PRESENT: LaValle, Schletty, Irsfeld, Vail ABSENT: Spitzer 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Vail, to approve the Minutes of March 17, 1980, after the following change has been made: 5.2 Bruce Myhre — table matter until April 21 ,. 1980. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Schletty, to approve the General Claims for April 7, 1980, as submitted. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims for April 7, 1980, as submitted. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 5 .0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5 .1 Jerome Jessen — Renew of Mobile Home Permit MOTION: LaValle made motion, seconded by Irsfeld, to grant a renewal of the Mobile Home Permit for Jerome Jessen, 7475 132nd Street North, under Chapter 40, Article Subdivision D, for a period of 90 days. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 5 .2 Hjelmhaug & Mireault — Signed Contracts Mr. Hjelmhaug's property has been hooked up to the sanitary sewer. Mrs. Mireault presented the Council with a copy of her signed contract. She inquired as to whether the city would be able to help her financially with the cost of the project. The city is in no position to help her financially. Mrs. Mireault has until June 1 , 1980, to hook up to the sewer. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 5.3 Safeway House Movers - Petition for Mobile Home Permit (7:15 PM) The public hearing to consider the request of Safeway House Movers for a Mobile Home Permit to be used for Watchman's Quarters was called to order at 7: 15 PM. Mr. Cardinal was present, and stated that he had no problem with the request. The public hearing was closed at 7: 16 PM. MOTION: Irsfeld made motion, seconded by Vail, to grant a Mobile Home Permit to Safeway House Movers, 5885 165th Street North, under Chapter 40, Article III, Subdivision E, for a period of ninety (90) days, for Watchman Quarters. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 5.4 Bruce Myhre - Complaint This matter will be discussed at the meeting of April 21 , 1980. 5.6 Charles Schwab - Site Plan Approval and Variance Mr. Schwab has property in the Agricultural District and would like to construct a 32 x 32 pole barn. The Planning Commission recommended approval of the Site Plan along with a Variance to construct the barn closer to the road than the primary building. Mr. Johnson stated that two applications would be appropriate or an Ordinance Amendment would be in order. MOTION: Irsfeld made motion, seconded by Vail, to approve the Site Plan for Charles Schwab to construct a 32 x 32 pole barn to be used for personal garage and storage. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to approve the Variance for Charles Schwab to allow the pole barn to be constructed closer to the road than the primary building. Building to meet ordinances for setback requirements. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED Page 41 APRIL 7, 1980 5 .9 Marlowe Peuse - Hookup pipe under Irish Avenue Mr. Peuse, son-in-law of Mrs. Duraine, would like to replace a water pipe running under Irish Avenue from the house to the barn. MOTION: Irsfeld made motion, seconded by Schletty, that the city grant approval to Marlow Peuse to replace the existing water pipe between the barn and the house which crosses Irish Avenue and ,that this be accomplished by pushing the pipe under the road rather than digging up the road surface. If this cannot be accomplished, then Mr. Peuse must come back to the City Council to obtain approval to tear up the road surface. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 5.7 Andrew Goiffon - Special Use Permit 5.8 Richard Schuh - Mining Permit Mr. Schuh requested that his two Mining Permits require only one bond for the two pits. He also stated that he would be requesting an asphalt plant on the pit. MOTION: Schletty made motion, seconded by Vail, to grant a Special Use Permit to Andrew Goiffon, effective May 1 , 1980, for mining gravel. If no valid Mining Permit in effect, Special Use Permit will be null and void. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Irsfeld, to grant a Mining Permit to Richard Schuh subject to the conditions of the existing Mining Permit that Mr. Schuh has for the Lavina Duraine pit. Mr. Schuh be allowed to use the Letter of Credit and Bonds as security on both pits. The haul roads on the Andrew Goiffon pit shall be easterly on 147th Street to Irish Avenue, and the haul roads used on the Duraine pit will also bein effect on the Andrew Goiffon pit. Permit to become effective May 1 , 1980 to June 30, 1981. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 5 .5 Thomas Clark - Minor Subdivision and Variance Mr. Clark owns approximately 36 acres of property zoned RR11 and AG. This acreage does not include the existing homesite of 3.5 acres which was established in 1966. The land is proposed to be divided into two lots (5 .1 acres and 31 acres) . Mr. Clark was advised to have the tract lettering type of survey (Tract A and Tract B) . Page 42 APRIL 7, 1980 Thomas Clark — Continued MOTION: LaValle made motion, seconded by Schletty, to approve the Minor Subdivision for Thomas Clark to divide 36 acres into two lots of approximate acreage (5.1 A and 31 A) subject to Mr. Clark's providing a Certificate of Survey. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Irsfeld, to grant a Variance to Thomas Clark on the 5.1 acre parcel to allow a minimum lot width of 165 ' because no more land available. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 5.10 James Brevig — Rezoning Mr. Brevig has made application to rezone Lot 2, Block 2, Evergreen Hills , froth RRII to SFE. The Planning Cdmmission recommended denial. Attorney Johnson stated that no formal draft has been prepared, but mentioned some, of the conditions discussed with Brevig's attorney, Mr. Tim Geck. 1 . Restrictive covenant stating that property cannot be divided into more than two lots until public utilities provided. 2 . Mutual releases of the claims by/against the city. 3. Easement for continued maintenance of the dike in its present position by the city. 4 . Use of top of dike as roadway. The property owner to bear the cost of the roadway, with a minimum of 10' width for driveway purposes. The water level of the dike will be controlled by a culvert with a gate. The new lot will be subject to all restrictions determining a buildable site. MOTION: LaValle made motion, seconded by Irsfeld, to grant a rezoning to James Brevig for Lot 2, Block 2, Evergreen Hills from RRII to SFE, subject to a Minor Subdivision application and approval. Also subject to an agreement between James Brevig and the City of Hugo resolving all matters of concern on that particular piece of property. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED Page 43 APRIL 7, 1980 James Brevig — Continued Attorney Johnson was directed to work with Mr. Geck to resolve the matter of the agreement between Mr. Brevig and the City. 5 . 11. Discussion of 130th Street into Bald Eagle Industrial Park_,. . Occupants in the Industrial Park were present to discuss the con- dition of 130th Street leading into the park. Mayor LaValle directed Councilman Schletty to have gravel placed on the road, and the road to be graded every week. The present condition of the road was said to be hazardous. Engineer Kuusisto will meet with the Mayor and the owners of the businesses to determine cost estimates and future plans for the park. 5 .12Arthur Bald Eagle Sportsmsn Assn. Timm —... MOTION: Schletty made motion, seconded by Irsfeld, to refer this matter to the Planning Commission for their review at the meeting of April 9, 1980. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee — No discussion 6.2 Planning Commission The Planning Commission recommended that Site Plan and Variance be addressed on one applicatLon with payment of the highest fee. MOTION: Schletty made motion, seconded by Vail, that the City Council determined that individual applications and fees be required for Site Plan Approval and Variance. VOTING FOR: LaValle, Schletty, Vail VOTING AGAINST: Irsfeld MOTION CARRIED 6.3 Water Superintendent Mr. Burkard was instructed to contact Mr. Atkinson regarding the watermain break by Nadeau's store. 6.4 Building Inspector Mr. Crever submitted his monthly report. Page 4 4 APRIL 7, 1980 6.5 Fire Chief MOTION: Vail made motion, seconded by Irsfeld, to allow the Fire Department to send 7 men to the State Fire School, in the amount of 4600.00, and to send two men to the State Fire Convention, in the amount of , 400.00. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED 6.6 Police Chief Acting Police Chief Pure submitted his monthly report. 6.7 Attorney Mr. Johnson submitted his monthly report. 6.8 Engineer Engineer Kuusisto submitted his monthly report. 6.9 Clerk MOTION: LaValle made motion, seconded by Schletty, to notify Anoka Electric that the City of Hugo will pay the increased rate for the 150 watt high pressure sodium lights. The 150 watt lights not to be replaced. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Vail, to set May 7, 1980, from 9:30 AM to 3:00 PM, as the day for the Board of Review. VOTING FOR: LaValle, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Vail made motion, seconded by Schletty, to extend the meeting past 11 :00 PM. All aye. Motion Carried. 8.0 UNFINISHED BUSINESS 8.1 Audit Report MOTION: Irsfeld made motion, seconded by LaValle, to set a Special Meeting of the City Council for April 22, 1980, at 6:30 PM, for the purpose of discussion of the audit report.
