PRESENT: LaValle, Spitzer, Schletty, Irsfeld, Vail 3.0 APPROVAL OF MINUTES MOTION: Spitzer made motion, seconded by Irsfeld, to approve the minutes of December 1 , 1980, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Spitzer, to approve the General Claims for December 15, 1980, after the following additions are made: Howard Kuusisto - $6,607.60 Carol A. Willimas (petty cash) - $21 .14 Nadeau's Market - $20.46 Walt Thielbar - $56.00 Capitol Electronics - $32.50 Claims for Anf inson, Hendrickson ($295.00) - delete VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Utility Claims for December 15, 1980, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Homer Dole - Land Division Mr. Dole stated that he had provided a quit claim deed for a 33' easement from Mr. & Mrs. Theodore Peltier. Irsfeld suggested that a Road Maintenance Agreement. be submitted between Mr. Bergman and future owners of Lots 3 & 4 (deed restriction) . Perc tests were taken on the lots, and one site would require fill to accommodate an on-site septic system. The Council and Engineer recommended that this fill set for one year prior to installation. MOTION: Irsfeld made motion, seconded by Spitzer, to approve the Land Division for Homer Dole ' subject ect to Mr. Dole's showing to the City of Hugo a Road Maintenance Agreement for sharing a driveway running between Mr. Bergman's and Lots 3 and 4, and this agreement shall be a deed restriction for Lots 3 and 4. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Page 138 December 15, 1980 5.2 John Jarvais - Land Division Mr. Jarvais is proposing the division of five acres from his property lying along Round Lake. Mr. Mike Ball, prospective buyer, was present, and submitted proof of ownership. A perc test has already been provided. MOTION: LaValle made motion, seconded by Spitzer, to approve the Land Divi- sion for John Jarvais and the Variance from the 300' road frontage because no additional land available. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.3 Thomas Clark - Land Division Mr. Clark is proposing the division of 30 acres into 3 10 acre lots lying along 132nd Street. Proof of ownership was provided when previous Minor Subdivision was granted. MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Land Division for Thomas Clark and that a Variance be granted for Parcel E from the required 300' road frontage. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 5.4 Bill Clark - Expiration of Letter of Credit MOTION Spitzer made motion, seconded by Irsfeld, that Mr. Bill Clark be notified that his Letter of Credit shll be extended for six (6) months. If Mr. Clark fails to provide the requested extension, his letter of credit will be drawn on December 29, 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED , 5.5 Shirley Nelson Hill- Vacate priority status (On Sale Liquor License MOTION: LaValle made motion, seconded by Spitzer, that the priority status of Shirley Nelson Hill for the existing On Sale Liquor License be terminated and refund to be made. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Before Mrs. Hill can obtain the liquor license, the following must be completed: 1 . Site Plan Approval 2. Special Use Permit 3. Building Permit 5.6 ' Liquor Licenses and Miscellaneous Licenses MOTION: Spitzer made motion, seconded by LaValle, that Shirley Nelson Hill ONE POTATA TRADING POST, 12010 Keystone Avenue, be granted the fol- lowing licenses: OFF SALE NON-INTOXICATING LIQUOR, CIGARETTE AND SOFT DRINK, in the amount of $32.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED Page 139 December 15, 1980 MOTION: Spitzer made motion, seconded by Schletty, that Todd Hubbard, THREE H's, INC. , 17288 Forest Boulevard, be granted the following licenses: OFF SALE NON...INTOXICATING LIQUOR, ON SALE INTOXICATING LIQUOR, CIGA- RETTE, SOFT DRINK, AND BILLIARD, in the amount of $1 ,537.00. The ON SALE SUNDAY LIQUOR LICENSE will not be granted until a more clear definition regarding Sunday liquor license requirements is provided. Spitzer withdrew his motion. MOTION: Spitzer made motion, seconded by Schletty, that Todd. Hubbard, THREE H'S, INC. , 17288 Forest Boulevard, be granted the following licenses: OFF SALE NON-INTOXICATING LIQUOR, ON SALE INTOXICATING LIQUOR, CIGA- RETTE, SOFT DRINK, AND BILLIARD, in the amount of $1 ,537.00. The city clerk is directed to notify the applicant why the On Sale Sunday license was not approved, and what is planned to be done. