CITY OF LAKE ELMO <br />WASHNGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2001-021 <br />F��-1U4 SOLUTION GRANTNG A VARIANCE TO SECTION 400.14, SUBD. SM <br />FOR LAKE ELMO VISTA <br />WHEREAS, Thomas Steffens, Metro Development Corporation, and Stephen Korhel have <br />applied for a variance to Section 400.14, Subd. 8M of the Lake Elmo Municipal Code to permit a street <br />right -of -way width of 48.91 feet along the north street frontage of Lot 1, Bock 1, Lake Elmo Vista. <br />WHEREAS, at its March 26th meeting, the Planning Commission recommended approval of the <br />variance requested based on compliance with the Findings required. <br />WHEREAS, at its April 3 d meeting, the City Council reviewed the variance requested by <br />Thomas Steffens and Stephen Korhel. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council approves a variance to Section <br />400.14 Subd. 8M of the City Code to permit a street right -of -way width of 48.91 feet along the North <br />street frontage of Lot 1, Block 1, Lake Elmo Vista based on the following Findings: <br />1. A strict application of the street right -of -way width standard would deprive the applicant <br />reasonable use of this land. <br />2. The variance will not be detrimental to the public health, safety and welfare. <br />3. The variance application is the result of an unusual hardship related to the physical <br />characteristics of this land related to an inaccurate calculation of the distance required to <br />accommodate a street right -of -way at this location by a prior Minor Subdivision. <br />ADOPTED, by the Lake Elmo City Council on the 3rd day of April, 2001 <br />Lee Hunt, Mayor <br />ATTEST: <br />{. <br />Mary ° ue " der, City, inistrator <br />4 <br />
