The meeting was called to order by Mayor LaValle at 7:01 PM.

December 15, 1980, as submitted.

5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES
5. 1 Safeway House Movers - Renew of Mobile Home Permit
MOTION: McAllister made motion, seconded by Irsfeld, to grant a 90 days renewal
of the Mobile Home Permit for Safeway House Movers, 5885 165th Street,
under Chapter 40, Article III, Subdivision S.

5.2 American Legion Auxiliary 620 - Bingo License
MOTION: Irsfeld made motion, seconded by Sobletty, to grant a Bingo License to
the American Legion Auxiliary 620, with a waiver of the bond requirement.

5.3 Benson Kennel - Review of Special Use Permit
Mr. Jeffrey Barbour was unable to attend tonight's meetiug.

the meeting of 1/19/81 .

5.4 Doctors' Clinic - Site Plan Review
The Forest Lake Doctor's Clinic is proposing the renovation of the old Paul's
Pizza into the Hugo Dedical Clinic, contracted by Greg Gautsch Construction.
A Site Plan was submitted for review by the Council. Any access or egress from
Highway 61 will need state approval. At this time, Mr. Gautsch is looking for
concept approval only, and will at a later date, submit a more detailed plan.
The proposed clinic will be outpatient only, with two physicians working there.
The clinic will have six patient rooms, and three special use rooms. The existing
building will be added onto, but will not exceed the existing setback. The
parking layout has yet to be resolved.
MOTION: McAllister made motion, seconded by Irsfeld, to grant concept approval to
the proposed addition as indicated on the submitted Site Plan. A final
determination on parking will be made when a final and more detailed
parking plan is submitted. Applicant to provide a copy of the Purchase
Agreement, and the application for Site Plan Approval to be signed by
Robert Ricci and the Hugo Medical Cliuic,

5.5 Schmidty's 61 Club - Discussion on Sunday Liquor License
Scott and Todd Hubbard were present, and questioned why they were not given any
prior notice that their Sunday liquor license would not be iaaued. A license has
been issued to that business since 1976, Mr. Hubbard stated that they have pizza
ovens and a microwave, and do in fact serve food. It would be a matter of inter-
pretation of the law as to what constitutes a "meal". They have contracted with
bands for seven months (Sundays) in 1981 , and requested that the City Council re-
consider their position. If the Council should decide to set up criteria re-
garding what cmoditutms a restaurant, the Hubbard's agreed to take a look at their
business, and act accordingly for the year 1982.
MOTION: Vail made motioo' seconded by McAllister, that the City of Hugo grant an
On Sale Sunday Liquor License to SCHMIDTY'S 61 CLUB, 17285 Forest Boule-
vard, in the amount of $200.00.

5.5 Schmidty's 61 Club - Transfer of Special Use Permit
The original owners of Schmidty's 61 Club were issued a Special Use Permit, and
this permit should have been transferred at the time the property changed hands.
Mayor LaValle stated that Schmidty's has some parking problems (parking in front
of fire doors) , and Mr. Hubbard stated that they have been working to remedy this
problem. The Permit also states that there should be a fence along the front of
the business to prevent parking in the ditches, but Mr. Hubbard stated that the
state ordered them to have the fencing removed. Mayor LaValle stated that he
would check on this matter.

issued to Schmidty's, Inc. , be transferred to 3 H's, Inc. , with the same
conditions.

6.1 Ordinance Committee - No discussion

6.3 Water Superintendent
MOTION: LaValle made motion, seconded by Vail, to accept the resignation of
Robert Burkard, effective February 1 , 1981 .

Mr. Burkard is to be provided a copy of the Building Inspector's final inspection
report for a new house so that he can proceed with water billing.
6.4 Building Inspector
Tom Crever submitted his monthly report. Fred Macalus has constructed a pole barn
on his property without prior Site Plan Approval or a Building Permit. Mr. Macalus
is to go through the normal channels for Site Plan Approval.
MOTION: LaValle made motion, seconded by Schletty, that the Building Inspector
charge McCarron's Construction double for the Macalus permit.

