HUGO BOARD OF ADJUSTMENTS AND APPEALS
FEBRUARY 8, 2007
Chairperson Schumann called the meeting to order at 6:30 p.m.

Brunotte made motion, Schumann seconded, to recommend approval of the minutes of December
14, 2006 as submitted.
All Ayes. Motion carried.
Variance for Gussett Design (Rick Burr)
The Board of Zoning considered the application of Rick Burr, owner of Gusset Design, 15587
Forest Boulevard North, for two variances to permit construction of a 12,060 square foot
addition to an existing 5,740 square foot building used for office, warehousing, and
manufacturing. The addition would be used to warehouse equipment utilized by the business
and would provide storage for materials currently stored outside.
The Associate Planner explained one variance was from the side yard set back requirement to
allow the addition of the building to be one foot from the property line where thirty feet is
required, and the other variance was from the commercial/industrial construction standards to
build an addition with metal panels, which is prohibited by the ordinance. The applicant also
requested a concept plan review.
The current use is a legal non -conforming use. The property is zoned General Business (C-2) and
the use is industrial. In order to build the addition, the applicant would have to apply for a
conditional use permit to expand the legal non -conforming use during the site plan review and
must comply with the related performance standards.
An addition had been constructed in 1992 and a variance was granted to allow the building to be
three feet from the property line where the industrial zoning at that time required a 10 -foot
setback. The building was constructed at a slight angle, and to build an addition at the same
sight line, the setback would be 2'8" to 1'1" from the south property line.

The Associate Planner explained that the ordinance required building exteriors be architecturally
enhanced concrete panel, architecturally enhanced masonry block, masonry with block, masonry
with exterior insulation and finish system (EIFS), brick, dressed stoned or glass. The applicant
was requesting to match the existing building which is constructed of metal panels with some
brick.
Brunotte questioned the water run-off with the building so close to the property line and whether
it would cause water on the adjacent property.
The Associate Planner pointed out the infiltration area in the back and said it should be adequate
but the engineer would need specific calculations. The elevations did not show gutters on the
building.
Schumann opened the public hearing.
Mark Erickson, 15685 Foxhill Ave. N., explained that the back of his property faced Gusset
Design and asked if they operated 24 hours or when the late shift ended.
Burr, the property owner, said he ran one shift; not 24 hours.
Erickson said he could hear banging of metal, voices, garage doors opening and closing, and
forklifts backing up. He was not sure if all the noises were from Gusset Design or from NRI.
He agreed that sound traveled further at night.
There were no other comments, and Schumann closed the public hearing.
Schumann asked if there was any improper use on the property. The Associate Planner
explained it was a legal non -conforming use and he could continue the use there.
Burr said the last shift ended at 4:00 and none of his fork trucks have backup or beepers or
flashing light. Most of the noise is likely from the Peloquin Industrial Park. He had not had a
night shift for about four years, and the doors were opened and closed during the day.
Brunotte asked about fencing.
Burr said he would be changing the fencing along the north to relocate it on the property line and
said he would not have soffits but would have a gutter system on the roof.
Schumann made motion, Brunotte seconded, to recommend approval of the variances for Gusset
Design at 15587 Forest Boulevard North.
