PRESENT: LaValle, McAllister, Schletty, Irsfeld, Vail Attorney, Charles Johnson and Engineer Kuusisto 3.0 APPROVAL OF MINUTES MOTION: Schletty made motion, Irsfeld seconded, to approve the minutes of December 6, 1982, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, McAllister seconded, to approve the General Claims for December 20, 1982, as submitted. All aye. Motion Carried. MOTION: Vail made motion, Irsfeld seconded, to approve the Utility Claims for December 20, 1982, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.2 PhiliOburn - Special Use Permit Philip Ogburn, 6310 132nd Street, is proposing the construction of a 32 x 50 addition to their existing building. The land lies in the RRI zone which allows 1200 square feet for accessory buildings. In excess of that would require a Special Use Permit. MOTION: Irsfeld made motion, LaValle seconded, to approve the Special Use Permit for Philip Ogburn, 6 310 132nd Street, for the construction of a 32 x 50 addition to their existing building, as per the submitted plan. Building to be used for personal storage only. All aye. Motion Carried. 5.3 Mike Gibbs - Variance Mike Gibbs, 5748 150th Street, would like to construct a 20 x 32 garage within 2' of the property line. The code requires a setback of 5' . A letter from the effected property owner was submitted stating that there was no problem with.:the variance request. MOTION: Irsfeld made motion, Vail seconded, to approve the Variance of Michael Gibbs, 5748 150th Street, to construct a 20 x 32 garage within 2' of the sideyard property line, as per the submitted site plan. All aye. Motion Carried. 105 December 20, 1982 5.4 Patrick Meehan - Site Plan Approval Mr. Meehan, 12611 Ingersoll Avenue North, would like to construct a 36 x 50 pole barn for his personal use. The land is zoned RRII, which allows 1800 square feet for accessory buildings. MOTION: Vail made motion, Irsfeld seconded, to approve the Site Plan for Patrick Meehan, 12611 Ingersoll Avenue North, for the construction of a 36 x 50 pole building for his personal use, as per the submitted site plan. All aye. Motion Carried. 5.5 Licenses MOTION: Irsfeld made motion, McAllister seconded, to grant a Gambling License to the Hugo Lions Club for the year 1983 with a waiver of the bond require- ment. All aye. Motion Carried. MOTION: Irsfeld made motion, Vaild seconded, to grant a Gambling License to the American Legion Post 620 for the year 1983 with a waiver of the bond re- quirement. All aye. Motion Carried. MOTION: Vail made motion, Irsfeld seconded, to grant a Bingo License to the American Legion Auxiliary Post 620 for the year 1983 with a waiver of the bond requirement. All aye. Motion Carried. MOTION: McAllister made motion, Irsfeld seconded, to grant the following licenses to Jerome C. Grundhofer dba Paul's Pizza, 14849 Forest Boulevard North: ON SALE NON-INTOXICATING LIQUOR AND CIGAKi'rih, in the amount of $112.00. License subject to satisfactory sheriff's report. All aye. Motion Carried. MOTION: Schletty made motion, Vail seconded, to grant a CIGMETIE LICENSE to Granger's Inc. , 14797 Forest Boulevard, in the amount of $12.00. All aye. Motion Carried. MOTION: Vail made motion, Schletty seconded, to grant an OFF SALE NON-INTOXICATING LIQUOR AND CIGARtaTE LICENSE to Nadeau's Star Market, 14583 Forest Blvd. , in the amount of $27.00. All aye. Motion Carried. MOTION: Irsfeld made motion, McAllister seconded, to grant a CLUB ON SALE NON- INTOXICATING LIQUOR LICENSE to Wild Wings of Oneka, 9491 152nd Street, in the amount of $10.00. All aye. Motion Carried. 