6.5 Fire Chief - No discussion
6.6 Attorney
Mr. Johnson submitted his monthly report. A public hearing regarding the proposed
Carnelian/Marine Watershed district will be held 1/6/81 at Stillwater High School.
Hugo has three sections in that proposed district with a potential overlap with
the existing Rice Creek Watershed. This could result in double taxation. After
discussion with the Water Resources Board, they stated that the boundaries would be
amended if necessary. The attorney stated that the city could incur an undetermined
amount of expense if they become a party to the public hearing.
MOTION: Irsfeld made motion, seconded by Vail, that the City of Hugo adopt the
statement offacts and position, as submitted by Mr. Johnson, as it relates
to the proposed Carnelian/Marine Watershed District. The City of Hugo
will not become a part of the proceedings. Such statement to be filed
with the public hearing clerk at Stillwater. The City Clerk is authorized
to sign the statement.

Attorney suggested that maybe the Ordinance Committee should review the possession
of a misdemeanor amount of marijuana.

The Council stated that a milar copy of Weldwood Development's plat would be
acceptable to the city.
MOTION: McAllister made motion, seconded by Irsfeld, that the City Council approve
the agreement with Melody Lounge for payment of the delinquent utility
bill, and the Mayor be authorized to sign said agreement.

MOTION: Irsfeld made motion, seconded by Schletty, that the City of Hugo pay the
bill from Complete Air, in the amount of $1 ,175.00, and the bill from
Granger Plumbing, in the amount of $301 .25.

MOTION: LaValle made motion, seconded by Schletty, to approve the Farm Site
Plan for Raymond Rogalla, to construct a 36 x 50 pole barn.

7.1 Zoning Ordinance Amendment
MOTION: Vail made motion, seconded by McAllister, to set a public hearing for
February 16, 1981 , at 7:30 PM, for consideration of an ordinance amending Chapter 320
of the Hugo City Code entitled "ZONING" by amending use district provi-
sions and regulations relating to accessory storage buildings.

9.1 Designate Official Newspaper
MOTION: LaValle made motion, seconded by Irsfeld, to designate the Forest Lake
Times as the official newspaper for the City of Hugo for the year 1981 .

of Hugo and Twin City Federal, Maplewood, as the official depositories for
the City of Hugo for the year 1981 .

9.3 Appoint Acting Mayor
MOTION: LaValle made motion, seconded by Vail, to appoint Councilman Larry Irsfeld

9.4 Appoint Health Officers
MOTION: LaValle made motion, seconded by Schletty, to appoint Councilmen Mike

9.5 Appoint Liaison to Planning Commission
MOTION: Irsfeld made motion, seconded by LaValle, to appoint Mike McAllister as
City Council's liaison to the Planning Commission, and set up some kind
of schedule for inclusion of the balance of the Council, in this capacity.

MOTION: LaValle made motion, seconded by Schletty, to appoint Charles Johnson
as City Attorney for the year 1981 .

9.9 Appoint Councilman in Charge of Roads
MOTION: LaValle made motion, seconded by Irsfeld, to appoint Councilman Howard
Schletty in charge of roads.

9.10 Salary Review
MOTION: McAllister made motion, seconded by Schletty, to grant a pay increase
of 7% for all permanent, and permanent part-time employees of the
City of Hugo, with another review to be scheduled for the 2nd meeting
in June.

10.0 MISCELLANEOUS
MOTION: Schletty made motion, seconded by Irsfeld, to adopt RESOLUTION 1981-1 ,
A RESOLUTION ESTABLISHING A WEIGHT LIMIT OF 5 TON ON EVERTON AVENUE,
ETHAN AVENUE, AND 122ND STREET NORTH.
VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail

A copy of this resolution is to be forwarded to all licensed garbage haulers in
the City of Hugo.

City Council's liaison to the Ordinance Committee.
