HomeMy WebLinkAbout2007.07.12 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS July 12, 2007 Chairperson Schumann called the meeting to order at 6:30 p.m. PRESENT: Petryk, Schumann ABSENT: Puleo ALSO PRESENT: Bryan Bear, Community Development Director (CDD) Rachel Simone, Associate Planner Michele Lindau, Community Development Assistant Minutes of June 14, 2007 Schumann made motion, Petryk seconded, to recommend approval of the minutes for June 14, 2007 as submitted. All Ayes. Motion carried. Stodola Variance for Setback for Garage Addition The Board considered the application of Laura and James Stoloda, 12757 Homestead Drive North, for a variance for a side yard setback for a garage addition. The applicant was requesting to construct a 628 square foot garage addition to be located 17 feet - 9 inches from the side property line where 20 feet is required by ordinance. The Associate Planner explained the applicant would be demolishing a portion of the existing garage and constructing the 628 square foot addition, making the total square foot of the building 996. The applicant wanted to keep the addition in line with the existing garage, which was requiring a variance to encroach 2 feet — 3 inches into the setback. Staff felt it was a questionable hardship. Schumann opened the public hearing. Jim Stodola, the applicant, explained their lot was not the typical Rural Residential sized lot, and he was restricted by the lake and the well and septic. He said he could build a free standing garage but it would require trees and shrubs to be removed. Petryk asked about the truss size and said sometimes changing the size of the standard truss resulted in a non -typical design. She said the area was restricted because it was only one acre. She noted there were two letters written by adjacent property owner stating they were in favor of the variance. Board of Zoning Adjustments Meeting July 12, 2007 - page 2 Schumann said staff was correct in making the judgment that it was a self created hardship, and he considered the minimum nature of the encroachment. Petryk made motion, Schumann seconded, to recommend approval of the variance request for 12757 Homestead Drive North. All ayes. Motion carried.