106 December 20, 1982 MOTION: McAllister made motion, Irsfeld seconded, to grant a bonafide club ON SALE NON- INTOXICATING LIQUOR LICENSE to the Hugo Lions Club for the year 1983. MOTION: McAllister made motion, Irsfeld seconded, to grant an OFF SALE NON-INTOXI- CATING LIQUOR, ON SALE INTOXICATING LIQUOR, ON SALE SUNDAY LIQUOR, CIGA- x a=m AND BILLIARD LICENSE, to Catherine E. Anderson dba Swanny's of Hugo, Inc. , 14559 Forest Boulevard, in the amount of $1732.00. All aye. Motion Carried. MOTION: Irsfeld made motion, Vail seconded, to grant an ON SALE INTOXICATING LIQUOR ON SALE SUNDAY LIQUOR, CIGANETTE AND BILLIARD LICENSE, to Robert Ricci dba Ricci's Saloon, 14777 Forest Boulevard, in the amount of $1717.00. All aye. Motion Carried. MOTION: Schletty made motion, Irsfeld seconded, to grant an ON SALE INTOXICATING LIQUOR, ON SALE SUNDAY LIQUOR AND CIGAxETTE LICENSE to GPR & ERA, INC., DBA BLACKSMITH LOUNGE, 17205 Forest Blvd. , in the amount of $1712.00. All aye. Motion Carried. 6.0 ORDINANCES AND RESOLUTIONS 6.1 Dru9 Paraphenalia Mt. Johnson will be submitting a proposed draft at a later date. 7.0 UNFINISHED BUSINESS 7.1 Delinquent Utility Accounts MOTION: LaValle made motion, Irsfeld seconded, that the delinquent utility accounts be sent notification, along with their fourth quarter billings, that if all bills are not current by February 10, 1983, their service will be discontinued. All aye. Motion Carried. 7.2 Appoint Carole LaBelle Deputy Clerk MOTION: LaValle made motion, Irsfeld seconded, that Carole LaBelle be appointed Deputy Clerk for the City of Hugo. All aye. Motion Carried. 8.0 NEW BUSINESS - No discussion 9.0 ATTORNEY AND ENGINEER Mr. Johnson submitted his monthly report. Mr. Kuusisto stated that a meetingf1s 'was hdayrelative the NSP right-of-way matter. g Y NSP will be submitting a letter to the city stating the conditions that were agreed. upon. 107 December 20, 1982 10.0 CLERK MOTION: McAllister made motion, Vail seconded, that the Clerk be authorized to attend the meeting on January 10, 1983, Mahtom di City Hall, to discuss the possible implementation of the punch card system for future elections. All aye. Motion Carried. MOTION: LaValle made motion, Irsfeld seconded, to approve the Site Plan for Mary Celske, 5311165th Street, to construct a 24 x 26 pole building to be used as a garage and workshop. Approval subject to completion of an application and payment of the appropriate fee. All aye. Motion Carried. The city received a letter from the MWCC regarding their claim that Hugo failed to have an inspection of the connection at the intersection of Falcon Avenue North and 130th Street. Mayor LaValle stated that although he cannot recollect the man's name, he was present at the time the inspection was made. A letter to that effect will be sent to Mr. Harrington's attention. MOTION: Irsfeld made motion, Schletty seconded, that the Mayor be authorized to sign the Capitol City Maintenance Contract for 1983. All aye. Motion Carried. 5.1 James Flannery - Discussion of site plan for 2r posed on sale liquor establishment Mr. Flannery, attorney for Will Harris, was present to discuss the revised site plan .for the construction of an on sale liquor establishment on property previously housing Schmidty's. Mr. Flannery stated. that Mr. Harris would try and utilize the existing septic system. Scott Hubbard, previous owner of Schmidty's, stated that he understood Mr. Richard Schmidt had installed a new system 18 months prior to his ownership. Mayor LaValle informed Mr. Hubbard that the drainf Meld was extended at that time, not an entire new system. LaValle instructed Mr. Flannery to have a perc test taken, and taking into consideration the size of the building and its capacity, have the appropriate septic system installed. Mr. Flannery stated that Will Harris Investment, Inc. , will hold the liquor license and the real estate will be in the name of Wilbur Harris. Attorney Johnson informed Mr. Flannery will then be re- quired to submit a lease agreement. MOTION: McAllister made motion, LaValle seconded, that the City of Hugo will retain one (1) On Sale Intoxicating Liquor License for a period of 90 days, and that Mr. Wilbur Harris as an individual, and Wilbur Harris Investment, Inc. , will have first right to apply for the license. Reservation can be ex- tended at the discretion of the Council provided there is positive pro- gress being made in securing and complying with the conditions of the Special Use Permit for a restaurant, bar, and off sale liquor operation.
