MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
May 3, 1982
The meeting was called to order by acting Mayor, Larry Irsfeld, at 7:02 PM.
PRESENT: McAllister, Irsfeld, Vail
Attorney Johnson was also present.
ABSENT: LaValle, Schletty
3.0 APPROVAL OF MINUTES
MOTION: McAllister made motion, Irsfeld :seconded, to approve the minutes of April 19,
1982, as submitted.

4.0 APPROVAL OF CLAIMS
MOTION: Vail made motion, McAllister seconded, to approve the General Claims for
May 3, 1982, as submitted.

5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES
5.1 Patrick Flynn - Site Plan Approval
Mr. Flynn, 15979 Jeffrey Avenue, would like to construct a 32 x 48 pole barn for his
own storage of agricultural products. The land is zoned Agricultural.
MOTION: McAllister made motion, Irsfeld seconded, to approve the Site Plan for
Patrick Flynn, 15979 Jeffrey Avenue, to construct a 32 x 48 pole barn for
his personal use only.

5.2 Zimco Wood - Special Use Permit (Letter of Credit)
Zimco Wood was to provide the City with a $500 Letter of Credit prior to. the Council
meeting of May 3rd. The clerk's office noted that no contact had been made with a
representative from Zimco, and the financial guarantee had not been submitted.
MOTION: McAllister made motion, Vail seconded, that the Special Use Permit for
Zimco Wood be revoked on the grounds as stated to the permit holder at
the public hearing held April 19, 1982, listed as follows: 1 ) Business no
longer in operation; and 2) The permit holder has not met the conditions
of the permit by keeping the Letter of Credit in effect.

5.3 James Husnik - Husnik Industrial Park
The Planning Commission recommended preliminary plat approval, and felt that
variances should not be required because the buildings were existing prior to
subdivision. Mr. Husnik stated that the driveway for Lot 2 will be made wider
and indicated, as such, on the final plat. Mr. King, Rice Creek Watershed, was
present to answer any questions regarding this matter. There was much dis-
cussion regarding the ponding requirements for Husnik's subdivision. Mr. King
stated that the ideal solution for ponding would be an overall drainage plan in
the park. The ponds are located on public easements, and the Council expressed
concern with possible liability on the city's part, in case of an accidental
drowning. Attorney.:Johnson stated that if the easement was shown on the plat,
rights and duties would be created within the municipality. He felt the pond
could be shown as private. Irsfeld suggested that the City Engineer be con-
tacted, requesting his input on ponding, how much standing water, and the possi-
bility of fencing. Also, shapild there be additional access easement to the pond.
Proof of ownership was determined to be satisfactory by the City Attorney.
Mr. Husnik was directed to contact Kuusisto prior to the meeting of May 17th.
5.4 Bruce Myhre - Status of Special Use Permit
MOTION: Irsfeld made motion, McAllister seconded, to table. this matter until the
meeting of May 17, 1982.

5.5 James Leroux - Renew of Mobile Home Permit
MOTION: McAllister made motion, Vail seconded, to renew the Mobile Home Permit
for James Leroux, 4360 165th Street North, granted under Chapter 40,
Article III, Subdivision D, for a period of 90 days.
VOTING FOR: McAllister, Irsfeld, Vail

5.6 Emanuel Colonna - Renew of Mobile Home Permit
MOTION: McAllister made motion, seconded by Vail, to renew the Mobile Home Permit
for Emanuel Colonna, 4720 170th Street, granted under Chapter 40,
Article III, Subdivision C, for a period of 90 days.
VOTING FOR: McAllister, Irsfeld, Vail

5.7 Leonard Noack - Auto Dismantling License
The trees planted for the purpose of screening the junkyard, have not grown because
of the standing water. He had stated at the Planning Commission meeting, that he
will be planting more trees this fall.
MOTION: McAllister made motion, Irsfeld seconded, to grant an Auto Dismantling
License for a period of one year, to Leonard Noack, .16615 Forest Blvd.
The City Council concurs with the Planning Commission's recommendation
that Mr. Noack make every attempt to replant trees, and look for alternate
methods of screening.

