MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
MEETING OF February 4, 1980
The meeting was called to order by Mayor LaValle at 7:02. P.M.
PRESENT: LaValle, Spitzer, Schletty, Irsfeld
ABSENT: Vail
3.0 APPROVAL OF MINUTES
MOTION: Spitzer made motion, seconded by Schletty, to approve the minutes
of January 21, 1980, after the following change has been made:

4.0 APPROVAL OF CLAIMS
MOTION: Irsfeld made motion, seconded by Schletty, to approve the General
Claims for February 4, 1980, after the addition of the following
claim for the Fire Department;
Detroit Lakes Area Vocational Institute - $48.00
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld
MOTION CARRIED
MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Utility
Claims for February 4, 1980, as submitted.

5.0 PETITIONS, REQUESTS, COMMUNICATIONS AND LICENSES
5. 1 Robert Lockyear - Washington County Planning Coordinator
The City Council had requested that Mr. Lockyear appear at their meeting to discuss
the proposed contract between the city and Washington County. After indicating some
points of question in the contract, it was determined that the City Attorney and
Mr. Lockyear should set up a meeting, with Carl Dale, to change the language of the
contract so that it would meet the needs of the city and Washington Couflty.
5.2 James Leroux - Renewal of Mobile Home Permit
MOTION: Spitzer made motion, seconded by Irsfeld, to renew the Mobile Home
Permit for James Leroux, 4360 165th Street North, under Chapter 40,
Article III, Subdivision D, for a period of ninety days.

5.3 Dan Santinni - Renewal of Mobile Home Permit
MOTION: Spitzer made motion, seconded by Schletty, to renew the Mobile Home
Permit for Dan Santinni, 7124 125th Street North, under Chapter 40,
Article III, Subdivision C, for a period of ninety days.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld
MOTION CARRIED
5.4 Greg Stankey - Renewal of Mobile Home Permit
MOTION: LaValle made motion, seconded by Schletty, to table the renewal
of the Mobile Home Permit for Greg Stankey until the meeting of
2/19/80. The $10.00 fee had not been paid.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld

5.5 Alex Zaluckyj - Variance
Mr. Zaluckyj is proposing the division of 40 acres into two 20 acre parcels. The
old homestead house meets the 300' setback requirement so a variance is not required.
MOTION: Spitzer made motion, seconded by Schletty, to approve the Land Div-
ision of Alex Zaluckyj to allow the division of 40 acres into two 20
acre parcels.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld
MOTION CARRIED
After further review of the file, it was determined that no Certificate of Survey
has been provided.
MOTION: Spitzer made motion, seconded by Schletty, to rescind the previous
motion.

MOTION CARRIED
Zaluckyj was instructed to have the land surveyed to meet all the setback require-
ments of the city, and at that time, come back to the city for Land Division approval.
MOTION: Spitzer made motion, seconded by Irsfeld, that this application be
held in abeyance until this matter is resolved.

5.6 Metropolitan Steel - Purchase of land in Bald Eagle Industrial Park
Mr. Eldridge is interested in purchasing approximately 4 acres of land in order to
expand his present business. Mr. Eldridge was informed that Grace Development
would have to make application for a Minor Subdivision and appear before the Planning
Commission. A drainage plan and site plan would have to be provided. Spitzer
stated that the right-of-way for Farnham Avenue should be a matter for subdivision.
5.7 Building Permits not paid for - Mary Lysne
Ms. Lysne lives on 5 acres of land in the Agriculture zone. She constructed a pole
barn and the Building Inspector determined that a $29.00 fee was in order. LaValle
felt that because the Inspector set a fee on the permit she should pay
MOTION: Schletty made motion, seconded by LaValle, to table this matter until
the meeting of February 19, 1980.

5.8 Report from Deane Vail of railroad acquisition
Councilman Vail reported to the clerk that Burlington Northern had disbanded the
project. The right-of-way to be acquired was not in the City of Hugo.
ONEKA HILL FARMS - Liquor License Application
MOTION: Spitzer made motion, seconded by Schletty, that the application
filed by Oneka Hill Farms for the On Sale Liquor License be accepted.
The matter to be tabled until March 3, 1980.

