HomeMy WebLinkAbout2005.07.14 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS JULY 14, 2005 Chairperson Schumann called the meeting to order at 6:32 p.m. PRESENT: Puleo, Schumann ABSENT: Brunotte ALSO PRESENT: Bryan Bear, Community Development Director (CDD) Michele Lindau, Community Development Assistant Minutes June 23, 2005 Puleo made motion, Schumann seconded, to recommend approval of the minutes of June 23, 2005 as submitted. All Ayes. Motion carried. Variance for Deck at 13540 Fiona Avenue North (Falk) The Board considered the request of Jason and April Falk for a variance to construct a porch and deck on their home located at 13540 Fiona Avenue North (Country Ponds). The CDD explained that the applicants were requesting a variance for a front yard setback for construction of an 8' X 14' deck and a 21' X 14' porch addition on their home at 13540 Fiona Avenue North. The structure would be located 17 feet from the front property line. The property is located at the northwest corner of Fiona Avenue North and Fiona Circle North. The property fronts on both streets and ordinance requires a thirty foot front yard setback for buildings in the R-3 Zoning District. Schumann opened the public hearing. There was no one there who wished to speak on the request. Schumann closed the public hearing. The Commission found that the proposal met all the standards necessary to approve a variance for a side yard setback. Puleo noted that it was consistent with what had been approved in the past. Puleo made motion, Schuman seconded, to recommend approval of a variance to locate a deck and porch 17 feet from the front property line at 13540 Fiona Avenue North. All Ayes. Motion carried. Board of Zoning Adjustments Meeting July 14, 2005 - page 2 Variance for a Garage at 6651 1451h Circle North (Murphy) The Board considered the request of Mark Murphy and Heidi Fessler, 6651 145th Circle North, for a variances to construct a garage on property located at 6651 145th Circle North (Diamond Point East). The CDD explained that the applicant was requesting approval of three variances to construct the garage. The applicant would like to construct a 1,340 square foot garage where ordinance limits the size of a garage to 1,000 square feet. Another variance was requested for the location of the garage. The applicant would like to locate the structure in front of the home where ordinance requires accessory structures to be located further from the road than the principal structure. The third variance was from the setback requirement. He applicant would like to construct the garage six feet from the side property line where ordinance requires a ten foot side yard setback. The parcel is part of the Diamond Point East development. The home located on the parcel existed prior to the platting of the property. The existing garage on the property encroaches on the east property line and is intended to be removed. The applicant had informed staff that they were working on a property line adjustment which would eliminate the need for a setback variance. The applicant withdrew the application and would be submitting a revised application. Schumann opened the public hearing. Other than the applicant, there was no one present who wished to speak on the request. Schumann closed the public hearing. The application will be on the agenda for the next meeting.
