CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2002-022 <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR AN <br />DEPENDENT CARE CENTER FOR FAMILY VIOLENCE NETWORK <br />WHEREAS, Family Violence Network/HTC, Inc. and Dee M. Flatau -Cobb, 9730 <br />Hudson Blvd., has requested a Conditional Use Permit for a dependent care center. <br />WHEREAS, the Lake Elmo Planning Commission held a Public Hearing on <br />March 25, 2002, and reviewed and recommended approval of the Conditional Use <br />Permit. <br />WHEREAS, the Lake Elmo City Council, on April 2, 2002, reviewed the <br />application and the recommendation of the Planning Commission. <br />NOW, THEREFORE, BE IT RESOLVED, by the Lake Elmo City Council that a <br />Conditional Use Permit is hereby approved for a dependent care center subject to the <br />following conditions: <br />1. Inspection of the private septic system by a qualified septic system <br />technician; and, certification by that septic system technician of the <br />adequacy of the existing system for the intended use and occupancy. <br />Such inspection and certification shall be reviewed and approved by <br />the City Engineer prior to any use of the facility by FVN +HTC, Inc. <br />Maximum occupancy limitations, based on the septic system capacity, <br />shall be prescribed by the City Engineer. Exceeding those maximum <br />occupancy limits shall be a violation of the Conditional Use Permit <br />terms. <br />2. The existing facility shall not be modified to increase the number of <br />residency units, nor structurally enlarged in any manner. <br />3. All existing signage relating to the motel use of the site shall be removed <br />from the site within 30 days of occupancy by FV +HTRC, Inc. <br />