MOTION: LaValle made motion, seconded by Irsfeld, to approve the Driveway
Maintenance Agreement between the City of Hugo and Mr. & Mrs. Gerald
Dabe and/or any subsequent owners.

MOTION: Irsfeld made motion, seconded by Schletty, that the record show
that the City Council and Attorney Johnson discussed Chapter 290-9,
Subd. I, and it was interpreted to mean an "or" situation and not
an "and" situation meaning that the piece of property does not
have to have 300' frontage on a public street. .

Mr. Stanley Lynn was informed that he would need Site Plan approval from the city
for his proposed business (CB zone) . The Site Plan would have to include the
following: Location for the well and septic system, location of the building
indicating setbacks, drainage plan, parking lot, exterior of building, and the
driveway.
6.3 Water Superintendent - No discussion
6.4 Building Inspector - No discussion
6.5 Fire Chief
Ron Istvanovich stated that the city is eligible for a grant of $2,823.00, ' to be
shared with Birchwood and Dellwood. The money would have to be used for medical
supplies and the city has no room for such equipment. The City of White Bear
Lake provides Hugo with ambulance service, and they are interested in purchasing
a Hurst tool in the amount of $6400.00. The Fire Department would like to donate
their portion of the grant to White Bear Lake for the purchase of this tool.
MOTION: Irsfeld made motion, seconded by Spitzer, that the grant money for
Hugo, Birchwood and Dellwood be forwarded to this city. The City of
Hugo will in turn donate these monies to thecity of White Bear Lake for the
purchase of a Hurst tool.

MOTION: Spitzer made motion, seconded by Irsfeld, authorizing
the Fire Chief to purchase Life Saving Code Book in the
amount of $16.5O.

Istvanovich will contact the Building Inspector regarding exit lights
at Shepherd of the Fields Church.

6.6 Police Chief
Acting Police Chief Pure submitted his monthly report. The city
has received a complaint regarding the property of Neil Buschmann.
MOTION: Spitzer made motion, seconded by LaValle, that Officer
James Fure be directed to contact Neil Buschmann to
obtain permission to view his property to determine
the license status of the vehicles on his property.

Mr. Johnson submitted his monthly report.

Mr. Kuusisto submitted his monthly report.
7.0 ORDINANCES AND RESOLUTIONS
MOTION: Spitzer made motion., seconded by Irsfeld, to adopt
ORDINANCE 170, AN ORDINANCE AMENDING CHAPTER 320 OF
THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE
ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL
PROPERTY.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld
MOTION CARRIED
MOTION: Spitzer made motion, seconded by Irsfeld, to adopt
ORDINANCE 171 , AN ORDINANCE AMENDING CHAPTER 82 OF THE
HUGO CITY CODE ENTITLED "DRIVEWAYS" TO PROVIDE FOR
SECURITY DEPOSITS FOR DRIVEWAY CONSTRUCTION AND TO
PROVIDE FOR PERMIT AMENDMENT.
VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld
MOTION CARRIED
MOTION: LaValle made motion, seconded by Irsfeld, to table the
Nudity Ordinance until the meeting of February 19, 1980.
VOTING FOR: LaValle, Schletty, Irsfeld

MOTION: Spitzer made motion, seconded by Irsfeld, to adopt
RESOLUTION 1980-63, A RESOLUTION SETTING THE SITE PLAN
APPLICATION FEE IN THE RB AND CB DISTRICTS AT A MINIMITN
OF $25.00, AND ALL OTHER COSTS INCURRED, IN EXCESS,
TO BE BILLED TO THE APPLICANT AND TO BE PAID PRIOR TO THE
ISSUANCE OF SITE PLAN APPROVAL.
VOTING FOR: LaValle, Spitzer, Irsfeld
MOTION CARRIED
MOTION: -Spitzer made motion, seconded by Irsfeld, to set a Special
Meeting for February 11 , 1980, at 7:00 P.M. , for the pur-
pose of discussion of Police Union Contract.
