PRESENT: LaValle, Spitzer, Schletty, Irsfeld, Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Spitzer, to approve the minutes of January 7, 1980, after the following change has been made: RESOLUTION 1980-61 - fees of $100.00 and more to be paid by certified check; said fees shall not be con- sidered remitted VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to approve the minutes of January 14, 1980, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Irsfeld, to approve the General Claims for January 21, 1980, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims for January 21, 1980, as submitted. MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMUNICATIONS & LICENSES 5. 1 James Leroux - Renewals of Mobile Home Permit MOTION: Spitzer made motion, seconded by Vail, to renew the Mobile Home Permit for .James Leroux, 4360 165th Street North, for 8/15/79 and 11/15/79, under Chapter 40, Article III, Subdivision O. Permit good until 2/15/80. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.3 Mardon Homes - Request for extension of application for Subdivision The City has received a letter from Mardon Homes requesting that their application for subdivision be extended. Page 12 JANUARY 21, 1980 Mardon Homes - Continued Preliminary Plan approval was granted by the City Council on April 2, 1979, and Subdivision Ordinance 290,. Subd C (4) states that the subdivider shall file. twelve copies of the plat with City Clerk not later than six months after the date of approval of the plan. If this is not done, the approval of the plan will be considered null and void. Their deadline to request for an extension was October 2, 1979. MOTION: LaValle made motion, seconded by Irsfeld, that the request from Mardon. Homes for an extension be denied because of the fact that the plat has already been denied by the terms of the Subdivision Ordinance. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.4 Marvin Christianson - Rezoning Mr. Christianson has applied to have 12.96 acres rezoned from SFE to SFU. Let the record show that a publichearing has been held by the Planning Commission. They have recommended approval of the request. MOTION: Irsfeld made motion, seconded by Vail, to approve the request of Marvin Christianson to rezone 12.96 acres from SFE to SFU. Legal discription..as follows: The W2 - E 2/3 - S2 - SE4 of Section 17, T31N, R21W, Washington County, Minnesota, and the W2 - E 2/3 - NE4 - NE4 - Section 20, T31N, R21W, Washington County, Minnesota, except the south 7. 17 acres more or less lying south of Oneka Lake Blvd. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.5 Gerald Dabe - Land. Division Mr. Dabe is requesting permission to divide 40 acres into one 20 acre parcel and two 10 acre parcels. Mr. Bartholdi stated that the deed with the signatures of the adjoining property owners has notas yet been provided. MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Land Division of Mr. Gerald Dabe to divide a 40 acre parcel into one 20 acre parcel and two 10 acre parcels contingent on the provision of right-of-way deeds private easements, and private driveway agreement to the satisfaction of the City Attorney within the next 60 days. VOTING FOR: LaValle, Spitzer, Schletty, Irfeld, Vail MOTION CARRIED 5.2 Public Hearing - 7:30 P.M. a. Site Plan approval in the RB and CB Districts b. Watchman's quarters in CB and Industrial Districts Page 13 JANUARY 21, 1980 5.2 Public Hearing - Continued MOTION: Spitzer made motion, seconded by Schletty, to recess for the public hearing at 7:35 P.M. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED There were no residents present to make comments on the proposed ordinances. The notice of the public hearing was published in the Forest Lake Times on 12/27/79. The public hearing to consider the mentioned changes was closed at 7:40 P.M. MOTION: LaValle made motion, seconded by Irsfeld, to adopt ORDINANCE 165, AN ORDINANCE ADENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY REQUIRING SITE PLAN APPROVAL IN THE RB AND CB DISTRICTS. MOTION: Spitzer made motion, seconded by Irsfeld, that an additional sentence be added to Subd. F, as follows: An additional 60 day delay in the City Council's decision may be granted at the discretion of the City Council upon written request of the application. MOTION AS AMENDED: VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED ORIGINAL MOTION: VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to adopt ORDINANCE 166, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING SPECIAL USES FOR CONCENTRATED BUSINESS (CB) DISTRICT AND THE INDUSTRIAL (I) DISTRICT TO PERMIT WATCHMEN'S QUARTERS AS A SPECIAL USE. