HomeMy WebLinkAbout2003.05.22 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS May 22, 2003 Chairperson Schumann called the meeting to order at 6:05 p.m. PRESENT: Brunotte, Schumann ABSENT: Puleo ALSO PRESENT: John Rask, Community Development Director Michele Lindau, Secretary Minutes May 8, 2003 Schumann made motion, Brunotte seconded, to approve the minutes for May 8, 2003 as submitted. All Ayes. Motion carried. Gressen Variance The Board considered the application of Greg and Cara Gressen, 8620 126th Street North, for a variance to permit a 13 -foot side yard setback for the construction of a 1,550 square foot addition. The addition would provide 598 square feet additional garage space and 952 square feet additional living space. The property consists of 5.4 acres in the Rural Residential Zoning District where the City's Comprehensive Land Use Regulations require that buildings be set back 40 feet from the side lot line. At the Board of Zoning Adjustments meeting on May 8, 2003, the Board tabled action on this request. The Board had questions for the applicant who was not present. Tim and Bonnie Elemes, 8650126th Street North, stated that they wished to maintain the space between their homes and did not approve of the garage addition. Schumann said he had no problem with granting the variance in light of the fact that the City was considering amending the ordinance to permit a 20 foot side yard setback, which was the setback prior to the ordinance change in 1999. Brunotte said he was not in favor because they would be encroaching into the setback Board of Zoning Adjustments Meeting May 22, 2003- page 2 by more than 20 feet. Schumann made motion, Brunotte seconded, to forward the request to the City Council without a recommendation. All Ayes. Motion carried. Bahm Variance for Accessory Building The Board considered the request of Raymond Bahm, 6310 132nd Street North, for variances to exceed the maximum size permitted for an accessory building, and to permit an accessory building with an exterior finish that is inconsistent with the principal structure located on the property. In addition to the 1,950 square foot accessory building already located on the property, Bahm was requesting to construct another 2,160 square foot accessory building, where zoning ordinance permits two accessory buildings not to exceed a combined size of 2,300 square feet on parcels of five acres in size. The applicant also requested a variance to permit a brown metal siding exterior where the home has a brown wood exterior. The existing building on the property has a yellow metal exterior and the applicant indicated that he would be painting it brown to match the house and existing building. The City had received two letters via email from neighboring property owners asking the City to deny the request due to concerns over the appearance of the property. The applicant, Ray Bahm, explained that the existing building was full of cars and he had no place to work on them. It was noted that the City had received complaints and had sent Bahm letters asking him to clean up his property. Schumann said he felt that the request was reasonable and would allow him to have a place to work on his hobby as well as clean up his property. Brunotte said he did not approve of it because the ordinance did not allow it. Brunotte made motion to deny the variance because there was no hardship and the variance far exceeded the maximum permitted. Motion died for lack of a seconded. Schumann made motion, Brunotte seconded, to forward the request to the City Council without a recommendation. All Ayes. Motion carried. Board of Zoning Adjustments Meeting May 22, 2003- page 3 Wilson Variance for Accessory Building The Board considered the request of Max and Cheryl Wilson, 14880 Homestead Avenue North, for a variance to permit a 20 -foot side yard setback for the construction of a 1,200 square foot accessory, where a 40 -foot setback is required by ordinance. The applicant, Max Wilson, explained that because of the existing wetlands and rolling hills, there was no other place to locate the building without encroaching upon the hayfields. Brunotte made motion, Schumann seconded, to recommend approval of the variance for Max and Cheryl Wilson. All Ayes. Motion carried. Sullivan Variance for Oversized Garage The Board considered the request of John and Susanne Sullivan, 9079 170th Street North, for a variance to construct a 1,115 square foot attached garage for construction of a new home. The applicant, John Sullivan, explained he was constructing the home to follow an existing ridgeline and that the design of the garage and home created a larger garage area without giving the appearance of an oversized garage. He said that the home was set back a good distance from the street and was well screened. Brunotte made motion, Schumann seconded, to recommend approval of the variance for John and Susanne Sullivan. All Ayes. Motion carried. Shimota Variance for Oversized Accessory Building The Board considered the request of Leonard and Rita Shimota, 9824 140th Street North, for variances to exceed the maximum size permitted for an accessory building, and permit an accessory building with an exterior finish that is inconsistent with the principal structure. The applicant would like to construct a 40'X60' accessory building where ordinance allows a maximum of three accessory buildings with a combined size of 3,600 square feet in the agricultural zoning district. The applicant currently has four accessory buildings totaling 3,700 square feet and would like a variance to allow the construction of an additional 2,400 square foot building. The applicant is also requesting to finish the home with red steel siding where the home has brick siding. Board of Zoning Adjustments Meeting May 22, 2003- page 4 The Community Development Director explained that the existing accessory buildings were built in the 1880's and were very well maintained. The proposed building would also match the color the existing accessory buildings. The applicant also proposed to construct a custom fagade on the front of the building that faces 140th Street North. This would resemble the exterior of the other accessory buildings on the property. The applicant Len Shimota explained that he needed more storage space and wanted to maintain the historical buildings on the site. Shimota said that he had vintage cars he did not want to leave outside, and that the existing buildings were not set up for the storage of them. He added that most of the building would not be visible from the street. Schumann made motion, Brunotte seconded, to recommend approval of the variance for Len and Rita Shimota. All Ayes.
