HUGO BOARD OF ADJUSTMENTS AND APPEALS
NOVEMBER 13, 2003
Chairperson Schumann called the meeting to order at 6:30 p.m.
PRESENT: Brunotte, Puleo, Schumann
ABSENT: None
ALSO PRESENT: John Rask, Community Development Director

Minutes August 28, 2003
Brunotte made motion, Schumann seconded, to approve the minutes of August 28, 2003 as
submitted.

Stockness Variance for Accessory Building
The Planning Commission considered the application of Tim Stockness, 9757 122nd Street North,
for a variance to construct an accessory building closer to the road than the principal structure.
The accessory building would be approximately 1,860 square feet in size and would be set back
892 feet from the front property line and 20 feet from the side property line.
The Community Development Director explained that the applicant had initially requested
another variance to allow the existing dog kennel to remain within the 10 -foot required side yard
setback for kennels, but the applicant withdrew that portion of the request and will be relocating
the kennel to meet the required setback.
Mark Tregilgas, 2565 Lake Avenue, White Bear Lake, said that his parents own the vacant lot to
the west of the site. Tregilgas had written a letter to the Community Development Director and
was at the meeting to express his concern over the value of his parent's property being affected
by the location and size of the building that Stockness referred to as the dog kennel. Tregilgas
said he felt Stockness was well aware of the setback requirement when he constructed the kennel
building.
Schumann made motion, Puleo seconded, to recommend approval of the variance to locate the
accessory building closer to the road than the principle structure subject to the kennel being

relocated to meet the 20 foot setback for accessory buildings prior to a building permit being
issued for the new building.
Tregilgas provided pictures to the Board of the kennel/building and questioned what exactly was
required to be moved since the setback for kennels was only 10 feet and the setback for buildings
was 20 feet.
The Community Development Director explained that the Building Inspector had been out to the
property and had confirmed that a new slab was poured for the relocation of the building but did
not know if it was large enough to accommodate the whole building/kennel or just a portion of it.
Stockness was not present at the meeting.
The motion and seconded were withdrawn.
Schumann made motion, Puleo seconded, to table the request to allow time for staff to determine
exactly what Stockness was proposing to do.
All Ayes. Motion carried.
Anderson Variance for Home
The Board considered the request of Craig and Chris Anderson for a variance to permit a home to
be located within the 200 foot setback from an unnamed lake on property located at 15550
Jeffery Avenue North, Lot 1 Block 1, Anderson Hills.
The applicant would like to construct a new home 151 feet from the Ordinary High Water
(OHW) from an unnamed lake. Hugo City Code, Chapter 320, Section 1155-020 requires a 200
foot setback. The home would comply with the DNR setback requirement of 100 feet. The
lowest floor elevation of the home would be 12' above the 100 year flood elevation.
Puleo made motion, Brunotte seconded, to recommended approval of the variance for 15550
Jeffery Avenue North.
