HomeMy WebLinkAbout2006.07.27 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS July 27, 2006 Chairperson Schumann called the meeting to order at 6:31 p.m. PRESENT: Brunotte, Schumann ABSENT: Puleo ALSO PRESENT: Bryan Bear, Community Development Director (CDD) Michele Lindau, Community Development Assistant Minutes of June 8, 2006 Schumann made motion, Brunotte seconded, to recommend approval of the minutes of June 8, 2006 as submitted. All Ayes. Motion carried. Variance for Jeff and Cynthia Stickler for Accessory Building The Board considered the request of Jeff and Cynthia Stickler, 8715 126th Street North, for a variance to construct a 2,300 square foot accessory building closer to the road than the principle structure on property described as Lot 3, Block 2, County View Acres. Hugo City Code states that no accessory building shall be located or protrude in front of the principal building on the site in relation to any public street. The CDD explained that the property was 5.9 acres in size and located on the northwest side of Long Lake. The location of the drainage swale to the southwest of the home and the septic system to the northeast prevented access to an accessory building if it were located behind the home. Both the home and accessory building would be visible from the street but screened by trees from neighboring properties. Georgiann Bartylla, 8675 126th Street North, stated she was an adjacent property owner and had no problem with the variance. Brunotte made motion, Schumann seconded, to approve the variance for 8715 126th Street North, to permit a 2,300 square foot accessory structure to be located closer to the road than the principal structure. Board of Zoning Adjustments Meeting July 27, 2006 - page 2 Variance for Tim and Gemiann Bartylla for Accessory Building The Board considered the request of Tim and Georgiann Bartylla, 8675 126th Street North, to construct an accessory building closer to the road than the principle structure on property described as Lot 2, Block 2, Country View Acres. Hugo City Code states that no accessory building shall be located or protrude in front of the principal building on the site in relation to any public street. The CDD explained the applicant was a neighbor to Jeff and Cynthia Sticker and the variance was similar to that requested by the Sticklers. The property was five acres in size and the applicant had a 400 square accessory building which was setback an equal distance from the road as the home. The applicant wanted to remove this building and replace it with a larger structure. The property was located on the northwest side of Long Lake which was classified as a Natural Environmental Lake. Ordinance required structures to be setback 200 feet from lakes classified as Natural Environmental. The existing home was set back 218 feet from the lake. The applicant would not be able to construct the desired accessory building to the rear of the home to meet the required setback from the lake. In addition, the location of the septic system prevented access to the structure. The Sticklers were present and said they had no objection to the variance. Brunotte made motion, Schumann seconded, to recommend approval of the variance for 8675 126th Street North for an accessory structure to be located closer to the road than the principal structure.
