APPROVING SITE PLAN FOR DIGNICARE,LLC.ON PROPERTY LOCATED
SOUTH OF 130TH ST.AND EAST OF FOREST BLVD,(TH 61)
WHEREAS, DigniCare, LLC.,has requested approval of a site plan to allow construction
on the 3.34 acre property legally described as follows:
(See Attached)
WHEREAS, the Planning Commission has reviewed the site plan at a duly called Public
Hearing and recommends approval,and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by DigniCare, LLC,for a site plan,subject to the following conditions:
1. A site plan is approved in accordance with the site plan dated September 18,2015 and
October 1,2015, except as amended by this resolution.
2. Approval is contingent upon City Council approval of a rezoning to PUD for the 3.34
acre site.
3. The project is approved for a maximum of 32 senior housing units.
4. A 39 foot wide roadway easement shall be dedicated for the expansion of Forest
Blvd. (TH 61).
5. Prior to the issuance of a building permit, the developer shall submit final site plans,
building elevations, street improvement plans, utility plans, grading and drainage
plans, landscaping plans, lighting and signage plans along with the required land use
applications for the development.
6. Prior to the issuance of a building permit, the developer must comply with the
following conditions:
a. The developer must comply with Resolution 2015-50 for the PUD.
b. The developer must obtain all necessary stormwater management and WCA
permits from the City.
c. The developer shall obtain all necessary local, state,and federal permits.
7. Prior to the issuance of a building permit, the developer must comply with the
following conditions:

a. A development agreement will need to be signed and executed in a form
satisfactory to the City.
b. The City's development fees will apply to this project. The fee amounts will be
calculated and included as part of the Development Agreement.
