City of Lake Elmo <br />Washington County, Minnesota <br />Resolution 94-2 <br />WHEREAS, the City of Lake Elmo feels very strongly that a joint project with the <br />City of Oakdale, to provide Sanitary Sewer to Section 32 and Section 33, would be <br />financially beneficial to both Cities; and <br />WHEREAS, the City of Lake Elmo has prepared a Joint Powers Agreement for <br />this Utility Extension Project which sets forth terms and conditions, that if agreed upon <br />by both Cities, will provide a means of constructing one sanitary sewer project rather <br />than two separate sanitary sewer systems; and <br />WHEREAS, an addendum to this Joint Powers Agreement is a Joint Resolution <br />of both cities affecting the detachment of certain lands from the City of Lake Elmo and <br />the annexation of such lands to the City of Oakdale, thereby resolving the jurisdictional <br />issues between the cities relative to the Subject Property without the necessity of costly <br />litigation; and <br />WHEREAS, the City of Lake Elmo will continue to oppose special legislation that <br />would afford the City of Oakdale the opportunity to petition the Minnesota Municipal <br />Board for the concurrent detachment and annexation of any property currently under <br />the jurisdiction of Lake Elmo within Section 32 and Section 33 to Oakdale, without the <br />City of Lake Elmo being afforded the same opportunity to petition the Minnesota <br />Municipal Board for the concurrent detachment and annexation of land currently under <br />the jurisdiction of Oakdale within Section 32 and Section 33. <br />NOW, THEREFORE, BE IT RESOLVED THAT: The City of Lake Elmo <br />respectfully requests its legislative representatives to sponsor the attached bill if and <br />when similar legislation is sponsored on behalf of the City of Oakdale. <br />BE IT FURTHER RESOLVED THAT: The City of Lake Elmo prefers that local <br />issues be resolved at local levels, and that intervention by the Minnesota State <br />Legislature will set a precedent in this instance and interfere with continued efforts by <br />the City of Lake Elmo and the City of Oakdale tq negotiate ape amicable resolution to <br />this issue. <br />. . . . . . ....... <br />Wyn John Mayor <br />Attest: <br />Mary I<Ueiffnler,/,',,ify� Administrator <br />
