PRESENT: LaValle, McAllister, Irsfeld, Vail Also, Attorney Charles Johnson and Engineer Howard Kuusisto ABSENT: Schletty 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, McAllister seconded, to approve the minutes of June 7, 1982, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: McAllister made motion, Irsfeld seconded, to approve the General Claims'for June 21 , 1982, as submitted. All aye. Motion Carried. MOTION: McAllister made motion, Irsfeld seconded, to approve the Utility Claims for June 21 , 1982, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Frank Langer Discussion- on Cost Proposal for 1983 Assessing Mr. Langer, Hugo's assessor, was present to discuss the Council's previous action to pay him $3.45/parcel including mileage for 1983 assessments. Mr. Langer had requested $3.60, and stated that this figure was comparable to payments made by Hugo's surrounding communities. Langer felt that it would be a wise decision to equalize this payment. MOTION: Irsfeld made motion, LaValle seconded, to set the assessor's payment for 1983 Real Estate Assessment at $3.60/parcel including mileage. All aye. Motion Carried. Mr. Langer also noted that he needs to be certified every year in order to perform his assessing duties. LaValle suggested that each municipality should pay for their portion of schooling, yearly, rather. than full payment every 3 to 4 years. This way the city could anticipate an annual cost at budget time. 5.2 First State Bank of Hugo - Release of Letter of Credit The bank has a $2,000 Letter of Credit to the City guaranteeingthat the sidewalk damaged during their recent addition would be repaired. The guarantee will expire August 1 , 1982. 58 June 21, 1982 MOTION: LaValle made motion, Vail seconded, that the First State Bank of Hugo's Letter of Credit, in the amount of $2,000, be released. The terms of the Site Plan Approval have been fulfilled. All aye. Motion Carried. 5.3 Bill Clark - Expiration of Bond The $2500 bond guarantees elevations for the lot where the house is constructed, and not the lot where the fill was removed. A letter had been sent to Mr. Clark requesting an extension for the bond if the erosion control measures, as pre- viously specified, had not been satisfied. As of this date, the City had no response from Mr. Clark. MOTION: LaValle made motion, McAllister seconded, that the Bill Clark erosion control matter be dropped from consideration, because bond does not guarantee erosion control in this matter. All aye. Motion Carried. 5.4 John Norton - Special Use Permit Mr. Norton submitted a new plan for the filling of his lot - Lot 7, Block 1 , Royalhaven Estates. Mr. Norton stated that his financing will expire the end of July, 1982, and would like city approval to fill his lot. Norton stated that it _would take approximately 3,000 square yards of fill to complete the job. The intent is to take the fill from Mr. Norton's lot across the road, but he has not ruled out the possibility of purchasing the gravel commercially. A perc test was submitted for Lot 7, and the proposed septic system will be located on the same lot as the house. Mayor LaValle was not comfortable with the idea of filling another lot on Sunset Lake, and questioned the long-range effects on the lake. Mr. Kuusisto stated that he had no problem with the proposed septic system. If the original system failed, the city would like to dedicate a portion of Mr. Norton's lot lying across the street from the house to insure an alternate site is available. MOTION: Irsfeld made motion, Vail seconded, to approve the Special Use Permit for John Norton to fill Lot 7, Block 1 , Royalhaven Estates, subject to the following: 1 . Approval from Rice Creek Watershed District. 2. Grading plan on Lot 6 for removal of the fill. 3. Approval of the septic system by our engineer, with a guarantee of dedicated alternate sewer site. A Letter of Credit, in an approximate amount of $8,000, be submitted. The exact amount to be determined at a later date. The Letter of Credit is to run two (2) years after the date of installation of the septic system, and shall be extendable' upon request of the City. The retaining wall, in relation to the abutting property, must be addressed and design standards meet with City approval. A Letter of Credit, in an amount to be determined at a later date, be submitted to the City, guaranteeing proper erosion control on Lot 6, if and when dirt is to be removed. 59 June 21 , 1982 John Norton - SUP Fill is to"be be provided as indicated on the preliminary plan. A Letter of Credit,, in an approximate amount of $7,000, shall be given to the City to guarantee that fill, in fact, is placed where indicated, and guarantee erosion control methods be put in place and monitored fora period of time to-be determined. • The Letter of Credit to run two (2) years after the fill has• been applied,. and shall be extendable at the request of the City. • VOTING FOR: LaValle, Irsfeld, Vail VOTING AGAINST: McAllister Motion Carried. Attorney Johnson suggested that Mr.