5.8 David Schuman- Vacation of Easement (Public Hearing 8:00 PM)
The public hearing was called to order at 8:00 PM. Barry Stack, land surveyor,
represented Mr. Schuman at the hearing. Robert Waller, 14310 Homestead Avenue,
was present, and stated that he had no objection to vacation of the easement.
The public hearing was adjourned until the meeting of May 17, 1982, at 7:30 PM,
when the City Engineer would be present.

The regular meeting was called back to order at 8:10 PM.
Mr. Glen Crain, 4652 North Frenchman Road, was present to complain about a plugged
culvert resulting in poor drainage to/from his property. Mr. Crain volunteered to
take care of the cleaning of the ditch. Mr. Schletty is to contact Crain regarding
this matter.
ZIMCO WOOD - Special Use Permit
MOTION: McAllister made motion, Irsfeld seconded, a motion amending the previous
Zimco motion that revocation of the Special Use Permit shall not occur
until such time as Zimco Wood reopens its operation, and then only if a
Letter of Credit, in the amount of $500.00, is not received by the city
prior to reopening. The reason for the amendment is the owner has sup-
plied the city with a bond, in the amount of $500, and the city considers
that acceptable and shall be kept current.
McAllister and Irsfeld withdrew their motion.
MOTION: Irsfeld made motion, Vail;seconded, to rescind the motion of 5.2, revoking
the Special Use Permit for Zimco Wood.

MOTION: Irsfeld made motion, McAllister seconded, to amend the Special Use Permit
for Z imc o Wood, retaining the six (6) items as listed on the Special Use
Permit dated September 21 , 1981 , and the addition of Item 7:
7. The city shall accept the bond from Thomas S. Zimmerman, in the amount
of $500.00, as an intermediate security to guarantee suppression of
dust, but at such time as business begins operation, Mr. Zimmerman
will furnish the city with a Letter of Credit, in the amount of
$500.00, in place of the bond.

MOTION: McAllister made motion, Irsfeld seconded, authorizing the Fire Chief to
send three (3) men to the State Fire School, in an amount not to ex-
ceed $300.00.

EMS contract and report at the meeting of May 17, 1982.

novation of dump truck into a tanker on the agenda, under 5. 1 , for

The matter of the new Washington County Contract to be discussed at the Council
meeting of May 17, 1982.
6.6 Clerk
MOTION: McAllister made motion, Irsfeld seconded, authorizing the purchase of
400' of snowfence for a total of $239.60 for installation on city's ball
field. Installation not to be completed until after Good Neighbor Days,
and Hugo Feed Mill to be notified as such.

MOTION: Irsfeld made motion, McAllister. seconded, to hire the Hugo Feed Mill to
spray the city's park for $100.00.

to purchase 50 tons of agri-lime at $7.75/ton for the city's ball fields.

7.0 ORDINANCES AND RESOLUTIONS

HEC FUZZY'S
Mr. Doug Driggs, representing Hec Fuzzy's, was present to discuss reports made by
the State Health Department regarding the establishment. The original $66.00 check
issued to the Health Department had bounced, and Driggs presented a copy of a
cashier's check, in the amount of $66.00, correcting the error. He also presented
a license to goeratate issued by the Health Department. Driggs stated that he has
met all the requirements as listed, and is now in the process of finalizing the
cleaning of the kitchen. Irsfeld requested that Mr. Driggs provide the city with
a copy of the report from the Health Department after they have made their inspection.
8.0 UNFINISHED BUSINESS
8.1 Capitol City Contract
Attorney Johnson has talked with Mr. Rukavina, and they are in the process of re-
vising the original contract. A new version will be forthcoming prior to two (2)
months.
MOTION: Irsfeld made motion, McAllister seconded, that the City Attorney draft
a letter to Mr. Rukavina stating the city's concerns with the proposed
Capitol City Contract.

9.0 NEW BUSINESS
10.0 MISCELLANEOUS
There was an on-site inspection made of the erosion problem on Homestead Drive,
across from the Bill Clark property. Kuusisto suggested that a pipe be installed
on the Gunn property as a permanent solution to the drainage problem. Clark stated
that he will cooperate with Mrs. Gunn.
MOTION: Irsfeld made motion, McAllister seconded, that the clerk's office contact
Dwayne Cardinal and get a strating date for construction of the septic system
on the Kruse property. If a definite date can not be established, the Mayor
is authorized to contact other sewer installers to install thesystem
as approved by the City Engineer.
