PRESENT: LaValle, McAllister, Irsfeld, Vail ABSENT: Schletty 3.0 APPROVAL OF MINUTES MOTION: Vail made motion, seconded by LaValle, to approve the minutes of August 17, 1981 , as submitted. VOTING FOR: LaValle, McAllister, Irsfeld, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by McAllister, to approve the General Claims for September 8, 1981 , as submitted. VOTING FOR: LaValle, McAllister, Irsfe.ld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by McAllister, to approve the Utility Claims for September 8, 1981, as submitted. VOTING FOR: LaValle, McAllister, Irsfeld, Vail MOTION CARRIED • 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Forest Lake Youth Service Bureau Representative from the Bureau, Tom Oswald, was present, and submitted statistics for how many Hugo residents will be served by their organization in 1982. (SCHLETTY AR- RIVED AT 7:05 PM) . A short slide demonstration was shown illustrating the restitution program in Washington County. Mr. Oswald requested the support of the City of Hugo in the amount of $2,500.00. Mayor LaValle stated that the City will be working on the 1982 budget within the next few weeks, and, hopefully, the Forest Lake Youth Service Bureau will get the same consideration as in the past. 5.3 Public Hearing (Project 8102) - Bald Eagle Industrial Park (7:30 PM) The City Clerk read the public hearing notice as published in the Forest Lake Times. There was no one present at the meeting regarding this matter. MOTION: Irsfeld made motion, seconded by Schletty, to close the public hearing at 7:35 PM. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.2 Richard Parranto - Discussion on Easement (Janero Avenue) • Mrs. Olaf Larson, 11991 Janero Avenue, wanted to receive a letter from the City of Hugo stating that Janero Avenue is a dedicated street and that her property will always have access to 122nd Street by Janero Avenue and will be maintained by the City of Hugo. Mrs. Larson was concerned that her property could become landlocked. September 8, 1981 Apparently, there is a 20' easement which is creating a "cloud" on the title. Mayor LaValle stated that that road was established in 1880 and has been maintained ever since MOTION: McAllister made motion, seconded by Irsfeld, that the City of Hugo pro- vide Mrs. Olaf Larson, 11991 Janero Avenue, a letter indicating that Mrs. Olaf Larson has access to 122nd Street via Janero Avenue (a public street) . VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.4 Gerald Hauble - Site Plan Approval Mr. Hauble, 5460 125th Street, is proposing the construction of a 40 x 64 pole barn for his personal use. The original homestead was on a 2 acre parcel. Mr. Hauble has since combined the surrounding 8 acres with the 2 to create a 10 acre parcel to meet the zoning requirements. Mr. Johnson stated that a new Certificate of Survey will have to be submitted. MOTION: Irsfeld made motion, seconded by Schletty, to approve the Site Plan for Gerald Hauble, 5460 125th Street, for the construction of a 40 x 64 pole barn for personal storage only. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.5 John Trippel - Variance and Special Use Permit Mr. Trippel, 5732 150th Street, is proposing the construction of a 24 x 40 pole type building to be used as his main garage and for storage. The existing garage is located 4' from the side yard property line. That garage will be moved to the Dave Woeltge property, and the new building would use the existing footings. McAllister noted that the building has already been constructed prior to City appro- val. The adjoining property owners did not object to the proposal. MOTION: McAllister made motion, seconded by Irsfeld, to approve the Variance re- quest of John Trippel to construct a 24 x 40 pole barn 4 feet from the side yard property line rather than the required 5 feet. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: McAllister made motion, seconded by Vail, to approve the Special Use Permit for John Trippel to construct a 24 x 40 pole type building for his per- sonal use only. VOTING FOR: LaValle, McAllister, Irsfeld, Vail ABSTAINED: Schletty MOTION CARRIED MOTION: McAllister made motion, seconded by Irsfeld, that Councilmen McAllister and Irsfeld, along with the City Attorney, submit a recommendation to the City Council for setting building material standards in the RB, CB, SFU and SFE districts. VOTING FOR: LaValle, McAllister, Schletty, Irsfe ld, Vail MOTION CARRIED September 8, 1981 5.6 Dave Woeltge - Special Use Permit Mr. Woeltge, 5747 150th Street, would like to move in an 18 x 20 accessory garage on to his property. MOTION: McAllister made motion, seconded by Vail, to approve the Special Use Permit for Dave Woeltge to move in an 18 x 20 accessory garage for personal storage only. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.7 Richard Matthews - Special Use Permit Mr. Matthews would like to construct a 20 x 24 garage on his 5 acre parcel prior to construction of the residence. Because of present interest rates, Mr. Matthews is unable to construct the house. The Planning Commissionrecommended that Mr. Matthews provide a $1 ,500.00 letter of credit. Matthews stated that his bank normally issues Letters of Credit to commercial customers only. However, because of the small amount, he did not feel it would be a problem obtaining it. MOTION: LaValle made motion, seconded by Irsfeld, to approve the request of Richard Matthews for a Special Use Permit to construct a 20 x 24 garage prior to the main residence, subject to the following: 1. Mr. Matthews provide the City of Hugo a Letter of Credit in the amount of $1500.00, in a form acceptable to the City. 2. The Letter of Credit will be released upon Mr. Matthews' obtaining a valid Building Permit by May 1 , 1983. 