BE PAID BY CERTIFIED CHECK; SAID FEES SHALL NOT BE CONSIDERED REMITTED UNTIL SUCH VALID CHECK IS RECEIVED BY THE CLERK'S OFFICE. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MO T I ON CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to appoint Joe McMahon as Assistant Fire Chief for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 3 JANUARY 7, 1980 Page Fire Chief - Continued MOTION: Spitzer made motion, seconded by Irsfeld, to appoint Frank Hovald as 2nd Assistant Fire Chief for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 6.6 Police Chief MOTION: Spitzer made motion, seconded by Irsfeld, to accept the resignatL on from Robert Barth as Hugo Police Chief effective January 2, 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED MOTION: LaValle made motion, seconded by Irsfeld, to appoint Mr. James Fure as temporary Police Chief at a pay of $150.00/month in addition to his regular salary. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 6.7 Attorney, Mr. Johnson submitted his monthly report. Mr. Johnson was instructed to send a letter to Mr. Dick Harold, Washington County, regarding the easements for the Bridge Replacement Program. Attdildy Johnson reviewed a deed submitted by Mr. Gerald Dabe regarding his proposed roadway. MOTION: LaValle made motion, seconded by Schletty, to direct the City Clerk not to sign the deed submitted by Mr. Gerald Dabe' s attorney. The following requirements should be met: 1 . Need an up-to-date title ownership report. 2. Need a statement stating that by approving, the City of Hugo does not waive the right to levy special assessments, and 3. The deed should state that it is not a buildable site. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED Nudity Ordinance - The Ordinance Committee is to be notified to consider an amendment to the liquor license ordinance to bring the definition of premises into agreement with the definition in the contemplated Nudity Ordinance. Page 4 JANUARY 7, 1980 The City Council will review the Planning Contract as submitted by Carl Dale and will discuss at their meeting of 1/21/80. Mayor LaValle stated that he would be the complaining party for the legal action to be taken to accomplish the sanitary sewer hookups in the city. Johnson is to be provided with the legal descriptions for the appropriate properties and with a copy from PCA regarding this matter. 6.8 Engineer - No discussion 6.9 Clerk The city has received a letter from Mr. Stanek regarding his guest to have a road, provided to his property. Attorney Johnson will respond to his letter. The City has received a request form Grace Development requesting a reduction in their letter of credit to cover the parking lot in the Bald Eagle Industrial Park from $2,000.00 to $500.00. Engineer Kuusisto recommended that their request be approved. MOTION: Spitzer made motion, seconded by Schletty, to reduce Grace Development's Letter of Credit to cover the parking lot in the Bald Eagle Industrial Park from $2,000.00 to $500.00. Letter of Credit to expire June 5, 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the claim of $9,612.65, payable to McLean Construction Company, for the Watermain Improvement Project 79-06. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 7.0 ORDINANCES AND RESOLUTIONS No discussion 8.0 UNFINISHED BUSINESS 9.0 NEW BUSINESS 9.1 Swear in Mayor and City Coundil - Not necessary 9.2 Designate Official Newspaper MOTION: Spitzer made motion, seconded by Irsfeld, to designate the Forest Lake Times as the official newspaper for the City of Hugo for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED Page 5 JANUARY 7, 1980 9.3 Designate Official Depositories MOTION: Spitzer made motion, seconded by LaValle, to designate the First State Bank of Hugo and Twin City Federal, Maplewood, as the official depositories for the City of Hugo for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 9.4 Appoint Adting Mayor MOTION: LaValle made motion, seconded by Irsfeld, to appoint Councilman Dan Spitzer as the Acting Mayor for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 9.5 Appoint Health Officers MOTION: LaValle made motion, seconded by Spitzer, to appoint Councilmen Larry Irsfeld and Deane Vail as the Health Officers for the City of Hugo for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 9.6 Appoint City Council Liaison to Planning Commission MOTION: LaValle made motion, seconded by Spitzer, to appoint Councilman Larry Irsfeld as the City Council's Liaison to the Planning Commission for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 9.7 Appoint City Attorney, MOTION: Spitzer made motion, seconded by Irsfeld, to appoint Mr. Charles Johnson as the City Attorney for the year 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 9.8 Appoint City Engineer MOTION: Spitzer made motion, seconded by Schletty, to appoint Mr. Howard Kuusisto as the City Engineer for the year 1980. Page 6 JANUARY 7, 1980 Appoint City Engineer — Continued VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 9.10 • Salary Review MOTION: Spitzer made motion, seconded by Irsfeld, to set a Special Meeting for January 14, 1980, at 7:00 P.M. , for -the purpose of salary review and conduct any discussion that may be appropriate to the Police Contract. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED 10.0 Miscellaneous Police Reserves MOTION: Spitzer made motion, seconded by Irsfeld, to place the current part—time, and or, reserve Police Officers on part—time Police Officer Status pending the completion of the psychological evaluation tests to be conducted at the City' s expense. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, that acting Police Chief, James Fure, be directed to refrain from scheduling any of the part—time Police Officers for duties other than those directly supervised by a full— time member of the Hugo Police Force until further notice. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, that acting Police Chief, James Fure, be directed to arrange for the psychological testing of the part—time Police Officers. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, that acting Police Chief, James Fure, be directed to set up a meeting with the Washington County Sheriff and Mayor, to discuss radio supervision of the part—time Police Officers.
