PRESENT: LaValle, McAllister, Schletty, Irsfeld, Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of February 1 , 1982, as submitted. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: McAllister made motion, seconded by Vail, to approve the General Claims for February 16, 1982, as submitted. VOTING FOR: LaValle, McAllister, SChletty, Irsfeld, Vail MOTION CARRIED MOTION: Vail made motion, seconded by Irsfeld, to approve the Utility Claims for February 16, 1982, as submitted. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS 6.1 Resolution 1982-1 The Clerk presented RESOLUTION 1982-1 , A RESOLUTION ADOPTING RECORDS RETENTION SCHEDULE. The Council approved of the body of .the proposal, but not the preface. There was discussion as to how the proposal would be best suited for the City of Hugo. MOTION: Irsfeld made motion, seconded by Vail, to adopt RESOLUTION 1982-1 , A RESO- LUTION ADOPTING A RECORDS RETENTION SCHEDULE. Irsfeld withdrew his motion. MOTION: Irsfeld made motion, seconded by Vail, to adopt RESOLUTION 1982-1 , subject to the following: 1 . The first paragraph entitled RECORDS RETENTIONS SCHEDULE ADOPTED, in- cluding Items 1 , 2, and 3, be deleted in its entirety. 2. The second WHEREAS to become paragraph #1 . 3. The first WHEREAS to become paragraph #2. 4. The third WHEREAS, and the remainder of the Resolution, to remain as is. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld,Vail MOTION CARRIED 17 5.0 PETITIONS, REQUESTS, COMMUNICATIONS AND LICENSES 5.1 Lester Schmidt - Minor Subdivision This application:was given approval on January 18, 1982, subject to certain conditions being met within 30 days. As of 2/16/82, all conditions had not been satisfied. Attorney Jim Meyer was present, and stated that the letter from Grace Development's attorney would be forwarded this week. Because of the delay, Mr. Meyer asked to Council to grant an extension for the Minor Subdivision approval. MOTION: Irsfeld made motion, seconded by McAllister, to grant an extension for Lester Schmidt, Minor Subdivision, until March 15, 1982, per the request of the applicant's attorney. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1 NSP Right-of-Way Engineer Kuusisto has submitted a cost estimate for engineering fees, and Mr. Johnson's will be forthcoming. 7.2 Bald Eagle Industrial Park - Preliminary Study (Drainage) Mr. Kuusisto submitted a cost estimate for an overall drainage plan in the Bald Eagle Industrial Park. Attorney Johnson had just received his copy, and did not have time to review the information. MOTION: Irsfeld made motion, seconded by Schletty, that this matter be placed on the agenda for the meeting of 3/15/82. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 9.0 ATTORNEY AND ENGINEER Mr. Johnson had previously submitted his monthly report. Mr. Johnson had been in contact with the factory rep, regarding the warranty for the roof installed by Energy Savers. Mr. Bennett indicated that the manufacturer would not go for a fifteen year warranty on materials at any price. MOTION: Irsfeld made motion, seconded by LaValle, that the City Attorney be directed to draft a letter to the bonding company of the contractor who installed the roof on City Hall, addressing the position that our guarantee has not been fulfilled as provided in the specs of the project. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED The septic system for the Doug. Kruse has not been installed as of this time. Attorney Johnson stated that he will follow-up on correspondence previously submitted regarding the Armon system at 12616 Ingersoll Avenue. 18 February 16, 1982 The attorney reviewed the Capital City Mutual Aid Contract, and found paragraph 10, Hold Harmless, to be ambiguous. MOTION: LaValle made motion, seconded by Irsfeld, that the City Clerk submit the excerpt from Mr. Johnson's letter of 2/2/82, addressing the Hold Harmless clause, to the Mutual Aid Association asking them to give us their in- terpretation of Paragraph 10. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED 10.0 CLERK Jim Husnik, manager of the American Legion, was present to discuss the proposed 2700 sq ft addition to the club. Jim was inquiring as to how many SACS and RECS would be required. LaValle stated that one ( 1 ) SAC and REC would be charged, and the city would monitor the amount of water usage for one year. The property is zoned SFU, and the Legion would need a Special Use Permit to construct the addition. The Planning Commission has the option to hold a public hearing. On Sale The Hugo Lions Club has applied for a/non-intoxicating Malt Liquor License. MOTION: McAllister made motion, seconded by Irsfeld, to grant an ON SALE NON-INTOXI- CATING MALT LIQUOR LICENSE to the Hugo Lions Club for the year 1982. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED MOTION: McAllister made motion, seconded by Irsfeld, that the Hugo Lions Club be allowed to use their ON SALE NON-INTOXICATING MALT LIQUOR LICENSE on June 4, 5, 6, 1982. The Lions Club has been granted exclusive use of the city park for those days, subject to proyding clerk's office with both general liability insurance and insurance under the Minnesota Liquor Liability Act. VOTING FOR: LaValle, McAllister, SChletty, Irsfeld, Vail MOTION CARRIED The City received a letter from Bill DeJarlais, Vice President of the Lions Club, requesting that Mike McAllister make security arrangements for Good Neighbor Days on behalf of the Lions Club. There was discussion as to the number of people expected at the dance and the amount of security required. MOTION: LaValle made motion, seconded by Schletty, that McAllister investigate the matter and present a report to the City Council on security for Good Neighbor Days. LaValle withdrew his motion. MOTION: McAllister made motion, seconded by Vail, that the Council-at-Large be designated as official security and police representative to Washington County Sheriff's Office for Good Neighbor Days. VOTING FOR: McAllister, Schletty, Irsfeld, Vail VOTING AGAINST: LaValle MOTION CARRIED 19 MOTION: McAllister made motion, seconded by LaValle, that the City of Hugo commit itself to reimburse the Hugo Lions Club for 30 hours of additional patrol for full-time, off-duty Washington County Sheriff Deputies, during June 4, 5, and 6, 1982. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED ACTION ALERT A bill amending the municipal planning act to provide that a city may not pro- hibit manufactured homes (mobile homes) is presently being considered by the legislature. MOTION: McAllister made motion, seconded by Irsfeld, that the City Hugo Hu o send a communication to the appropriate parties on S.F. 1677 and H.F. 1738, stating our opposition to the bill. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld Vail MOTION CARRIED The city received a memo from Representative Connie Levi regarding surface water drainage management which is presently being discussed in the House and Senate. MOTION: LaValle made motion, seconded by McAllister, that we respond to Connie Levi's letter stating that the City of Hugo unequivocally opposes S.F. 1451 and 1452. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED VERN PELOQUIN MOTION: LaValle made motion, seconded by McAllister, that a Certificate of Appreciation be sent to Vern Peloquin for his years of service on Hugo's Planning Commission. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED McAllister stated due to budget uncertainty the clerk's office should not attend conf. MOTION: Irsfeld made motion, seconded by McAllister, that the City of Hugo will not participate in the clerk's conference this year. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld, Vail MOTION CARRIED Councilman McAllister stated that he will work with the City Clerk to d©tain specs for city's insurance to advertise for informal solicitation.
