HUGO BOARD OF ADJUSTMENTS AND APPEALS
DECEMBER 22, 2005
Chairperson Schumann called the meeting to order at 6:38 p.m.
PRESENT: Brunotte, Schumann
ABSENT: Puleo
ALSO PRESENT: Bryan Bear, Community Development Director (CDD)

Minutes of November 10, 2005
Schumann made motion, Brunotte seconded, to recommend approval of the minutes of November
10, 2005 as submitted.
All Ayes. Motion carried.
Variance for Atkinson for a Side Yard Setback (Peloquin Industrial Park)
The Board considered the application of Dean and Ruby Atkinson, 13452 Goodview Avenue
North, for a variance to permit a 10 foot side yard setback on property owned by them in the
Peloquin Industrial Park. The property is located in the General Industrial Zoning District where
the minimum side yard setback is 40 feet. The parcel is 1.60 acres in size and located on the
north side of 152"d Street in the Peloquin Industrial Park. The applicant requested the 10 foot
side yard setback on the site so a new building or building addition can be constructed on the site
at a later date.
The CDD explained that the lot was 120 feet wide; most industrial lots are generally larger but the
Peloquin Industrial Park was an older park containing smaller lots. He noted that the Commission
and Council recently granted a setback variance for another parcel in the park. To comply with the
setback variance on the Atkinson site would leave only 40 feet for the width of the building.
Schumann asked why the ordinance required a 40 foot setback. And the CDD explained that the
intent was to have separation between buildings but agreed that 80 feet was excessive.
Schumann pointed out that larger buildings provide more tax base and 20 feet between buildings
would leave adequate room for emergency vehicles.
Brunotte made motion, Schumann seconded, to approve the variance and recommend the council
revisit the 40 foot setback requirement in the Industrial District.
