HomeMy WebLinkAbout2003.03.13 BOZA MinutesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS March 13, 2003 Chairperson Schumann called the meeting to order at 6:35 p.m. PRESENT: Puleo, Schumann ABSENT: Brunotte ALSO PRESENT: John Rask, Community Development Director Michele Lindau, Secretary Minutes January 23, 2003 Schumann made motion, Puleo seconded, to approve the minutes for January 23, 2003. Ayes: Schumann Abstain: Puleo Motion carried. Stockness Variance for Property Line Adiustment The Board considered the request of Tim Stockness, 9757 122nd Street North, for variances to permit adjustment of the common lot line between the Stockness property and property located at 9627 122nd Street North owned by the Wlaschin family estate. To permit the requested property line adjustment, a variance from the 10 -acre minimum lot size requirement was needed for the parcel at 9627122 d Street N. and a variance from the 300 feet minimum lot width requirement was needed for the parcel located at 9757 122nd Street N. The parcel at 9575 122nd Street N. was 7.63 acres with a lot width of 220 feet and the parcel at 9627 122nd Street N. was 9.07 acres with a lot width of 330.2 feet. After the property line adjustment, the parcel at 9627 122nd Street would be reduced to 2.8 acres and the parcel at 9757 122nd Street N. would be increased to 13.9 acres, bringing it into compliance with the minimum lot size requirement. The lot width of both parcels would remain the same. The applicant wanted to acquire the rear portion of the adjacent lot, which is immediately west of his existing home, to ensure he maintains the privacy of his home in the future. Schumann asked if there were horses on the property and Mr. Stockness replied that there were horses several years ago. Puleo asked why not create a 5 -acre parcel instead of a 2.8 -acre parcel since 5 acres would permit Board of Zoning Meeting March 13, 2003- page 2 horses. Stockness said he wanted to keep the other parcel as large as possible for the purpose of farming. Puleo added that he felt not every parcel in Hugo needed to be able to accommodate horses. Puleo and Schumann agreed that the owner of a smaller parcel could possibly lease neighboring land to allow them to have horses. Schumann noted there would be no more nonconformity created that what existed now and Puleo said one parcel would be brought into conformance to the 10 -acre lot minimum requirement. Schumann made motion, Puleo seconded, to recommend approval of the variances as requested. All Ayes. Motion carried. Gaertner Variance for Oversized Garage The Board considered the request of David Gaertner, 8455 136th Street North (Duck Pass) for variances to permit construction of a 1,080 square foot accessory garage 19 feet from the side lot line where 40 feet is required, 25 feet from the front property line where 40 feet is required, and to locate the accessory garage closer to the road than the principle structure at 8455 136th Street North (Duck Pass). The location of wetlands and the septic system prevented the applicant from locating the garage elsewhere on the property. The applicant was proposing to construct the accessory building 14 feet from the home. Staff noted that the applicant could move the garage over one -foot to provide a 20 -foot side yard setback. At the time Duck Pass was approved, the required side yard setback was 20 feet. Puleo noted that only the corner of the garage would be 19 feet from the lot line and asked the applicant if there was a reason he needed 14 feet between the garage and the home. Mr. Gaertner explained there was a large tree between the house and garage he did not want to disturb it. Puleo said he saw no need to have the corner of the building setback 20 feet and Schumann agreed he did not want to endanger the tree. Puleo made motion, Schumann seconded, to recommend approval of the variances as requested. All Ayes. Motion carried. Adiournment Schumann made motion, Puleo seconded, to adjourn at 6:55 pm. All Ayes.
