HomeMy WebLinkAbout2008.12.11 BOZA MinuesMINUTES HUGO BOARD OF ADJUSTMENTS AND APPEALS December 11, 2008 Chairperson Schumann called the meeting to order at 6:30 p.m. PRESENT: Schumann, Galler, Puleo ABSENT: None ALSO PRESENT: Bryan Bear, Community Development Director (CDD) Rachel Simone, Associate Planner Dennis Fields, Community Development Assistant Approval of Minutes — November 13, 2008 Galler made motion, Puleo seconded, to approve the minutes for November 13, 2008 as presented. All Ayes. Motion carried. Triemert - Variance request from accessory building size requirement Rachel Simone, the Associate Planner, described the application to the Board of Zoning. Rachel explained that the applicant is in the agricultural zoning district. The applicant is asking for a variance from the structure size requirements to allow for two building additions totaling 5,688 square feet of accessory buildings. Rachel explained the differences in the two building additions and that one has already been constructed that exceeds the allowed amount. Staff feels that the variance conditions are questionable and makes a recommendation to approve the existing addition and deny the request for the second addition. Schumann asked if the total square ft included the lean to. Rachel replied, yes it is totaled from all the footings. Galler asked if the commission did not approve the existing addition would that require the applicant to remove it. Rachel stated that it would need to be removed, yes. Schumann opened the public hearing. The applicant Arnie Triemert came forth to answer questions from the Board of Zoning. Board of Zoning and Adjustments Meeting — December 11, 2008 - page 2 Mr. Triemert questioned why the lean to is part of the square footing of the buildings, and stated that he would like the addition on the back side of his building for a shelter for animals and for additional storage space. Puleo asked if he had any animals on the property right now. Triemert answered that he did not but would like to get some cows and a horse. Schuman asked the dimensions of his existing building and stated that he could accomplish his addition without a variance if he was to construct a cantilever. Mike Happ, 11624 Foley Blvd NW, Coon Rapids, MN, stated that he owns the property directly to the north and the addition would not bother him at all. He said that Mr. Triemert takes good care of his yard and property and this would just help him continue to do so. John Udstuen, 15190 Everton Ave N, thinks that the ordinance should be changed to allow more square feet of accessory building space. He also stated that Triemert's property is well maintained and the addition would help to clean up the lot. Schumann closed the public hearing. Puleo understands staffs reasoning for recommending denial of the variance, however agrees with the public that 3,600 sq feet is not that much for a ten acre lot. He thinks that this is a unique area because these parcels will remain 10 acre lots as stated in the comprehensive plan. He also noted that the present council has not wanted to be too restrictive when it comes to what someone can do with their property. Schumann asked if lofting sheds were legal within the city. Rachel answered that there is no language in the ordinance that restricts them. Schumann stated that he thought this wasn't an unreasonable request however maybe a cantilever could prevent him from having to get a variance Mike Happ added that the cantilever idea wouldn't work well because they would need oversized footings on the existing building to support it. Galler agreed with keeping the site clean but thought there could be a way the cantilever would work. Puleo motioned, Schumann seconded to approve the variance request to the city council.
