PRESENT: LaValle, Spitzer, Irsfeld Vail ABSENT: Schletty Mayor LaValle stated that the proposed assessment rate is $14.43/foot, of which 40% will be picked up by the city. The stub charge will be included in the $400.00 hookup charge. Mayor LaValle felt there was a discrepancy in the charge for water hookup. He stated that there is a REC charge for sewer connection, but no charge similar to that for water hookup. LaValle suggested that the Ordinance Committee work with Mr. Burkard, Water Superintendent, and report of their findings. (SCHLETTY ARRIVED AT 6:58 P.M.) MOTION: LaValle made motion, seconded by Vail, to adopt RESOLUTION 1980-69, A RESOLUTION SETTING THE ASSESSMENT FIGURE RATE FOR THE WATERMAIN IMPROVEMENT 140th STREET LOOP CLOSURE AT $14.43/FOOT. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, to adjourn the public hearing at 7:00 P.M. All aye. Motion Carried. The regular meeting of the Hugo City Council was called to order at 7:00 P.M. PRESENT: LaValle, Spitzer, Schletty, Irsfeld, Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Spitzer, to approve the General Claims for May 19, 1980, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Spitzer, to approve the General Claims for May 19, 1980, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES Todd and Scott Hubbard were present and stated that they are in the process of purchasing Schmidty's 61 Club, and anticipate closing the sale on June 3, 1980. Their Articles of Incorporation were reveiwed by Mr. Johnson and met with his approval. There are 3 brothers involved in this corporation. MOTION: Spitzer made motion, seconded by Irsfeld, to grant the following licenses to Three H's, Inc. , Schmidty's 61 Club, 17285 Forest Blvd. , Hugo, Minnesota: Off Sale Intoxicating Liquor, On Sale Intoxicating Liquor, On Sale Non-Intoxicating Liquor, On Sale Sunday Liquor, Cigarette, Soft Drink, and Billiard, in the amount of $1 ,795.31 . All issuance of licenses conditioned on the sale of Schmidty's 61 Club to become effective June 3, 1980, or such time as closing may occur within 60 days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.1 William Poferl - Business in Home Mr. Poferl, 12056 Everton Avenue North, was requested to appear before the Council to discuss his business operation in his home. Mr. Poferl stated that he recently received a large contract for business with 3M Company, but the job should be finished by the middle of June. He normally employs one full time and one part-time. For this particular job, he has hired 4 extras, and to eliminate parking problems, they now carpoll and utilize one car. Mr. Poferl stated that he started his bus- iness in 1975 (Zoning Ordinance adopted January, 1975) . Spitzer stated that Mr. Poferl cannot intensify his operation on a permanent basis or the city would have to look at it again. A Special Use Permit may then be required. 5.2 Paul Santanni - Renew of Mobile Home Permit MOTION: Spitzer made motion, seconded by Vail, to grant a renewal of the Mobile Home Permit for Paul Santanni at 7124 125th Street North, under Chapter 40, Article III, Subdivision C, for a period of 90 days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Page 60 May 19, 1980 5 .3 Joseph Gregoire - Renew of Mobile Home Permit MOTION: LaValle made motion, seconded by Spitzer, to grant a renewal of the Mobile Home Permit for Joseph Gregoire, 7600 165th Street North, under Chapter 40, Article III, Subdivision D, for a period of 90 days, provided that $10.00 fee is paid prior to June 1 , 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.5 Vern Peloquin - Release of Letter of Credit (Freeland Avenue) Howard Kuusisto recommended that the Letter of Credit be released after Mr. Peloquin has cleaned out the upstream end of the culvert. MOTION: Spitzer made motion, seconded by Irsfeld, to release the Letter of Credit from Vern Peloquin for the construc- tion of Freeland Avenue after the culvert has been cleaned. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.6 Pat Svendsen - Variance MOTION: Irsfeld made motion, seconded by Vail, to approve a Variance for a 8' setback from rear and side yard, to construct a 60 x 110 tennis court. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.7 Howard Moe - Annual review of Special Use Permit MOTION: Irsfeld made motion, seconded by Spitzer, to approve con- tinuance of the Special Use Permit for B 8c H Auto Sale, Howard Moe, striking Items 2 and 3. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS MOTION: Spitzer made motion, seconded by Schletty, to adopt RESOLUTION 1980-68, A RESOLUTION ESTABLISHING A BOUNTY ON POCKET GOPi t S CAPTURED IN THE CITY OF HUGO, MINNESOTA, AND AUTHORIZING THE APPOINTMENT OF A BOUNTY PAYMASTER FOR RECEIVING CAAIMS AND APYING BOUNTIES ON POCKET GOPHERS, AND ESTABLISHING COMPENSATION FOR THE BOUNTY PAYMASTER. Page 61 May 19, 1980 VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, to adopt RESOLUTION 1980-70, A RESOLUTION AUTHORIZING THE JOINT AND COOPERATIVE AGREEMENT FOR USE OF POLICE PERSONNEL AND EQUIPMENT AND AUTHORIZING DESIGNATION OF REQUESTING OFFICIAL AND RESPONDING OFFICIAL. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1 NSP Release Agreement 7.2 NSP Powerline Easement These matters will be discussed at the Council meeting of June 16, 1980. 8.0 NEW BUSINESS 9.0 CLERK MOTION: LaValle made motion, seconded by Spitzer, to approve the vacation days as requested by James Fure. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED The Hugo Lions Club has agreed to allow the Hugo Slow Pitch team to use their existing one year 3.2 non-intoxicating and soft drink for their Slow Pitch Tournament, May 31 and June 1 , 1980. Proof of Insurance will be provided. MOTION: Spitzer made motion, seconded by Schletty, extension of the Hugo Lions Club permission to use the city park from May 30 - June 10, 1980. Permission is also given to use their liquor license and soft drink license on the addition- al dates of May 31 , 1980 and June 1 , 1980. In accordance, the Hugo Lions Club will maintain Dram Shop Insurance and a full time licensed police officer must be on duty dur- ing the bar operation.
