MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
October 6, 1980
The meeting was called to order by Mayor LaValle at 7:07 PM.

3.0 APPROVAL OF MINUTES
MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of
September 15, 1980, after the following change has been made:
Page 1 (Buschmann) - The reflectors have been removed

5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES
5.1 Safeway House Movers - Renew of Mobile Home Permit
MOTION: LaValle made motion, seconded by Spitzer, to renew the Mobile Home Permit
for Safeway House Movers, 5885 165th Street, Under Chapter 40, Article III,
Subdivision E. for a period of 90 days.

5.2 Neil Buschmann - Nuisance Complaint
MOTION: Spitzer made motion, seconded by Irsfeld, to vacate the nuisance com-
plaint against Mr. Buschmann.

5.3 Benson Kennel - Change in Building Structure
The original plan for the kennel was for construction of an all-block building.
Mr. Barbour stated that because of financial reasons, he is contemplating a
change in the wing sections from block to metal. The metal wings will be en-
tirely insulated, and should have the same limitations in regard to the noise
factor. The center section of the building will be block. Barbour is proposing
construction of the building in three pases: 1 ) the first wing to be con-
structed immediately, 2) the center section within one year, and 3) the last
wing at an unknown time. Planning Commission member, McAllister, requested the
matter be tabled because of a:-possible change in ownership of the business.
Barbour stated that Mr. Benson is approaching 80 years old, and would remain
in the business operation, but not actively or financially. Engineer Kuusisto
reviewed the perc tests for the kennel, and found them to be adequate.
MOTION: Spitzer made motion, seconded by Irsfeld, to amend the conditions of
the Special Use Permit for Benson Kennels as follows:
1 . The building to be constructed will be a combination of metal and block,
as indicated on the plans submitted.
2. The metal portion, indicated as Phase 1 , will be completed by December. 31 ,
1980, and block and frame building' indicated as Phase 2, will be completed
by December 31 , 1981 . The metal wing, indicated as Phase 3, will be built
only upon amendment of this Special Use Permit.
3. Should Phase 2 not be completed on or before December 31 , 1981 , the Special
Use Permit granting a commercial kennel operation shall become null and
void. If Phase 1 is not completed on or before December 31 , 1980, the
entire Special Use Permit shall become null and void.
4. This permit shall be reviewed by the City Council for compliance to these
conditions in January of 1981 and January, 1982.
5. The entire Special Use Permit shall be null and void unless agreed to by
applicant no later than October 31 , 1980.

5.4 A & B Construction - Special Use Permit (Public Hearing 7:30 PM)
Public hearing called to order by Mayor LaValle at 7:40 PM. Mr. Atkinson,
A & B Construction, withdrew his application of the permit to allow for a mobile
home and residence in the Industrial zone.
MOTION: Spitzer made motion, seconded by Irsfeld, to close the public hearing
at 7:41 PM.

Of the applicant, the A & B Construction application is vacated.

5.5 MR Tourist Camp - Special Use Permit
Mr. Kassen Rameden had made application for a Special Use Permit to operate a sea-
sonal trailer camp. Mr. Rameden failed to submit the required data to consider
his application for public hearing.
MOTION: Spitzer made motion, seconded by Schletty, that the application from
MR Toursit for a Special Use Permit be denied in view of the inacti-
vity of the applicant and no response to numerous requests by the
City Council.

5.6 James Brevig
Attorney Tim Geck and Mr. Johnson have completed the agreement between the City of
Hugo and James Brevig for the resolution of the dike matter and the Minor Subdi-
vision of Brevig's property. The property was rezoned to SFE on April 7, 1980, sub-
ject to certain conditions, as listed in the proposed agreement. Geck stated
that proof of ownership will be forthcoming along with consent from the mortgage
company.
MOTION: Spitzer made motion, seconded by LaValle, to approve the following:
1 . The agreement between the City of Hugo and Mr. James Brevig be approved
and Mayor be instructed to sign the agreement on behalf of the City when
tle conditions have been satisfied.
2. Rezoning of the property described as Lot 2, Block 2, Evergreen Hills, to
SFE be approved pursuant to the public hearing previously held by the
Planning Commission on 2/13/80.
3. The Minor Subdivision permitting the division of said property into two
parcels be approved.
4. Approval of this agreement is contingent upon submission of proof of ownership
and consent of mortgage company to the granting of the easement, by October 31 ,
1980.

6.0 REPORTS OF OFFICERS & COMMITTEES
MOTION: LaValle made motion, seconded by Irsfeld, to deny adoption of ORDINANCE 174,
AN ORDINANCE AMENDING CHAPTER 20 ENTITLED "ADMINISTRATION" FOR THE PUR
POSE OF ADJUSTING THE SALARIES OF THE CITY OFFICIALS.
VOTING FOR: LaValle, Schletty, Irsfeld
VOTING AGAINST: Spitzer and Vail

6.1 Ordinance Committee
The Ordinance Committee will review the Sign Ordinance at their meeting of 10/16/80.

6.2 Planning Commission - No discussion
6.3 Water Superintendent - No discussion
6.4 Building Inspector
The Building Inspector will be out of town until October 12, 1980.
6.5 Attorney
Mr. Johnson submitted his monthly report. Mr. Johnson was instructed to contact
Mr. John Hoeft regarding the status ofthe Open Space matter. The City Clerk was
instructed to contact Metro regarding an application to obtain additional funds
for completion of the Comprehensive Plan. Mr. Lockyear is also to be contacted
regarding the status of said plan.
6.6 Engineer
Mr. Kuusisto submitted his monthly report. A report was also submitted regarding
road improvements and storm sewer in the Bald Eagle Industrial Park. Kuusisto
will check with HUD regarding the possibility of obtaining a low-interest loan,
and Irsfeld will check on the feasibility of inter-fund borrowing with Bob Ehlers.
Mr. Gene Leroux will be hired by the city to perform the seeding necessary because
of the Bridge Replacement Program. Mr. Leroux will be paid $4.50/hr.

6.8 CLERK
The city has received a letter from Robert Ricci regarding payment of the overdue
water bill at Hoppy's Saloon.
MOTION: Spitzer made motion, seconded by Vail, that the City of Hugo accept the
contract from Rovert Ricci in lieu of certification of the delinquent
water bill at Hoppy's Saloon.

install gas mains at the Twin Pine Mobile Home Park, in accordance with
JOB ORDER G-590430.

Northwestern Bell to construct and thereafter maintain buried telephone
plant on 148th Street east of Highway, in accordance with JO 48029.

VOTING AGAINST: Schletty

The safe from the Police Department has been sold for $50.00. The caterpillar
owned by the city has been stolen from the gravel pit. It was insured for $1 ,000
with a $250 deductible.
MOTION: Schletty made motion, seconded by LaValle, that the City Clerk be in-
structed to file a claim with the city's insurance company for loss
of the city's caterpillar.

The Council will discuss the hiring of a maintenance person for the city at the
meeting of 10/20/80.
MOTION: LaValle made motion, seconded by Irsfeld, that the 180th Street joint
Improvement Project between the City of Hugo and Forest Lake Township
be approved with the understanding that Forest Lake Township will reim-
burse the City of Hugo for 50% of the cost.
