CITY OF LAKE ELMO WASHINGTON COUNT', MINNESOTA RESOLUTION 94-5 A RESOLUTION GRANTING A MINOR SUBDIVISION TO Bonita and Donald Klatt and Walter and Gladys Goetschel WHEREAS, Donald and Bonita Klatt and Walter and Gladys Goetschel made application to the City of Lake Elmo for a minor subdivision pursuant to Section 401.042 of the Lake Elmo municipal Code of the following described parcels of land: KLATT The Westerly 20 acres of the East Half of the Northeast Quarter (E1/2 of NE1 /4), of Section Twelve (12), Township Twenty -nine (29) North, Range Twenty -one (21) West, being the West 329.5 feet of said East Half of Northeast Quarter (E1/2 of NE1 /4) of Section Twelve (12), Township Twenty -Nine (29) North, Range Twenty -one (21) West, subject to the right -of -way of township road. GOETSCHEL: The East Half of the Northeast Quarter (E1 /2 of NE1 /4) of Section Twelve (12), Township Twenty -nine (29) North, Range Twenty -one (21) West, except the Easterly One Hundred and Ninety -five (195) feet of the South One Hundred (100) feet of the said East Half of the Northeast Quarter (W1 /2 of NE1 /4) of said Section Twelve (12), and except the Westerly Twenty (20) acres of said East Half of the Northeast Quarter (E1 /2 of NE1 /4) of said Section Twelve (12), being the West Three hundred twenty -nine and five tenths (329.5) feet of the East Half of the Northeast Quarter (E1/2 of NE1 /4) of Section Twelve (12), Township Twenty -nine (29) North, Range Twenty -one (21) West, subject to the right of way of Township road. And EXCEPT that part therrof described in Docment No. 327717 :Warranty Deed dated October 3, 1974, recorded October 15, 1974 as Document 327717. Convey the East 330 feet of the West 659.5 feet of the North 660 feet of the NE114 of NE1 /4 of Section 12, Township 29, Range 21, containing 5.0 acres, more or less; subject to highway and other easements of record. WHEREAS, the Lake Elmo Planning Commission considered this request at a regularly scheduled meeting on December 13, 1993, and conditionally recommended approval of the requested minor subdivision, based on the following findings of fact: 1. The subject land is designated RAD on the City Land Use Plan Map; 2. The property is zoned Rural Residential (RR) 3. The minimum lot size in the RR zoning district is 10 acres 4. The new 20 acre parcel is consistent with the City's Comprehensive Plan NOW, THEREFORE, BE IT RESOLVED that a minor subdivision is hereby granted to Donald and Bonita Klatt and Walter and Gladys Goetschel and said minor subdivision shall create the following described parcels:
