APPROVING PUD GENERAL PLAN FOR DIGNICARE,LLC.FOR PROPERTY
LOCATED SOUTH OF 130TH ST.AND EAST OF FOREST BLVD.(TH 61)
WHEREAS, DigniCare LLC has requested approval of a PUD general plan to allow 32
senior living and memory care units on the 3.34 acre property legally described as
follows:

WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly
called Public Hearing and recommends approval,and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by DigniCare, LLC., subject to the following conditions:
1. A PUD general plan is approved to allow the creation of 32 senior living and memory
care units. The development shall be constructed in accordance with the plans and
application received by the City on August 25, 2015, and revisions received on
September 18,2015 and October 1,2015, except as amended by this resolution.
2. Approval is contingent upon City Council approval of the requested rezoning of the
3.34 acre property.
3. The PUD general plan is approved based on the finding that the proposed project is
consistent with the City's Comprehensive Plan.
4. PUD flexibility is granted to allow:
a. Flexibility to allow senior housing as a land use.
b. Flexibility to allow a density of 9.5,where 3-4 units per acre are allowed.
c. Flexibility to allow a 22 ft. rear yard setback, where 30 ft. is the minimum
allowed by ordinance in the underlying zoning district.
5. The building setbacks for the PUD are as follows:
a. 30 feet front yard setback.
b. 10 feet side yard setback.
c. 22 feet rear yard setback.
6. The applicant must comply with the following, prior to the issuance of a building
permit:

Architectural and Design standards
a. The developer shall submit final site plans, building elevations, street
improvement plans, utility plans, grading and drainage plans, landscaping plans,
lighting and signage plans along with the required land use applications for City
approval.
b. The architectural plans shall meet the requirements outlined in the Multi-Family
Design Guidelines, and shall show that all building elevations receive equal
treatment and visual qualities.
c. The applicant shall submit a design palette for the entire project for City review
and approval. The palette shall include colors for awnings, siding, shakes,
shutters, shingles,brick and stone
Landscaping and Lighting
d. The landscape plans shall be revised to show an improved landscape buffer
between the senior housing facility and the residential homes. The landscaping
shall be of a sufficient height and size to adequately provide a buffer.
e. The grading plans shall be revised to show which existing trees will be preserved
on the property. The applicant shall make every effort to preserve existing trees.
f. Exterior lighting shall be consistent throughout the development. All lighting
shall be shielded to prevent glare and light trespass, as required by Section 90-239
of the ordinance.
Streets,Parking and Utilities
g. The location and geometrics of all driveways and parking areas are subject to
further review by the city staff. The center median within the circle drive shall be
removed from the plans.
h. Construction details of the fire lane and locations of fire hydrants for the senior
housing facility shall be reviewed and approved by staff.
i. An approved access permit and drainage permit for 127th St. off of Forest Blvd.
(TH 61) shall be obtained through MNDOT.
j. The extension of 127th St. shall be reviewed and approved by City staff

k. The stormwater management plan shall be reviewed and approved by the City
Engineer.
1. The 39' right of way along Forest Blvd. (TH 61) shall be dedicated to the City
beginning from 127th St. and extending to the northern most property line,with
legal description subject to be reviewed and approval by staff.
m. The applicant must record the easements, development agreement, etc. at
Washington County. Proof of recording must be provided to the City.
7. Prior to the issuance of a Certificate of Occupancy, the screening of all
mechanical equipment is subject to review and approval by the staff.
8. Prior to installation of any signs, the applicant shall obtain sign permits from the
city.
