PRESENT: LaValle, Spitzer, Vail ABSENT: Schletty and Irsfeld 3.0 APPROVAL OF MINUTES MOTION: Vail made motion, seconded by Spitzer, to approve the minutes of July 7, 1980, as submitted. VOTING FOR: LaValle, Spitzer, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Vail, to approve the General Claims for July 21 , 1980, after adding the claim of $140.00 to Police Department/Mike Gibbs. VOTING FOR: LaValle, Spitzer, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, to approve the Utility Claims for July 21 , 1980, as submitted. VOTING FOR: LaValle, Spitzer, Vail MOTION CARRIED (SCHLETTY ARRIVED AT 7:05 PM) 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Randall Irving - Temporary Mobile Home Permit Mr. Irving was present and stated that Mr. Crever has his applications, and is not yet finished with them. He would like to move the trailer in as soon as possible with no intention to move for at least a month. There is a well on the property, but no septic system or utilities. MOTION: Spitzer made motion, seconded by Vail, to grant a Temporary Mobile Home Permit to Randall Irving, 12875 Henna Avenue, under Chapter 40, Article III, Subdivision B, for a period of 90 days. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED 5.2 Bill Clark - Erosion and Drainage Problem Mr. Kuusisto presented the Council with elevations taken at the Clark residence located at 12601 Homestead Avenue. As a result of excavations being done on property located Page 77 July 21 , 1980 across the street, an erosion and drainage has occurred causing the roadbed to be damaged. MOTION: Spitzer made motion, seconded by Schletty, that Mr. Bill Clark be notified that the City Council requests that he appear before them at their meeting of August 4, 1980, 7: 15 PM, to discuss plans for the control of the unnecessary erosion in the vicinity of his recent construction. The City Engineer is directed to meet with Mr. Clark prior to the above date and develop recommendations which can be definitively discussed on August 4th. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED 5.3 Ramsey County/Hugo Contract for Signal at 120th Street MOTION: LaValle made motion, seconded by Vail, that the City of Hugo approves Agreement #59972 between the State of Minnesota and Ramsey County for the construction of a railroad crossing signal (arms and lights) at 120th Street and Highway 61 , and the City of Hugo will participate in the allocated cost of 5% for the cost of installation. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED Mayor LaValle has discussed the possibility of Hugo participating in the recon- struction of 120th Street east of Highway 61 . MOTION: Spitzer made motion, seconded by LaValle, that Howard Kuusisto be directed to set up a meeting with the Washington County Engineer to decide what the counties participation may be in the upgrading of 120th Street east of Highway 61 , and further to meet with the Ramsey County engineer to make an estimate of cost on such road improvement and allocated cost between the effected parties. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED 5.4 Salary Review MOTION: Spitzer made motion, seconded by Schletty, that this matter be laid over until the next meeting and the Mayor appoint himself and Coun- cil-at-Large to develop recommendations as may be necessary for salary structure. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS No discussion Page 78 July 21 , 1980 7.0 UNFINISHED BUSINESS Mayor LaValle stated that the Washington County Board of Commissioners has approved that the Sheriff's office enter into a contract with Hugo for policing. The pro- posed contract has not yet been submitted to Hugo. A letter or resignation from Acting Police Chief James Fure was submitted to the Council, to be effective July 24, 1980. MOTION: Spitzer made motion, seconded by Schletty, to accept James Fure's resignation. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED A letter of resignation from Officer Mike Gibbs was submitted to the Council to become effective immediately. MOTION: Spitzer made motion, seconded by Vail, to accept Mike Gibbs' resignation. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED The Mayor took time to express his thanks for the excellent service provided the city by the resigning officers. MOTION: Spitzer made motion, seconded by Vail, that prior to acceptance of the resignations of Messrs. Fure and Gibbs, the City Council hereby waives the requirement for 30 day notice of termiantion of Police Officers employed by the city. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED It was suggested that the Mayor obtain a letter from Sheriff Trudeau stating that Washington County will provide police protection for the City of Hugo until the proposed contract is consummated. Officer Fure stated that he has utilized two days of sick leave in 52 years and was wondering about compensation. The union contract has been in effect for two years and 7 months. MOTION: Spitzer made motion, seconded by LaValle, that the City of Hugo com- pensate the resigning Police Officers who will serve Washington County, 100% of the accrued and unused sick leave accrued since 1/1/78. MOTION: LaValle made motion, seconded by Vail, that this matter be tabled until the next meeting to obtain updated information as to how many dayshave actually been used. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED Page 79 July 21 , 1980 A letter from Officer Fare was submitted regarding the status of the part-time officers. Fure felt that it would be beneficial to the city to retain these men for public functions that take place during the year. After some discussion, the Council felt that there would be numerous problems if these men were retained (scheduling, liability, and administration) . MOTION: Spitzer made motion, seconded by Schletty, that the city accept Mr. Fure's recommendation and take no action. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED 8.0 NEW BUSINESS The Council discussed the Emergency equipment being used in private vehicles by the Fire Department. MOTION: Spitzer made motion, seconded by Schletty, that the Fire Chief be notified that in accordance with Minnesota State Statutes 169.64 and 169.68 and various actions by the City Council of Hugo, the use of personal vehicles for emergency use is prohibited. The Fire Chief is hereby directed to cease immediately the use of any personal ve- hicles for such emergency use and to certify no later than August 18, 1980, that all personal vehicles equippped for emergency use have had such equipment removed. The Fire Chief is further notified that future violation of these statutes and policies will result in immediate prosecution of any member of his department found in violation. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED Let the record show that Councilman Spitzer asked that Officer Fure make a report regarding this matter and the Spitzer sponsored the motion. COMPREHENSIVE PLAN MOTION: LaValle made motion, seconded by Spitzer, directing the City Attorney to set up a meeting with Mr. Bob Lockyear and any Council or Planning Commission members to further discuss the proposed Compre- hensive Plan. VOTING FOR: LaValle, Spitzer, Schletty, Vail MOTION CARRIED The Metro Council will be holding a public hearing on July 31 , 1980, 2:00 PM, to discuss draft guidelines establishing a procedure for review of proposed amend- ments to local comprehensive plans. The Planning Commission will review the data at their meeting of July 23rd. The Clerk is to call Mike Kuehn to get on their agenda, and the city will have a representative at the hearing. If a rep is unable to attend, written comments will be accepted until August 6th. The Council discussed the outstanding Letter of Credit from Grace Development for the coverage of necessary repairs needed in the industrial park (culvert in front of Axin Products) . Page 80 July 21 , 1980 MOTION: LaValle made motion, seconded by Schletty, that the City Clerk be directed to notify the 1st State Bank of Hugo that Grace Development has not met the obligations that their Letter of Credit guarantees and the city is taking action to draw on this Letter of Credit. LaValle withdrew his motion. The Clerk is to notify the 1st State Bank of Hugo that the Letter of Credit from Grace Development is in jeopardy, and no future extensions will be granted.
