PRESENT: Brunotte, Puleo, Schumann ABSENT: None ALSO PRESENT: Bryan Bear, Community Development Director (CDD) Michele Lindau, Community Development Assistant Minutes April 14, 2005 Brunotte made motion, Schumann seconded, to recommend approval of the minutes of April 14, 2005 as submitted. All Ayes. Motion carried. Variance for Robert and Barbara Schauer for Oversized Garage The Board considered the application of Robert and Barbara Schauer for an oversized attached garage on new construction at 4960 126th Street North (Bald Eagle Estates). The applicant was requesting to construct a 1,200 square foot garage where 1000 square feet was the maximum permitted by ordinance. The property is located in the Large Lot Residential Zoning District (R- 1) and consists of 1.2 acres. The CDD explained that several variances had been issued for oversized garages within the development prior to an ordinance amendment in 1992 when the maximum garage size was changed from 720 square feet to 1000 square feet. Since 2002, two variances had been issued for garages to exceed 1000 square feet. He pointed out that he applicant was allowed by ordinance to construct an 870 square feet of accessory storage in the R-1 Zoning District. Schumann opened the public hearing. There were no comments and Schumann closed the public hearing. Puleo pointed out that the applicant was unable to construct a basement because of the high water table so they would not have that area for storage. Puleo referred to a letter from a resident at 4950126 th Street North stating they had no objection to the granting of the variance. Puleo suggested that if the variance was granted, a condition could be added that the allowed amount of accessory storage be reduced to less than 870 square feet. Since the garage entrance would be facing the neighboring property and not the street, he also felt the portion facing the street should Board of Zoning Adjustments Meeting April 14, 2005 - page 2 have windows and siding that matched that of the home. Schumann said that variances had been granted in the past with the condition that no storage sheds be allow on the lot. He also said that he would rather allow an increase in the garage size than see a building constructed further back on the property into the wetland area. Brunotte said that with no basement the applicant would need more storage area and he would be okay with approving the variance with the condition that the applicant be limited to a smaller amount of accessory storage. The applicant Robert Schauer, 1827 Clarence Street, White Bear Lake, said he would agree to being limited in the amount of permitted accessory storage. Schumann made motion, Brunotte seconded, to approve the variance for a 1,200 square foot garage with the condition that the allowable accessory storage be reduced from 870 to 260 square feet and the exterior facing the street be compatible with the house.