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, to adopt ORDINANCE 167, AN ORDINANCE AMENDING CHAPTER 40 OF THE HUGO CITY CODE, ENTITLED "BUILDING AND CONSTRUCTION", ARTICLE III, ENTITLED "MOBILE HOME REGULATIONS" TO PERMIT MOBILE HOME TO BE USED AS SECURITY WATCHMAN'S QUARTERS. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Page 14 JANUARY 21, 1980 MOTION: Spitzer made motion to adopt RESOLUTION 1980-62, A RESOLUTION TO PERMIT ANY TWO OF THE FOLLOWING SIGNATURES TO SIGN CHECKS OR. WITHDRAWAL ORDER: Marvin LaValle, Dan Spitzer, Carol Williams, and Mary Ann Creager. Spitzer withdrew his motion. MOTION: Spitzer made motion, seconded by Irsfeld, to adopt ORDINANCE 168, AN ORDINANCE REGULATING AND CONTROLLING THE CONDUCT OF PERMISSIBLE GAMBLING. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to adopt ORDINANCE 169, AN ORDINANCE AMENDING CHAPTER 110, ENTITLED "FIRE PREVENTION AND PROTECTION" TO ADJUST THE PAY SCALE FOR THE VOLUNTEER MEMBERS FOR. RESCUE SQUAD AND FIRE DEPARTMENT BY RESOLUTION. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to adopt RESOLUTION 1980-62 A RESOLUTION ESTABLISHING THE PAY SCALE FOR THE FIRE CHIEF AT $5.00 PER HOUR AND THE FIREMEN AT $3.00 PER HOUR FOR BOTH FIRE AND RESCUE CALLS. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 7.0 UNFINISHED BUSINESS MOTION: Spitzer made motion, seconded by Schletty, that secretary Marie Connor's salary be set at $4.50/hour. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 7.2 Bridge Replacement Program The bids for this program were opened at Washington County on January 17, 1980, with low bid from Landwehr Heavy Moving, Inc., at $99, 108.00. MOTION: Spitzer made motion, seconded by Schletty, that the City of Hugo has asked the County Engineer to go ahead with the Bridge Replacement Program, both Part A and B. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Page 15 JANUARY 21, 1980 7. 1 Washington County Planning Contract MOTION: Spitzer made motion, seconded by Schletty, that the City Clerk's Office be directed to contact the head of the Washington County Planning Department requesting that he attend the City Council meeting of February 4, 1980, for the purpose of discussion of the proposed agreement between the city and the County Planning Department. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, that the Mayor be empowered to accept appropriate substitution for the County Planning Coordinator for the next meeting. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 7.3 Part-time Police (firearms) LaValle stated that Mr. Fure had acted in the best interest of the city when he requested the extension for the Reserve Officers so they could complete their psychological testing. 7.4 Planning Commission on accessory buildings The Council reviewed the recommendations as provided by the Planning Commission. There was some discussion as to whether the detached garage should be considered when determining square footages. The Council agreed that there was more work needed on the proposal before it could be adopted. MOTION: Spitzer made motion, seconded by Irsfeld, that the City Attorney be directed to draw up a draft of guidelines for accessory buildings with the assistance of Messrs. Irsfeld and McAllister for submission to the Ordinance Committee. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 8.0 NEW BUSINESS 9.0 CLERK The Clerk had received a call from Mrs. L'Allier stating that sewage was running on the ground from the Hjelmhaug residence. Attorney Johnson is working on proposals to be submitted to the Council. MOTION: Irsfeld made motion, seconded by Schletty, that the salary adjustments for City Employees be effective January 1, 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Page 16 JANUARY 21, 1980 Mayor LaVal.le stated that he would contact Mr. Ron Granger regarding the possible employment of him as Plumbing and Heating Inspector for the City of Hugo. 10.0 MISCELLANEOUS The city received a letter from Connie Levi regarding the DNR's interest in the acquisition of two railroad rights-of-way in Washington County. MOTION: LaValle made motion, seconded by Schletty, directing Councilman Vail tocheck out this matter and submit a report for the Council meeting of 2/4/80. VOTING FOR: LaValle, Schletty, Irsfeld, Spitzer, Vail MOTION CARRIED The city received a letter from Mrs. Thomas Bilek stating that she would like to have a street sign installed for 173rd Street. Councilman Schletty was directed to have a street sign installed at the requested location. Street signs are also needed at: Isleton. & 130th Street Finlay & 146th Street MOTION: Spitzer made motion, seconded by Irsfeld, to adjourn at 9:20 P.M. All aye. Motion Carried.