- Norton advise his lending institution that a . portion of Lot 6 could be required as an alternate site in the event the septic system of Lot 7 fails. 5.5. Norman Horton - Auto Dismantling Licenses (2) • Mr. -Horton is requesting two (2) licenses, one. for Hugo Auto ?arts and the other • for property to the north, which will house a new yard- knOwn as Highway 61 . The new leasee was present, and stated that the plans for the yard are not ready as yet, and that he will be moving in a temporary building to be used as an office. There is an existing driveway, and a snowfence will separate the two yards. MOTION: Irsfeld made motion, LaValle seconded, to approve the Amended Special Use Permit for Norman C. Horton with conditions 1 through 9 remaining as is. Condition #10 to. be changed .recognizing the fact that there are• two (2) operations and licenses issued under this Special Use • . Permit. All operations shall conform with all conditions of this permit. All aye. Motion Carried.. MOTION: Irsfeld made•motion, Vail seconded, to approve the two (2) Auto Dismantling Licenses for Norman C. Horton, until June 30, 1983. All aye. Motion Carried. When the second operation starts business, a Site Plan•will need to be approved, and a Mobile Home Permit will be required. Applications will have to be signed by the property owner. 6.0 ORDINANCES AND 'RESOLUTIONS MOTION: McAllister made motion, Irsfeld seconded, to set a public hearing for July 19, 1982, at 8:00 PM, •f or the purpose of condideration of the proposed Ordinance 1986, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" TO PROVIDE REGULATION OF EXTERIOR BUILDING MATERIALS USED ON ACCESSORY BUILDINGS IN SFE AND SFU ZONES. All aye. Motion Carried. 60 June 21 , 1982 Theodora Peltier, Ordinance Committee chairwoman, was present to ask about regulatb ns for the new law regarding manufactured housing. It was determined that a change to the Zoning Ordinance would be required. MOTION: LaValle made motion, Irsfeld seconded, to set a Special Meeting of the City Council for June 30, 1982, at 7:30 PM, for the purpose of discussion of relavent city matters. All aye. Motion Carried. MISCELLANEOUS Gerald Now was present to discuss his complaints against Bruce Myhre. The City has received a letter from Novy's attorney regarding this matter, and our attorney has responded. Noir alleges that Myhre is using his pole barn for com- mercial endeavors, and has submitted evidence to that effect to the City Attorney. MOTION: Irsfeld made motion, McAllister seconded, that Mr. Johnson be authorized to work on the Bruce Myhre matter, along with Gerald Novey, to .obtain the necessary information to proceed with filing of a formal complaint and prosecution. All aye. Motion Carried. 7.0 UNFINISHED BUSINESS 7.1 Purchase of Gravel - Fischer & Schuh Councilman Schletty was not present. 9.0 Attorney and Engineer 9. 1 Cal-Inland -- Report from Kuusisto Mr. Cadwallader has a #10,000 Letter of Credit, in favor of the City, guaranteeing installation of a permanent septic system on his property. It will expire on Allgust 1 , 1982. A report from Earth Science suggests a pressurized mound type system, and Kuusisto recommends a 1250 gallon tank. LaValle made note of a traffic problem created by the semis trying to gain access to the property, and that it appears that fill is being placed on the ponding area. It was suggested that the Council make an onsite inspection of the property prior to the special meeting of June 30th at 6:30 PM and all agreed. Mr. Johnson submitted his monthly report. MOTION: Irsfeld made motion, LaValle seconded, to extend meeting passed 11:00 PM. All aye. Motion Carried. 10.0 CLERK MOTION: LaValle made motion, Irsfeld seconded, to approve the use of the road along the north shore of Bald Eagle Lake by the N.E. YMCA for a footrace on August 28, 1982, between 9:0.0 AM and 10:00 AM, as along as they arrange for adequate policing and traf f ice rerouting with the Sheriff's Office. All aye. Motion Carried June 21 , 1982 61 MOTION: McAllister made motion, Vail seconded, to approve Northwestern Bell's Job Order 48885, for permission to place, construct and thereafter maintain buried telephone cable across Egg Lake Road. All aye. Motion Carried. MISCELLANEOUS Councilman Irsfeld stated that the Building Inspector requested clarification of the city code relating to setbacks for accessory buildings. After discussion, it was determined that doors should not effect the setback requirements, and the code "is what it is" and deeper analyzing is not required.
