PRESENT: LaValle, McAllister, Schletty, Irsfeld ABSENT: Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of December 7, 1981 , after the following addition has been made: Page 189 (last motion) - "all persons submitting claims for mileage do so on a quarterly basis, and on the statement show specific dates, mileage driven, and destination." VOTING FOR: LaValle, McAllister, Schletty, Irsfeld MOTION CARRIED 4.0 APPROVAL OF CLAIMS;' MOTION: Irsfeld made motion, seconded by LaValle, to approve the General Claims for December 21 , 1981 , as submitted. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld MOTION CARRIED (VAIL ARRIVED AT 7:05 PM) MOTION: Irsfeld made motion, seconded by McAllister, to approve the Utility Claims for December 21 , 1981 , as submitted. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Claude Bloomer,12471 Ethan Avenue, was present to discuss the problems he is having at his residence due to people using his property for access to Bald Eagle Lake for ice fishing. He requested that "NO PARKING" signs be installed along both sides of Ethan by his residence. Mayor LaValle felt that if the Sheriff's office issue enough tickets the problem would be resolved. MOTION: Irsfeld made motion, seconded by McAllister, to direct Washington County to install "No Parking" signs, and inform the Sheriff's department, by letter, to enforce the "no parking" situation, stating why we want the signs installed. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.2 Jeffrey Barbour - Land Division and Expiration of Letter of Credit Mr. Barbour submitted a Road Maintenance Agreement as previously requested. The agreement indicates access to the property via an undescribed easement. December 21 , 1981 MOTION: Irsfeld made motion, seconded by Vail, to approve the Land Division for Jeffrey Barbour, subject to the condition that the Road Agreement being recorded at Washington County. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED LETTER OF CREDIT The letter of credit, in the amount of $5,000, will expire 12/31/81 , and was re- quested originally to insure completion of Phase 2 of the kennel,parking area, and the septic system. The septic system for Phase 2 will be forthcoming. Mr. Barbour stated that he has planted 3,000 trees, and has ordered 5,000 more for planting this spring. MOTION: Irsfeld made motion, seconded by McAllister, that the $5,000 Letter of Credit be extended for one year, to guarantee the sewer system on Phase 2, according to the City Engineer's specifications, and consideration of parking facilities, if needed. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.3 Archie Potter - Land Division Mr. Robert McCloud is proposing the division of 39 acres into 3 parcels, one of which is owned by his daughter, Paula (Parcel B) . Parcel A was sold on Contract for Deed to Ray Wlaschin, and Parcel C is retained by Mr. McCloud. Proof-of- ownership was submitted. MOTION: Irsfeld made motion, seconded by McAllister, to approve the Land Division for Robert & Dorothy McCloud as follows: The SE2 of the SW4 and the E2 of the SW4 of the SW4 except West thirty three feet, all in Section 36, T31N, R21W of the Fourth Principal Meridian, Washington County, Minnesota, and subject to corrected survey. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED • 5.4 Maurice Gessner - Minor Subdivision Mr. Gessner has sold 2 acres to Ruby Loos, leaving a balance of 120 acres. Ms. Loos now owns a 22 acre parcel, but was not correctly identified on the deed. The sur- vey should eliminate the northern line of the two acre parcel, thereby creating the 22 acre parcel as desired by the city. A new deed will also be required with one legal for the entire parcel. MOTION: Irsfeld made motion, seconded by Schletty, to approve the Minor Sub- division for Maurice Gessner, subject to submission of a corrected survey and deed showing the 22 acres as one parcel. VOTING FOR: LaValle, McAllister, SChletty, Irsfeld, Vail MOTION CARRIED December 21 , 1981 5.5 American Legion Auxiliary - Bingo License MOTION: Vail made motion, seconded by McAllister, to grant a Bingo License to the American Legion Auxiliary Post 620, for the year 1982. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: McAllister made motion, seconded by Irsfeld, that the bond requirement for bingo manager, JoAnne Hovald, American Legion Auxiliary, be waived. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.6 American Legion - Gambling License MOTION: Vail made motion, seconded by McAllister, to .grant a Gambling License to the American Legion Post 620, for the year 1982. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by McAllister, that the bond requirement for gambling manager, Jim Husnik, American Legion Post 620, be waived. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: McAllister made motion, seconded by Irsfeld, to accept Jim Husnik's report, as the American Legion's Gambling Manager, for the year 1981. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 5.7 On Sale Liquor Licenses MOTION: LaValle made motion, seconded by Schletty, to grant an OFF SALE NON-INTOXI- LIQUOR AND CIGARETTE LICENSE. to Shirley Nelson Hill DBA One Potata Trading Post, 12010 Keystone Avenue, in the amount of $27.00. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: McAllister made motion, seconded by Schletty, to grant a CIGARETTE LICENSE to Granger's Inc. , 14797 Forest Boulevard, in the amount of $12.00. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: Schletty made motion, seconded by Vail, to grant an OFF SALE NON-INTOXICATING LIQUOR AND CIGARETTE LICENSE to Nadeau's Star Market, 14583 Forest Blvd. , in the amount of $27.00. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS - No discussion 7.0 UNFINISHED BUSINESS 7.1 City Auditor Councilman Irsfeld had contacted Anfinson, Hendrickson, and they stated that they%. were willing to work with the city to help keep its auditing expenses to a minimum. MOTION: McAllister made motion, seconded by Irsfeld, that the City .of Hugo hire the firm of Anfinson, Hendrickson to audit the city's books. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 8.0 NEW BUSINESS - No discussion December 21 , 1981 9.0 CLERK The clerk presented a new type of billing for use in the utility department. She had contacted Mr. Burkard, and he was satisfied with the new system. MOTION: Irsfeld made motion, seconded by Vail, that the city use the new billing system for the water and sewer department. • Irsfeld withdrew his motion. This matter will be reviewed further and to be placed on the agenda for 1/4/82. MOTION: Schletty made motion, seconded by McAllister, to approve Job Order 48731 for Northwestern Bell. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Vail, to approve Job Order 48738 for Northwestern Bell. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED ENERGY SAVERS Mr. Dennis Johnson had submitted a warranty for 10 years labor and 15 years material. What the city had contracted for was 15 years warranty on labor and materials. MOTION: LaValle made motion, seconded by Schletty, to pay Mr. Dennis Johnson $630.00. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Schletty, that the 5% retainage be held until the city receives a 15 year warranty for labor and materials for the new roof, or appropriate costs are determined as a deduct item for not fulfilling the contract. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 10.0 MISCELLANEOUS Planning Commission member, Vern Peloquin, will not be seeking another term for his present term which expires 12/31/81 . MOTION: McAllister made motion, seconded by Irsfeld, that the clerk's office place a notice in the official newspaper for parties interested in becoming a member of the Planning Commission. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED December 21, 1981 The ad is to be run twice, and matter placed on agenda for '1/18/82.