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Vail made motion, seconded by Spitzer, that Swan Anderson, SWANNY OF HUGO, INC. , 14559 Forest Boulevard, be granted the following licenses: OFF SALE NON-INTOXICATING LIQUOR, ON SALE INTOXICATING LIQUOR, ON SALE SUNDAY LIQUOR, CIGARETTE, SOFT DRINK AND BILLIARD, in the amount of $1 ,737.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Vail made motion, seconded by Irsfeld, that Howard Menne, MELODY LOUNGE, 13891 Forest Boulevard, be granted the following licenses: ON SALE INTOXICATING LIQUOR, ON SALE SUNDAY LIQUOR, CIGARETTE, SOFT DRINK AND BILLIARD, in the amount of $1 ,722.00. The outstanding water and sewer bill to be paid prior to December 31 , 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Schletty made motion, seconded by LaValle, that Leon Nadeau, NADEAU'S STAR MARKET, 14583 Forest Boulevard, be granted an OFF SALE NON-INTOXI- CATING LIQUOR, CIGARETTE AND SOFT DRINK LICENSES, in the amount of $32.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Schletty made motion, seconded by Spitzer, that Paul Salmon, PAUL'S PIZZA, 14849 Forest Boulevard, be granted a CIGARETTE, SOFT DRINK AND BILLIARD LICENSE, in the amount of $22.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS No discussion 7.0 UNFINISHED BUSINESS MOTION: Irsfeld made motion, seconded by Schletty, to change the public hearing date for street and storm sewer improvements for 130th Street (Bald Eagle Industrial Park) to February 2, 1981 , at 7:30 PM. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Schletty, directing the City Clerk to send a letter to Martin Zabel, ASCS Office, requesting him to pro- vide a map to the City of Hugo pursuant to Section 473H.03, Subd 4. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Schletty, to set a Special Meeting for January 12, 1981 , at 7:00 PM for the purpose of a joint meeting with the Planning Commission for review of the Comprehensive Plan. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld,Vail MOTION CARRIED Page 141 December 15, 1980 8.0 NEW BUSINESS 8.1 Filling of Planning Commission Vacancies MOTION: Irsfeld made motion, seconded by Vail, that the Ordinance Committee consider expanding the number of Planning Commission members from. seven (7) to nine (9) . VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED The applicants for the Planning vacancies are to be invitedto the special meeting of January 12, for an informal interview. 9.0 CLERK The Clerk was instructed to obtain information from the League regarding the insurance package that they offer. MOTION: LaValle made motion, seconded by Spitzer, approving the contract between the City of Hugo and Blaine Midway All Pets, for animal control within the city. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Irsfeld, that the contract between the City of Hugo (Fire Department) and Capitol Electronics for maintenance of pagers, be approved. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that the City of Hugo is opposed to legislative change regarding the League of Minnesota Cities' Policy on 2% Fire Aid. VOTING FOR: LaValle, Vail, Spitzer VOTING AGAINST: Irsfeld ABSTAINED: Schletty MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, that the Mayor meet with Kuusisto and Johnson to discuss the proposed Carnelian/Marine Watershed District. A public hearing will be held January 6, 1981 , at Still- water High School, regarding this proposal. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED The Metro Waste Control Commission is seeking a city official to serve on the Sewer Service Advisory Board for the purposes of reviewing, commenting, and advising the Commission on its various activities. Mayor LaValle volunteered to serve in this position. Page 142 December 15, 1980 MOTION: LaValle made motion, seconded by Irsfeld, to approve the Fire Department's plan for remodeling the offices in the Fire Dept. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, Vail MOTION CARRIED 10.0 MISCELLANEOUS Mr.Jeff Barbour was present, and requested an explanation regarding the engineer's suggestion for the septic system for the kennel. Mr. Barbour felt the system was more elaborate than he had anticipated. Councilman Spitzer suggested that Mr. Barbour have a system designed that he thinks will work, and to which Mr. Kuusisto agrees. If this system does not work, a full system would be required. Mayor LaValle presented out-going Councilman-st-Large, Dan Spitzer, with a plaque as a token for the many years he has served the City of Hugo, in many capacities. Everyone present concurred.
