CITY OF LAKE ELMO <br />WASULNGTON COUNTY, NTINNESOTA <br />RESOLUTTON NO. 97-24 <br />A Resolution granting a Conditional Use Permit to Robert Engstrom, FIELDS OF ST. CROIX for <br />a Community Support Agricultural FaniVWayside Stand in the Open Space Preservation Zoning District <br />WHEREAS, Robert Engstrom has applied for a Conditional Use Permit for a CSA Farm/Wayside <br />Stand and has submitted all required information and fees for the application for such permit on the parcel <br />of land shown as Oullot A of the Final Plat of the FIELDS OF ST. CROIX. <br />WHEREAS, Section 300 Open Space Preservation District, Subd. 53 (7) of the Lake Elmo <br />Municipal Code requires a Conditional Use Permit to operate a Wayside Stand in the City of Lake Elmo; <br />and <br />WHEREAS, the Lake Elmo Planning Commission at its May 12,1997 meeting recommended that <br />the City Council approve said Conditional Use Permit with conditions. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE <br />ELMO, NIINNESOTA, that a Conditional Use Permit for a CSA Farm/Wayside Stand, on the <br />aforementioned property is hereby granted, subject to the following conditions: <br />1. There shall be no sales of produce not typically grown in Pvfftmesota. <br />2. Only vegetables, fruits, herbs, trees, flower and eggs are allowed to be sold. <br />3. The elevations of the wayside sand shall be reviewed and accepted by the Planning <br />Commission before building permits are issued. <br />4. No exterior fighting is allowed except landscape lighting with an indirect light source. <br />5. The stand shall close at sunset during sales months. <br />G. Eight parldng spaces will be provided on the site. <br />7. Trash shall be kept within the wayside stand, contafficrizzed wifliifl the stand. <br />S. A small 4' x 8' sign is allowed at the entrance to the "Fields of St. Croix" identifying the <br />wayside stand and height shall be less than or equal to 10 feet above road grade. <br />This Conditional Use Permit may be rescinded, after a two week notice and a public hearing, if the <br />City Council finds that the public health, safety, or welfare is jeopardized. <br />ADOPTED this 20711 day of May, 1997, by the City Council <br />Elmo, <br />Washington County, Minnesota. <br />.