3. If a valid Building Permit is not obtained, the City will take the $1 ,500.00 and remove the garage. The Special Use Permit will become null and void. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIER 5.8 Armon Septic System - Bond Mr. Monson and Mr. Wiedenbacker made another on-site inspection of the septic system located at 12616 Ingersoll Avenue. It appears as though the system is still not func- tioning properly. Mr. Monson is to appear before Rice Creek on 8-9-81 , and Mayor LaValle stated that he thought he would also be present. There was some discussion as to who would be responsible for percolation tests on the property across the street from Mr. Kruse's residence. MOTION: McAllister made motion, seconded by Irsfeld, that the $4,000.00 bond for the Armon septic system located 12616 Ingersoll Avenue be drawn on if Rice Creek should concur with the City of Hugo findings that the system presently installed does not 'function properly. ' On September 21 , 1981 , the City will undertake to hire a contractor to install a satisfactory system. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED September 8, 1981 MOTION: McAllister made motion, seconded by Vail, that the City Clerk request a letter from the property owner at 12616 Ingersoll Avenue giving per- mission to the City of Hugo and/or Armon System for the installation of an on-site septic system and testing procedures as may be necessary. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.9 Robert McCullough - Bond and Septic System Agreement The clerk's office has contacted Mr. McCullough on several occasions, and he has commented that heis having some trouble obtaining a bond. The septic system agree- ment with A & B Sanitation, stating that he is having the system pumped at least three times a year, should be submitted shortly. MOTION: McAllister made motion, seconded by Irsfeld, that Mr. McCullough be re- quested to privide the City with a signed contract with a sewage pumping firm, in lieu of a performance bond, and the pumping firm provide the City. with a copy of the statements for pumping work done on the McCullough property. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.10 Richard Vail - Development Agreement Kuusisto stated that he has been contact with Washington County regarding the drainage at the intersection of Egg Lake Road and proposed Fountain Avenue. Kuusisto has suggested that the developer investigate the possibility of the construction of a pipe and inlet to the intersection location and providing a culvert, if necessary, for transporting water to the inlet crossing Fountain Ave. MOTION: McAllister made motion, seconded by Irsfeld, to approve the content of the Development Agreement between the City of Hugo and Richard Vail for Shamrock Gen, and subject to final approval when the developer submits final documents to the City. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.12 Ronald Granger - Licenses MOTION: McAllister made motion, seconded by Schletty, to grant the following li- censes to Ronald Granger, dba Paul's Pizza, 14849 Forest Blvd: ON SALE NON-INTOXICATING LIQUOR, CIGARETTE AND SOFT DRINK, in the amount of $42.32. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: McAllister made motion, seconded by Irsfeld, to adopt ORDINANCE 181 , AN ORDINANCE AMENDING CHAPTER 140 OF THE HUGO CITY CODE ENTITLED "LICENSES ANDREGULATED ACTIVITIES" BY ABOLISHING SOFT DRINK REGULATIONS. VOTING FOR: LaValle, McAllister,. Schletty, Irsfeld, Vail MOTION: CARRIED r September 8, 1981 5.13 Letter from Dick Mireault - RE: Ebeling Special Use Permit The City received a letter from Mr. Mireault stating that he did not intend to uti- lize the previously granted Special Use Permit. He would again make application for a duplext if that was his future intention. MOTION: LaValle made motion, seconded by Vail, that the Special Use Permit issued to Alvin and Ila Ebeling, 14880 Francesca Avenue, be vacated. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.14 Report from Vail - RE: Charlene Pale Nuisance Complaint Councilman Vail inspected the Gerald Novy property because of a nuisance complaint received by the City from.Charlene Page. Vail found the complaint to be unwarranted. MOTION: LaValle made motion, seconded by McAllister, that Mr. Vail direct a letter to Charlene Page regarding his findings on the Novy matter. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.15 Howard Moe - Request of $60.00 refund Mr. Moe has withdrawn his application for subdivision and has requested the City to refund application fee of $60.00. MOTION: LaValle made motion, seconded by Schletty, that the request of Howard Moe be denied. The City has spent considerable time and effort of our pro- fessional people on this matter. The City Clerk is directed to calculate the hours charged to this project, subtract the $60.00, and send a bill to Mr. Moe for the balance. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 6.0 REPORTS OF OFFICERS AND COMMITTEES 6.1 Ordinance Committee Attorney Johnson suggesteda joint meeting be scheduled with the Ordinance Committee to assist them in their revision of the Subdivision Ordinance. Johnson will check with the County Auditor regarding his requirements, then set a special meeting. 