RESOLUTION 92 -11 <br />CITY OF LADE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION APPROVING THE FINAL PLAT OF <br />STONEGATE PHASE I <br />WHEREAS, the City Council of the City of Lake Elmo has <br />previously considered and approved the preliminary plat of <br />Stonegate; and <br />WHEREAS, the Lake Elmo Planning Commission reviewed a final <br />plat for Stonegate Phase I at its March 23, 1992 meeting; and <br />WHEREAS, the final plat of Stonegate Phase I presented to <br />the City conforms to the City's subdivision ordinance. <br />NOW, THEREFORE BE IT RESOLVED that the City Council of the <br />City of Lake Elmo does hereby approve and accept the final plat <br />of Stonegate Phase I as the same as on file with the City <br />Administrator, subject to the following conditions: <br />1. The developer and the City shall execute a <br />developer's agreement and developer shall <br />deposit such security with the City in the <br />amountas determined by the City Engineer and <br />in a form as approved by the City Attorney. <br />2. The developer shall dedicate to the City 6.78 <br />acres for parks and trails. The developer is <br />credited with 0.41 acres of parkland dedication <br />since only 6.37 acres is required for dedication <br />in Phase I. This will be used when Phase II is <br />developed. In addition, the developer shall be <br />credited with an amount not to exceed $1,050 for <br />parkland dedication in Phase II for grading of <br />the trails in Phase I. Any remaining park <br />dedication will be a combination of land (trails) <br />and cash to meet code requirements. <br />3. The developer shall provide a current title <br />binder for Stonegate to the City Attorney for <br />review and approval. <br />4. The developer shall provide a legal description <br />for the outlet road from Stonegate Phase I thru <br />Phase II to the City Attorney so an easement can <br />be prepared, and said easement should be signed <br />by all record owners or parties who have a <br />mortgagee's interest; and legals and easements for <br />additional cul -de -sac areas. <br />
