HomeMy WebLinkAbout2003.05.08 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS May 8, 2003 Chairperson Schumann called the meeting to order at 6:35 p.m. PRESENT: Brunotte, Puleo, Schumann ABSENT: None ALSO PRESENT: John Rask, Community Development Director Michele Lindau, Secretary Minutes April 24, 2003 Puleo made motion, Brunotte seconded, to approve the minutes for April 24, 2003, as submitted. All Ayes. Motion carried. Gressen Variance for Garage The Board considered the request of Greg and Cara Gressen, 8620 126th Street North, for a variance to permit a 13 -foot side yard setback for a garage and living space addition to their home. The addition would provide 598 square feet additional garage space and 952 square feet additional living space. The property consists of 5.4 acres in the Rural Residential Zoning District where the City's Comprehensive Land Use Regulations require that buildings be set back 40 feet from the side lot line. The Community Development Director explained that the existing home was non- conforming because it was located approximately 25.5 feet from the side lot line. At the time the home was constructed, the side yard setback was 20 feet. Because the zoning ordinance permits the expansion of non -conforming buildings provided the expansion does not increase the non -conformity, the applicant could expand the building provided the expansion was no closer than 25.5 feet from the side lot line. It was noted that the garage portion of the addition would extend into the required setback of 25.5 feet and no variance would be needed if the applicant eliminated the garage portion of the addition. Tim and Bonnie Elemes, 8630 126th Street North, said that their home was built in 1985 in the center of their lot, which is located adjacent to the Gressens to the east. The Elemes said they were disappointed when neighbors on both sides built Planning Commission Meeting May 8, 2002 - page 2 their home very close to the lot line, and the orientation of the Gressen's home made the Elemes feel they were encroaching onto the Gressen's property. Elemes did not approve of the variance stating there was no hardship present The Gressens were not present at the meeting. Puleo made motion, Schumann seconded, to table the request until May 22, 2003. All Ayes. Motion carried. Van Klei Variance for Accessory Building The Board considered the request of Lonnie & Deb Van Klei, 12015 Janero Avenue North, for a variance to permit an accessory building with an exterior finish that is inconsistent with the principal structure as required by Hugo City Code Section 1195-030.1, Subd.4. The home is finished with vinyl siding and asphalt shingles and the accessory building would be constructed with a galvanized steel material. The applicant had indicated they would match the color of the siding to the color of the home. Klei explained that he wanted to locate the building within the pasture area and would like to construct the building of galvanized steel material that would not be destroyed by their horses, which have been known to destroy materials other than metal. The Community Development Director pointed out that several properties in the surrounding area have been granted similar variances and trees on the property would screen it from the road and neighboring properties. Puleo made motion, Schumann seconded, to recommend approval of the variance for 12015 Janero Avenue North. All Ayes. Motion carried. Bacchus Homes Variance for Home Setback and Garage Size The Board considered the request of Bacchus Homes, 1201 Arcade Street, Maplewood, for a variance to construct a 1,170 square foot garage where a maximum of 1,000 square feet is permitted by ordinance and a variance for a 31.45 -foot side yard setback where ordinance requires a 40 -foot building. The applicant is requesting the variances for new construction at 12789 Greystone Avenue North (Hidden Hills Development) consisting of 3.49 acres. The Community Development Director explained that the home will be constructed to meet the front setback requirement of 40 feet and will abut the drainage easement in the southeast rear corner. This drainage easement prevents Planning Commission Meeting May 8, 2002 - page 3 the home from being located elsewhere on the lot within a reasonable distance from the road. The front of the home will have the appearance of a standard three -car garage but one stall will be 37 feet deep where a standard garage is approximately 24 feet deep. Puleo made motion, Schumann seconded, to approve the variance for 12789 Greystone Avenue North. All Ayes. Motion carried. Hugo American Legion & Rick's Liquor Variance for Sign The Board considered the request of Hugo American Legion, 5383 140th Street North, and Rick's Liquor, 5441 140th Street North, for approval of variances to allow a: 1) 60 square foot sign, where a maximum of 36 square feet is permitted, 2) 19 - foot side yard setbacks from the north and south lot lines, where 30 feet is required, and 3) to permit a sign that exceeds the height of the building. The Community Development explained that the sign would contain the name of Rick's Liquor and the Hugo American Legion, and would direct traffic to turn on 140th Street. Rick's Liquor and the Hugo American Legion share a driveway access from 140th Street, as well as parking. The Board felt there was a hardship present because of the shape of the lot and elevation of the property on which it would be located. Schumann made motion, Puleo seconded, to recommend approval of the sign variances. All Ayes. Motion carried. Adiournment Puleo made motion, Schumann seconded, to adjourn at 6:47 p.m. All Ayes.
