CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />.RESOLUTION 96 -2 <br />A RESOLUTION REQUESTING A STATE -WIDE <br />MORATORIUM ON CONCURRENT DETACHMENT AND ANNEXATIONS <br />WHEREAS, in 1995, the City of Lake Elmo requested its legislative <br />representatives to propose legislation requiring resolutions of support from all <br />communities involved in concurrent detachment/annexation petitions; and <br />WHEREAS, the Chair of the Legislative Committee considering <br />detachment /annexation issues has determined that it would be in the State's best interest <br />to postpone consideration of new legislation governing detachment/annexations until <br />such time as issues are resolved between Cities and Township, both of whom disagree <br />with the current State regulations regulating detachment/annexations; and <br />WHEREAS, the City of Lake Elmo supports the position of the Chair, and further <br />supports the study of the detachment/annexation issues; and <br />WHEREAS, the City of Lake Elmo lost over six - hundred acres of prime <br />developable land, and spent in excess of $100,000 to oppose the concurrent <br />detachment/annexation of this six - hundred acres; and <br />WHEREAS, the Minnesota Municipal Board ruled in favor of the property <br />owner's petition for concurrent detachment /annexation, in spite of the City's compliance <br />with the State's Land Planning Act; and <br />WHEREAS, the City of Lake Elmo feels it is vitally important to protect the <br />integrity of the State's Land Planning Act, and the right it gives communities to plan and <br />control all development within its boundaries; and <br />WHEREAS, resolving detachment /annexation differences between Cities and <br />Townships is a positive first step needed in beginning a total review of the <br />detachment/annexation laws, and their apparent conflict with the State's Land Planning <br />Act. <br />NOW, THEREFORE, BET IT RESOLVED that the City of Lake Elmo <br />respectfully requests that the Minnesota Legislature impose a State -wide moratorium on <br />all future detachment/annexations until Cities and Townships resolve the <br />detachment /annexation issues in dispute. <br />