6.2 Planning Commission - Grant Township's Comprehensive Plan The Planning Commission has recommended approval of the plan as submitted. MOTION: McAllister made motion, seconded by Irsfeld, that the City of Hugo send a letter to the appropriate authorities, regarding Grant Township's Com- prehensive Plan, indicating we have no problems with the plan. The Mayor is directed to draft a comment stating our long-range concerns for other communities that may re] on Hugo for emergency services. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED September 8, 1981 6.3 Water Superintendent Mr. Burkard was present and stated that someone has again climbed the city's water tower. There was discussion as to how the city could best solve the problem. MOTION: McAllister made motion, seconded by Schletty, that the Mayor and Water Superintendent be authorized to take the necessary action to alleviate the problem with the ladder on the water tower. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED The Council has recommended that the fee for turning water on for delinquent accounts be set at $25.00. The cost is presently $5.00. 6.4 Building Inspector - No discussion 6.5 Fire Chief MOTION: Irsfeld made motion, seconded by Schletty, that the Fire Chief be authorized to take the emergency vehicle (rescue truck) to obtain bids for refinishing. VOTING FOR: LaValle, Schletty, Irsfeld, Vail VOTING AGAINST: McAllister MOTION CARRIED The City of White Bear Lake has requested the City of Hugo for $2,062.00/year for paramedic and ambulance service. The Council is to be provided copies of the letter and matter to be placed on agenda for meeting of 8/21/81 . Attorney Johnson stated that he will draft a letter regarding the proposed changes in :the Fire Department's by-laws for discussion at the Council meeting of 8/21/81. 6.6 Attorney Mr. Johnson submitted 'his monthly report. The City has received a letter from the bank in Hugo stating that it is their position that the City should be responsible for legal fees for vacation of the cistern easement located on their property be- cause the City requested the easement. MOTION: LaValle made motion, seconded by McAllister, that the City will consider vacation of the described easement upon the 1st State Bank of Hugo paying legal fees incurred by the City in so doing it. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED Mr. Johnson reviewed the Letter of Credit as submitted by the bank in Hugo and questioned Condition #1. MOTION: Irsfeld made motion, seconded by McAllister, that the City Attorney in- struct the 1st State Bank of Hugo as to what the city's requirements are for the required Letter of Credit. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED September 8, 1981 6.7 Engineer Mr. Kuusisto submitted his monthly report. Councilman Vail stated that the crossing at 130th Street and Highway 61 will be closed 8/14/81 and possibly 8/15/81 for re- pairs on the railroad tracks. NSP is proposing the installation of gas mains across Highway 61 to 130th Street. MOTION: McAllister made motion, seconded by Irsfeld, that NSP Job Order G647305 be approved subject to compliance with the recommendations of the City Engineer. VOTING FOR: Irsfeld, McAllister, Vail. VOTING AGAINST: LaValle and Schletty MOTION CARRIED MOTION: McAllister made motion, seconded by Vail, that approval of NSP Job Order G647305 be conditioned on NSP provide a $50,000 Letter of Credit, acceptable to the City, to insure compliance with the requirements of the City Engineer. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 6.8 Clerk /plat and parcel The City has received a letter from Washington County regarding 35135-2350, stating that the Highway Department will turn the lot over to—the City if the City will abate the local taxes, penalties, costs, and interest. MOTION: Irsfeld made motion, seconded by Schletty, that the City of Hugo accept Washington County's proposal for Lot 35135-2350. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED The City has received a letter from the.Washington County Sheriff's Office regarding the purchase of a radar unit for $545.00. MOTION: LaValle made motion, seconded by Irsfeld, that the City of Hugo is not interested in purchasing radar. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by McAllister, to set a public hearing for October 5, 1981 , at 8:00 PM, for the purpose of an assessment hearing for Project 8102. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED The Clerk received Anfinson's cost estimate for auditing the city's books in 1982 - $7,000.00. The City did not feel that they should change auditors every year, eli- minating the necessity for bids. Irsfeld will check with the State Auditor to see if they have a program available to city's for auditing. MOTION: Schletty made motion, seconded by Vail, to extend meeting passed 11:00 PM. All aye. Motion Carried. -1 /^ /7 September 8, 1981 The Council stated that the on-site inspection program cannot be initiated within the city until we have Metro Council's recommendations on the Comprehensive Plan. The Council did not express interest in change the utility billing to a com- puter system. McAllister will check with Jim Wisner to see if he is still interested in City Hall maintenance. MOTION: Irsfeld made motion, seconded by Schletty, to grant a one day license to St. John the Baptist Church for ON SALE NON-INTOXICATING LIQUOR for the Fall Festival on September 13, 1981 . VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by McAllister, to set a Special Meeting for September 17, 1981 , at 7:00 PM, for the purpose of discussion of the 1982 budget. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 8.0 UNFINISHED BUSINESS 8.1 Applications for Bookkeeping Position It was determined that this matter will be discussed at the Special Meeting of 8/17/81 .
