CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2002-017 <br />A RESOLUTION REQUESTING CORRECTION OF A PUBLIC NUISANCE <br />WHEREAS, the City Council has been advised by the Public and the City Zoning <br />Administrator that it appears that effluent from a cesspool, septic tank, drainfield, for <br />human sewage disposal system is being discharged upon the surface of the ground at <br />9198 31" Street North; and, <br />WHEREAS, Section 1335.03, Subd. 6 of the City Code declares such discharge to <br />be a Public Nuisance; and Section 133 5. 10 provides for City actions and process to abate <br />a Public Nuisance. <br />NOW, THEREFORE, that the property owner(s) of record be advised by <br />Certified Mail that effluent discharge upon the surface of the ground at 9198 31 St Street <br />North is found to be a Public Nuisance by the terms of the City Code. <br />FURTHER, that the City Administrator be directed to, by Registered mail, serve a <br />Compliance Notice upon the property owner(s) of 9198 31St Street North, ordering said <br />property owners to immediately correct the Public Nuisance. <br />FURTHER, that the City Administrator be authorized and directed to undertake <br />whatever measures deemed necessary to abate the Public Nuisance, consistent with the <br />procedures specified by Section 1335.10 of the City Code, if the property owners have <br />not complied with the Compliance Notice within 5 days. <br />ADOPTED by the Lake Elmo City Council on 19th day of March, 2002. <br />ee Hunt, Mayor <br />ATTEST: <br />Mary uef r, City inistrator <br />
