HomeMy WebLinkAbout2004.09.09 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS SEPTEMBER 9, 2004 Chairperson Schumann called the meeting to order at 6:37 p.m. PRESENT: Puleo, Schumann ABSENT: Brunotte ALSO PRESENT: Bryan Bear, Community Development Director Michele Lindau, Secretary Minutes June 10, 2004 Puleo made motion, Schumann seconded, to recommend approval of the minutes of June 10, 2004 as submitted. All Ayes. Motion carried. Graphic Homes for Variances for Driveways in Oneka Ponds The Board considered the application of Graphic Homes, North Branch, for variances for three driveways located at 15360, 15340, and 15352 Goodview Trail North, legally described as lots 6, 7, and 8, of the Oneka Ponds Development. The driveways had already been constructed at a width of 32 feet to match the width of the garages. Hugo City Code, Chapter 320, Section 1195- 220.1 limits the width of driveways in the residential districts to 24 feet as measured at the front setback line. The applicant had submitted a letter that stated they would reconstruct the driveways to conform to City Code should the variances be denied. In the past, the City had interpreted the code to require the width to be measured at the right-of- way line and had permitted driveways to widen beyond that point. The Board agreed on this interpretation since homes were being constructed with three -car garages at the front setback line. To enforce the ordinance as written would not allow driveway access to the entire garage. Puleo recalled when the ordinance had been amended three or four years ago, the issue of driveway widths had been thoroughly discussed. He said he saw no reason to change it and to approve the variance would be setting precedence. Schumann made motion, Puleo seconded, to recommend denial of all three variances for Graphic Homes.
