PRESENT: Spitzer, Schletty, Irsfeld,Vail ABSENT: LaValle 3.0 APPROVAL OF MINUTES,. MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of November 17, 1980, as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of the Special Meeting of November 24, 1980, as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Spitzer, to approve the General Claims for December 1 , 1980, as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims for December 1 , 1980, as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.2 Schmidty's - Off Sale Liquor License MOTION: Schletty made motion, seconded by Irsfeld, to grant an OFF SALE LIQUOR LICENSE to 3H's, INC. , (Schmidty's 61 Club) , 17285 Forest Boulevard, in the amount of $100.00. VOTING FOR: Spitzer, Schletty, Irsfeld,Vail MOTION CARRIED 5.3 Homer Dole - Land Division Messrs. Dole and Radford were present, and stated that the proof of ownership and a new survey sketch were submitted as requested. Deeds were submitted indi- cating an easement, but the attorney determined that the language did not es- tablish right-of-way. Percolation tests have not been submitted. Spitzer sug- gested that Mr. Dole obtain an easement from Theodore Peltier, in favor of Sovereign and LaCasse, to convey a 33' easement (access) across the east side of Peltier's property. Page 133 December 1 , 1980 MOTION: Irsfeld made motion, seconded by Spitzer, that the Homer. Dole matter for Land Division be added to the agenda for the Special Meeting of 12/8/80, at 7:00 PM. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.4 Charles Shubat - Special Use Permit Mr. Shubat is siiking a permit for Xmas tree sales located on his property. The Planning Commission was bypassed because of the time element involved. The treees were grown on the property, and will be cut on three consecutive weekends. There will be off road parking available. MOTION: Irsfeld made motion, seconded by Vail, to grant a Special Use Permit to Charles Shubat for the sale of Christmas trees from December 1 , 1980 to December 31 , 1980. VOTING FOR: Spitzer, .Schletty, Irsfeld, Vail MOTION CARRIED 5.5 Hugo Lions Club - Open Covered Pavilion In the future, the Lions Club would like to construct a 24 x 60 open covered shelter on city property. The shelter would be available to the public, and would be used in conjurdion with Good Neighbor Days. At this time, they are looking for concept approval. MOTION: Irsfeld made motion, seconded by Schletty, that the City of Hugo is interested in the gneral concept presented by the Hugo Lions Club for the construction of an open covered area, with specific details and location to be determined at a later date. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Hugo Lions Club - Gambling Report i McAllister, gambling manager for the Lions Club, was present, with the gambling records for the club, indicating a profit of $1 ,424.00, after cost. MOTION: Irsfeld made motion,seconded by Schletty, to accept the Hugo Lions Club gambling report, subject to a written report of same being sub.- mitted to the clerk's office. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.6 Floyd Sabanjo - Complaint Mayor and Councilman Irsfeld made on-site inspections regarding complaints received by the city. Noack's property is in the process of being cleaned up. Trees will be replanted in the spring, and the fence is to be rewired. The Sabanjo property was also inspected and will supposedly be cleaned up shortly. MR Tourist Camp was inspected, and will be inspected again in:.a few weeks. The camp is dormant, and the manager stated that she will be moving. Councilman Irsfeld suggested that the clerk bring up the matter of a city clean up day Page 134 December 1 , 1980 in April (1st meeting) . The cement spipeslying along the shoreline of Sunset Lake should be brought in closer to the road sometime in the. spring. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee -- No discussion 6.2 Planning Commission - No discussion 6.3 Water Superintendent - No discussion 6.4 Building Inspector MP. Crever submitted his monthly report. • He noted that Bill Pavek has not removed his privacy fence as required by his Special Use Permit. MOTION: Irsfeld made motion, seconded by Spitzer, that the Clerk's office inspect the property, and is directed to write a letter to Mr. . Pavek stating that his fence should have been removed by November .1 , VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 6.5 Fire Chief - No discussion 6.6 Attorneys Mr. Johnson submitted his monthly report. The Washington County Sheriff's Contract was discussed. Johnson suggested that a cover letter be directed to.their atten- tion, including the original contract, their letters of October 24, 1980, and November 28, 1980, and exhibits. • Letter should state that this is acceptable as an operating agreement until revised. • MOTION: Irsfeld made motion, seconded by Vail, that the Mayor be directed to sign a letter accepting the 1980 Washington County Police Contract, with a• letter of clarification. VOTING•FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 6.7 Engineer - No discussion 6.8 Clerk The •clerk received a letter from Mrs. Philip Johnson, 12557 Homestead Drive, re- questing that the following signs be placed on their road: Deadend and Slow Children. The matter was given to Councilman Schletty for his review. Hazardous Waste Management. MOTION: Spitzer made motion, seconded by Irsfeld, that Councilman Deane Vail be named as representative to the Waste Management Board. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Page 135 December 1 , 1980 Complete Air has submitted a bid to convert the heating system at City Hall from oil to gas, in the amount of $1 ,175.00. MOTION: Vail made motion, seconded by Schletty, that the City of Hugo con- tract with Complete Air to have a gas furnace installed at City Hall. Installation to coincide with depletion of present oil supply. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED The Fire Chief contacted the City Clerk regarding the seating capacity at Schmidty's. The Building and State Fire code regulates the capacity. The seating capacity will be reviewed to determine if they are in violation of the regulations. MOTION: Spitzer made motion, seconded by Irsfeld, that the City Clerk be authorized to purchase a Christmas wreath for City Hall for $6.00. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.1 Bill Clark - Letter of Credit Expires 12/31/80 MOTION: Spitzer made motion, seconded by Irsfeld, that the City Engineer be requested to file a written recommendation with the city, prior to the Special Meeting of December 8, 1980, relative to the Clark matter, and that the matter of Clark's letter of credit be added to the agenda for the meeting on the 8th. VOTING FOR: Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to set a public hearing for January 19, 1981 , at 7:30 PM, for the purpose of consideration of street improvements in the Bald Eagle Industrial Park.
