HomeMy WebLinkAbout2004.10.14 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS OCTOBER 14, 2004 Chairperson Schumann called the meeting to order at 6:37 p.m. PRESENT: Brunotte, Schumann ABSENT: Puleo ALSO PRESENT: Bryan Bear, Community Development Director (CDD) Michele Lindau, Secretary Minutes September 9, 2004 Schumann made motion, Brunotte seconded, to recommend approval of the minutes of September 9, 2004 as submitted. All Ayes. Motion carried. Hankee Variance for Garage The Board considered the application of Diane and Mike Hankee, 5995 138th Street North, for a variance to allow an attached garage to be constructed eight feet from the side property line where ten feet is required by ordinance. The CDD explained that the applicant had an existing attached two -car garage on an 80 -foot wide lot. The applicant was requesting to add a third stall to the garage. The existing house is setback 21 feet from the east property line. The 13 -foot wide garage addition would reduce the side setback to eight feet where ten feet is required. The Board had received a letter from the adjacent property owner stating their concerns about the drainage onto their property. Mike Hankee, applicant, stated that he had spoke to their neighbor and was aware of their concerns. Hankee pointed out that the structure would not be encroaching into the drainage easement. Hankee said the addition would be for the storage of a boat but would like to construct it big enough to accommodate a car. Diane Hankee, applicant, said the existing garage was constructed with two feet between the edge of the home and the garage door, and would like to put two feet on the other side as well to keep it proportional. She said she would not be setting precedence because other homes in the Board of Zoning Adjustments Meeting October 14, 2004 - page 2 development were placed on the lots differently. She said she felt it was more practical to build a standard size garage. Chair Schumann pointed out that even with the addition, they would still be under the 1,000 square feet allowed for garages in the residential district. He said there are issues because houses are placed on properties without considering additions and decks. Schumann made motion to recommend approval of the variance for Hankee. Motion died for lack of second and will be forwarded to the City Council without a recommendation. Anderson Variances for Accessory Buildings The applicant had informed staff that he wished to change his application. Staff will need to re - notice the adjacent property owners. Schumann made motion, Brunotte seconded, to table the request. All Ayes. Motion carried. Adjournment Schumann made motion, Brunotte seconded, to adjourn at 7:07 p.m. All Ayes. Motion carried.
