HUGO BOARD OF ADJUSTMENTS AND APPEALS
August 28, 2003
Chairperson Schumann called the meeting to order at 6:32 p.m.

Minutes July 10, 2003
Brunotte made motion, Schumann seconded, to approve the minutes of July 10,
2003 as submitted.
All Ayes. Motion carried.
Gallagher Variance for Accessory Building
The Board considered the request of Tomas and Peggy Gallagher, 10009 122nd
Street North, for a variance to exceed the maximum size permitted for an
accessory building on their five acre parcel. The applicant requested to build a
3,744 square foot pole building where the maximum permitted by ordinance is
2,300 square feet in a Rural Residential district.
Staff found that the building would be constructed to the rear of the property and
would be buffered from other properties.
Mr. Gallagher said he felt the 2,300 square foot maximum was too restrictive and
would not allow him to properly store items owned by him and his large family.
Gallagher stated that the other accessory building on the property would be
destroyed.
Brunotte made motion, Schumann seconded, to recommend approval of the
variance for 10009 122nd Street North.
All Ayes. Motion carried.

Ecker Variances for Property Line Adiustment
The Baord considered the request of Mary Ecker, 10264 122nd St. North, for a
variance from the minimum lot size requirement and a variance from the
minimum lot width requirement to allow a property line adjustment for properties
located at 10264 and 10284 122nd Street North, as well as vacant properties to the
west (immediately east of Withrow School). The applicant currently has eight
lots, approximately'/4 acre each, and is requesting approval to consolidate and
adjust the common lot lines to create three lots.
The CD Director explained that the property was platted circa 1950 as Zahlers
Acres consisting of ten 1/4 acre lots and two streets to be known as Edward Road
and Zahler Road, which were never constructed. In August 2002, Ecker requested
and was granted a vacation of both road easements. The two eastern lots, Lots 1
and 10, are now owned by US West, Inc. The remaining lots are owned by the
applicant. There are two homes located on the site. One home is located on
combined Lots 3 and 8 and the other is located on Lots 2 and 9. As proposed, the
existing homes would be on Lot B and Lot C, and Lot A would be a new home
site for a family member. An easement would be necessary to provide Lots B and
C the common use of the existing driveway.
Brunotte made motion, Schumann seconded, to recommend approval of the
variances as requested by Mary Ecker.
All Ayes. Motion carried.
