HUGO BOARD OF ADJUSTMENTS AND APPEALS
MAY 10, 2007
Chairperson Schumann called the meeting to order at 6:30 p.m.

Brunotte made motion, Schumann seconded, to recommend approval of the minutes of December
14, 2006 as submitted.
All Ayes. Motion carried.
Hill Variance for Deck
The Board considered the request of Paul and Angela Hill, 5713 128th Street North for a variance
for a front yard setback to construct a 12' X 24' wrap around deck on their home. The structure
would be located 18 feet from the front property line where a 30 foot setback was required by
ordinance. The property is a corner lot which results in having two front yards on the north and
the west side of the property. There is a deck door on the west side of the house and the applicant
would like to utilize the door for access to the deck. The house was built in 2001 and was
purchased by the applicant in 2006.
Brunotte recalled staff was now following the practice of verifying during plan review that all
future decks met the required setbacks.
Schumann noted that some setbacks had changed since certain homes were constructed.
Schumann opened the public hearing. Other than the applicant, no one was present who wished
to speak on the request.
Brunotte made motion, Schumann seconded, to recommend approval of the variance for 5713
128th Street North for a front yard setback.
All Ayes. Motion carried.

Strub/Kruse Variance for Property Line Adiustment
The Board considered the request of David and Jane Strub, 12670 Ingersoll Avenue North and
Doug and Judith Kruse, 12616 Ingersoll Avenue North, for a variance from the Rural Residential
lot size and width requirements to allow a property line adjustment of the common lot line
between their properties. The applicants were requesting to move the lot line 20 feet to the
south. Hugo Zoning Code, Chapter 320, states that if a property line adjustment causes either
property to remain or become out of compliance with the ordinance, a variance would be
necessary. Both properties would remain out of compliance with the zoning ordinance, which
requires a minimum parcel size of 10 acres and 300 feet road frontage. The lots are located on
the eastern shore of Sunset Lake. The lot line adjustment would result in the Strub property
being approximately 8,500 with 100 feet of road frontage, and the Kruse property approximately
3,800 square feet with 50 feet of road frontage.
The Associate Planner explained the properties were platted as Sunset Park in 1956 with 29 lots
along the east side of sunset lake and most of the lots are less than one acre. The lots became out
of compliance with the zoning ordinance when the 10 acre lot size and 300 foot road frontage
requirement was adopted. Therefore, because the lots would remain out of compliance, a
variance was necessary.
Schumann asked if making the one lot slightly smaller would have any effect on the septic
system.
Kruse stated it would not.
Schumann opened the public hearing. Other than the applicant, there was no one present who
wished to speak on the request. Schumann closed the public hearing.
Schumann made motion, Brunotte seconded, to recommend approval of the variances for 12670
and 12616 Ingersoll Avenue North.
