To implement the improvements, City staff obtained several <br />permanent and temporary easements, including a temporary construction easement agreement between the <br />City of Lake Elmo and Easton Village LLC for the construction of a temporary haul road to gain <br />construction access along the north side of the railroad. <br /> <br />ISSUE BEFORE COUNCIL: Should the City Council approve the attached Temporary Construction <br />Easement Agreement for the Village Parkway UPRR between the City of Lake Elmo and Easton Village <br />LLC? <br /> <br />PROPOSAL DETAILS/ANALYSIS: The attached Temporary Construction Easement Agreement was <br />prepared by the City Attorney for the above referenced purpose using the City Standard form of easement. <br />Easton Village LLC requested the easement be changed to an easement agreement, thereby requiring City <br />Council approval. Upon City Council approval the agreement can be signed by the Mayor and City Clerk. <br /> <br />FISCAL IMPACT: None. <br />RECOMMENDATION: Staff is recommending that the City Council approve the attached Temporary <br />Construction Easement Agreement for the Village Parkway UPRR between the City of Lake Elmo and <br />Easton Village LLC. The recommended motion for this action is as follows: <br /> <br />Motion to approve the attached Temporary Construction Easement Agreement for the Village <br />Parkway UPRR between the City of Lake Elmo and Easton Village LLC.” <br /> <br />ATTACHMENTS: <br /> <br />1.
