HUGO BOARD OF ADJUSTMENTS AND APPEALS
April 23, 2015
Chairperson Weidt called the meeting to order at 6:28 p.m.
PRESENT: Boland, Weidt
ABSENT: Gwynn
ALSO PRESENT: Rachel Juba, Planner

Approval of Minutes
Boland made motion, Weidt seconded, to approve the minutes for April 9, 2015, as presented.
All Ayes. Motion carried.
Petronack — Variance for accessory building location at 12997 Elmcrest Avenue N.
Planner, Juba, presented on the variance request to allow an accessory building to be placed in
front of the house, where the ordinance states that accessory buildings shall not protrude in from
of the principal building. The proposed accessory building would be 1,040 square feet and
would match the principal building in color and material.
Planner, Juba, described that the applicant owns two adjacent lots in the Kellison Addition
development. Both lots were planned and are allowed to have houses constructed on them. Juba
stated that the applicant is proposing to combine the lots into one parcel. The accessory building
is proposed to be located mostly on the vacant lot, not far from where the building site for a
house was planned. Juba described the accessory building to meet all applicable setback
requirements once the parcels are combined and that a condition of approval would be the
combination of the lots. Juba stated that the applicant is proposing a driveway from Elmcrest to
access the proposed accessory building.
Planner, Juba, described the criteria staff uses to evaluate variances, most notably: reasonable
use, unique circumstances, character of neighborhood, and spirit and intent. It was in staff's
opinion that there are practical difficulties in meeting the requirements for an accessory building
location. Juba concluded saying that staff recommends approval of the variance request for the
location of the accessory building.
Board member, Boland, wanted to verify the footprint of the structure that was as shown on the
plan was to scale with the actual structure.
Planner Juba stated everything was to scale.
Chairperson, Weidt, asked if there were any oppositions from neighbors on the variance request.
Planner, Juba, stated that she has received no calls regarding the proposed variance request.
Chairperson, Weidt, asked the applicant if the construction of the building was to take place this
summer.
The applicant, Michael Petronack, said that they plan to begin building the accessory building
this summer. He stated that he is waiting to see if his variance request is approved by the
Council to then go to the County and begin the process to combine his two lots.
Chairperson, Weidt, asked Planner, Juba, what the process is like to combine lots.
Juba stated that the process is pretty easy. The applicant would be required to go to the county
and request to combine lots, for tax purposes. The applicant would then pay a small fee and his
submittal will likely be accepted. Juba reminded the Board that there is a condition of approval
that the lots be combined or a building permit will not be granted.
Board member, Boland, asked the applicant about the materials that will be used to build the
accessory building.
The applicant, Michael Petronack, stated that the same builder who built their house will be
constructing the proposed accessory building. He said the appearance and materials used will
match their house.
Chairperson Weidt opened the public hearing.
No one stepped forward.
Chairperson Weidt closed the public hearing.
Boland made a motion, Weidt seconded, to recommend the approval to the City Council variance
to allow an accessory building to be placed in front of the house, where the ordinance states that
accessory buildings shall not protrude in front of the principal building.
All Ayes. Motion carried.
