CITY OF LAKE ELMO <br />COUNTY OF WASHINGTON <br />RESOLUTION 93-10 <br />Dated the 1 6th day of February, 1993. <br />Amended the 19th day of Mar-; 1993 <br />February (corrected cc7- 20 -93) <br />WHEREAS, Minnesota Statutes Chapter 414 is a comprehensive enactment <br />relating to procedures and criteria applicable to municipal incorporation, detachment <br />and annexation proceedings; and <br />WHEREAS, one of the stated purposes of Minnesota Statutes Chapter 414 is to <br />protect the integrity of the land use planning process within incorporated areas; and <br />WHEREAS, the Minnesota Municipal Board, pursuant to the provisions of <br />Minnesota Statutes Chapter 414, has denied the request of the City of Oakdale for <br />further annexation review within Section 32 and Section 33; and <br />WHEREAS, an amendment to the Lake Elmo Comprehensive flan has been <br />approved by the Metropolitan Council which extends the City's Municipal Service Area <br />easterly and allows the City to re- allocate sewer capacity from Section 32 and Section <br />33 to the newly extended Municipal Service Area; and <br />WHEREAS, such re- allocation is essential to the City of Lake Elmo's efforts to <br />allow reasonable development of property within its community; and <br />WHEREAS, the City of Lake Elmo has adopted development regulations <br />consistent with Metropolitan Council guidelines in order to facilitate reasonable <br />development within the extended Municipal Urban Service Area; and <br />WHEREAS, Senate File 491 and House Fife 220 have been introduced and, if <br />approved, would allow the City of Oakdale to petition the Municipal Board for further <br />annexation review within Section 32 and Section 33; and <br />WHEREAS, the title to Senate File 491 and House File 220 are inconsistent with <br />the content of the bills; and <br />WHEREAS, further annexation review within Sections 32 and 33 would <br />frustrate the City of Lake Elmo's efforts to plan for the reasonable development of <br />property within its community; and <br />
