HomeMy WebLinkAbout2004.06.01 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS JUNE 10, 2004 Chairperson Schumann called the meeting to order at 6:33 p.m. PRESENT: Brunotte, Puleo, Schumann ABSENT: None ALSO PRESENT: Bryan Bear, Community Development Director Michele Lindau, Secretary Minutes March 27, 2004 Puleo made motion, Schumann seconded, to recommend approval of the minutes of March 27, 2004 as submitted. All Ayes. Motion carried. MacCornack Variance for Accessory Building Location The Board considered the application of Robert and Sherrylee MacCornack, 9514 122nd Street North, for a variance from Hugo city Code, Chapter 32, Section 1195-030 which states that no buildings shall be located closer to the road than the principal structure. The applicant is building a new home on their 6.5 acre parcel that will be behind the existing home and accessory buildings. Once the new home is built the existing home would be removed but the applicant would like to keep the accessory buildings. Puleo asked the applicant why he was not constructing the new home in the same location as the existing home. The applicant replied that the existing house had a ceramic block foundation that was crumbling and they intended to live in the home until the new house was built. The Fire Department would then use it for fire training purposes and the hole would be filled once the house was burned. Puleo made motion, Brunotte seconded, to recommend approval of the variance for 9514 122 d Street North as applied for. All Ayes. Motion carried. Board of Zoning Adjustments Meeting June 10, 2004 - page 2 Palecek Variance for Accessory Building Exterior The Board considered the application for John and Marie Palecek, 12506 Irish Avenue North, for a variance to permit an accessory building with an exterior finish that is different than the principal building. The property is located in the Rural Residential Zoning District on five acres. In addition to the home, there was an existing 864 square foot accessory building located on the property finished with vertical steel siding similar to the color of the home, which is horizontal lap siding, beige in color. The applicant would like to construct an accessory building that would be the similar in color to the house and existing accessory building. When staff inspected the property it was noted that there were several porta-potties on the site. Hugo City code does not permit this type of exterior storage and recommended the property be brought into compliance prior to the issuance of a building permit. The CDD explained that if the exterior storage was part of a home occupation, the applicant could apply for a conditional use permit to allow the items to be stored inside the accessory building provided that all other conditions were met. John Palecek, the applicant, said he was the owner of Smilies Sewer Service and currently had 14 porta-potties stored on his property. He indicated he would remove them prior to applying for a building permit and would be applying for a conditional use permit to allow them to be stored in the proposed accessory building. Puleo made motion, Schumann seconded, to recommend approval of the variance for 12506 Irish Avenue North with the condition the exterior storage is removed prior to the issuance of the building permit. All Ayes. Motion carried. Miscellaneous Discussion The CDD and Board discussed the interpretation of City Code Chapter 320, Section 1195-0.30, Subd. 4, which requires that accessory buildings resemble the principal building on the lot. The Board agreed that it was difficult to construct an accessory building that complied with this requirement. The CDD asked how they felt about allowing City staff a greater degree of discretion on these types of applications. Schumann pointed out that problems could arise because residents had been required to obtain a variance in the past and felt the City needed to provide an explanation on the range of discretion. Puleo asked that they be informed by staff when items that would have gone to the Board in the Board of Zoning Adjustments Meeting June 10, 2004 - page 3 past are approved administratively. The CDD will prepare a memo to the Commission on how the Board has been reviewing these types of variances. Adjournment Puleo made motion, Schumann seconded, to adjourn at 7:05 p.m. All Ayes.
